CONTRACTOR's violation of Section 02225 — " Erosion Control and Treatment of <br /> Dewatering Water From the Construction Site . " <br /> 6 . CONTRACTOR's failure to make payment to Subcontractors or Suppliers for <br /> materials or labor in accordance with the respective agreements between the <br /> CONTRACTOR and the Subcontractors or Suppliers . <br /> ' SC- 15 . 02 . 13 Delete the third sentence in paragraph GC45. 0.2. 8 and insert the following in its <br /> place: <br /> If the unpaid balance of the Contract Price exceeds all claims , costs , losses , and damages <br /> (including but not limited to all fees and charges of engineers , architects , attorneys , and <br /> other professionals and dispute resolution or litigation costs ) sustained by OWNER arising <br /> out of or relating to completing the Work , CONTRACTOR will be paid for acceptable <br /> earned Work that is fully completed or partially completed , and executed in accordance <br /> with the Contract Documents , prior to the effective date of termination . <br /> ' SC- 15 . 02 . D Add the following new paragraph immediately after paragraph GC- 15. 02. C: <br /> D .
