2 . Payment Activities and Health Care Operations <br /> Administrator will be permitted to disclose Protected Health Information in accordance <br /> with 45 C . F . R. § 164 . 506(c) for the Payment activities of another Covered Entity or Health <br /> Care Provider and for the qualifying Health Care Operations of another Covered Entity. <br /> 3 . Covered Person Permission <br /> Administrator will be permitted to use or disclose Protected Health Information in <br /> accordance with an authorization or other permission granted by an Individual (or the <br /> Individual ' s Personal Representative) in accordance with 45 C . F . R . § 164 . 508 or 45 C . F . R . <br /> § 164 . 510, as applicable . <br /> 4 . Administrator ' s Own Management and Administration <br /> a. Protected Health Information Use <br /> Administrator will be permitted to use Protected Health Information as necessary <br /> for Administrator' s proper management and administration or to carry out <br /> Administrator' s legal responsibilities . <br /> b . Protected Health Information Disclosure <br /> Administrator will be permitted to disclose Protected Health Information as <br /> necessary for Administrator' s proper management and administration or to carry <br /> out Administrator' s legal responsibilities only (i) if the disclosure is Required by <br /> Law, or (ii) if before the disclosure, Administrator obtains from the entity to which <br /> the disclosure is to be made reasonable assurance, evidenced by written contract, <br /> that the entity will ( 1 ) hold Protected Health Information in confidence, (2) use or <br /> further disclose Protected Health Information only for the purposes for which <br /> Administrator disclosed it to the entity or as Required by Law ; and ( 3 ) notify <br /> Administrator of any instance of which the entity becomes aware in which the <br /> confidentiality of any Protected Health Information was breached . <br /> 5. De4dentified Health Information <br /> Administrator may use Protected Health Information to create De- Identified Health <br /> Information in conformance with 45 C . F . R . § 164 . 514(b) . Administrator may use and <br /> disclose De-Identified Health Information for any purpose, including after any termination <br /> of the Agreement and this Addendum . <br /> 6. Limited Data Set <br /> a. Creation of Limited Data Set. Administrator may use Protected Health <br /> Information to create a Limited Data Set : <br /> i . that contains the minimum amount of Protected Health Information <br /> reasonably necessary to accomplish the purposes set out in Paragraph b of <br /> this Section III . C . 6 , below ; and <br /> 3 <br /> HIPAA\BA Amend to ASO Agmt - fini <br /> August 12 , 2004 <br />
