<br />BE IT RESOLVED by the Board of County Commissioners of
<br />Indian River County, Florida, that this Board does herewith find and determin,
<br />as follows:
<br />1. That A. T. LE FEVRE and ALICE K. LE FEVRE, his wife,
<br />by and through their attorney, Chas. E. Smith, of Heath, Smith & Herring,
<br />have filed a Petition before this Board on the 10th day of April, 1962, at a
<br />meeting of said Board, requesting this Board to adopt a resolution closing,
<br />vacating and abolishing the public roads, streets, and rights-of-way located
<br />on the plat of Carver Colony Subdivision #1, as recorded in Plat Book 4, page
<br />87, Indian River County public records, as it pertains to the following describ
<br />ed land situated in Indian River County, Florida:
<br />All of the right-of-way of 40th Avenue as shown on the
<br />plat of Carver Colony Subdivision #1, as recorded in
<br />Plat Book 4, page 87, Indian River County public records,
<br />EXCEPT the west 30 feet of said 40th Avenue.
<br />2. That this Board has published two weeks' notice thereof one
<br />time in the Vero Beach Press Journal, a newspaper of general circulation
<br />published in Indian River County, Florida, said notice being published at
<br />least two weeks prior to the date stated therein for such public hearing.
<br />3. That said public roads, streets, and rights-of-way above de-
<br />scribed are not a State or Federal road and are not maintained by the State of
<br />Florida and are not located within the incorporated limits of any municipality
<br />and are located in Indian River County, Florida.
<br />4. That a public hearing thereon has been held by the Board of
<br />County Commissioners of Indian River County, Florida, in the offices of
<br />said Board in the Indian River County Courthouse, Vero Beach, Florida, on
<br />May 8, 1962, at 9:00 o'clock A. M.
<br />BE IT FURTHER RESOLVED that this Board does herewith close,
<br />vacate and abandon each and all of the above described public roads, streets,
<br />and rights-of-way and all portions thereof and does herewith renounce and
<br />disclaim any right of Indian River County, Florida, and the public in and to
<br />. all of said public roads, streets, and rights-of-way above described.
