AMENDMENT #1 <br /> to INDIAN RIVER COUNTY/IMPACT FEE STUDY CONSULTANT CONTRACT <br /> By and Between <br /> 1110 INDIAN RIVER COUNTY <br /> And <br /> 0� <br /> TINDALE -OLIVER & ASSOCIATES , INC . <br /> WHEREAS , on March 16 , 2004 , the County entered into a four month contract <br /> with TINDALE -OLIVER & ASSOCIATES , INC . to provide consulting services to <br /> complete an impact fee study for 8 new impact fees ; and <br /> WHEREAS , on June 8 , 2004 , the Board of County Commissioners approved an <br /> 8 week contract extension to provide time for the School District of Indian River County <br /> to complete its five year capital improvement plan and to provide time for the School <br /> District to review and comment on the impact fee study; and <br /> WHEREAS , both Hurricane Frances and then Hurricane Jeanne , beyond the <br /> control of either the County or Tindale-Oliver & Associates , Inc . , disrupted county <br /> government and school operations severely, therefore limiting the amount of available <br /> time for county and school district staffs to review and provide comments to consultants <br /> regarding the Impact Fee Study and necessitating that the agreement be extended , <br /> NOW, THEREFORE , in consideration of the following mutual covenants and <br /> agreements INDIAN RIVER COUNTY , FLORIDA and TINDALE -OLIVER & <br /> ASSOCIATES , INC . do agree as follows : <br /> 1 . The original agreement , dated March 16 , 2004 , shall remain in full force and <br /> effect until February 28 , 2005 . <br /> 2 . Except as supplemented herein , the terms and conditions of the Agreement <br /> shall remain in full force and effect .
