1698329 <br /> THIS DOCUMENT HAS BEEN RECORDED <br /> IN THE PUBLIC RECORDS OF <br /> INDIAN RIVER COUNTY FL <br /> BK : 1952 PG : 471 , Pagel of 1 r <br /> 10/27/2005 at 12 : 22 PM , <br /> JEFFREY K BARTON , CLERK OF <br /> COURT <br /> INDIAN RIVER COUNTY EMERG Y1' b1L5R )2005 -01 <br /> WHEREAS , EXECUTIVE ORDER NUMBER 2005 - 117 [Emergency Management] <br /> was issued by Jeb Bush , the Governor of the State of Florida on October 19 , 2005 , and <br /> declared that Hurricane Wilma threatens the State of Florida with a catastrophic disaster; <br /> and <br /> WHEREAS , EXECUTIVE ORDER NUMBER 2005 - 117 [Emergency Management] <br /> declared that a state of emergency exists in the State of Florida for sixty (60 ) days from <br /> October 19 , 2005 , that is , until December 18 , 2005 , unless further extended ; and <br /> WHEREAS , Section 8 of the aforementioned EXECUTIVE ORDER found that the <br /> special duties and responsibilities resting upon some state , regional and local agencies <br /> and other governmental bodies in responding to the disaster may require them to deviate <br /> from the statutes , rules , ordinances , and orders they administer, and therefore gave such <br /> agencies and other governmental bodies the authority to take formal action by emergency <br /> rule or order in accordance with Sections 120 . 54 (4 ) and 252 . 46 (2 ) , Florida Statutes , to the <br /> extent that such actions are needed to cope with this emergency ; and <br /> WHEREAS , by operation of law, the aforementioned EXECUTIVE ORDER , <br /> Florida Statutes sections 252 . 36 , 252 . 38 , and 252 . 46 , and Indian River County Resolution <br /> 2005- 117 , executed October 23 , 2005 at 12 : 00 pm by the County Administrator ( pursuant <br /> to the authority of , the Indian River County Board of County Commissioners set forth in <br /> Indian River County Resolution 2005 - 176 , adopted October 20 , 2005 ) , a State of Local <br /> Emergency was declared in Indian River County for seven (7 ) days , unless further <br /> extended . ; pursuant to all of the foregoing , the Indian River County Board of County <br /> Commissioners has the authority to issue orders and rules during the period of the <br /> declared emergency , and has delegated the ability to issue Emergency Orders for Indian <br /> River County to the County Administrator, <br /> NOW, THEREFORE , this Emergency Order is issued , declaring that a curfew is in <br /> effect for Indian River County from 8 : 00 p . m . Monday , October 24 , 2005 and ending at <br /> 6 : 00 a . m . on October 25 , 2005 , and will expire at that time , unless further extended by <br /> subsequent Emergency Order. <br /> DONE AND ORDERED this 24th day of October, 2005 . <br /> osep A .
