2/03(easemenUpartrel)MEFlk 03 <br /> a7l <br /> PARTIAL RELEASE OF EASEMENT <br /> WHEREAS , Indian River County (" County" ) has an existing utility <br /> easement from IR Mall Associates , Ltd . , located at Indian River Mall ( "Mall " ) , <br /> that is recorded in O . R. Book 1172 , Page 1053 et seq . ; and <br /> WHEREAS , in connection with new construction going on at the Mall , it is <br /> necessary to relocate a portion of the County' s existing utility easement; and <br /> WHEREAS , County staff has determined that the release of a certain <br /> portion of the existing easement in exchange for a new easement running <br /> parallel to the existing easement would not adversely affect the County; and <br /> WHEREAS , IR Mall Associates , Ltd . has executed and delivered , <br /> contemporaneously herewith , a new Easement for utility purposes to the County , <br /> so that the existing utility lines may be relocated from the released easement <br /> property to the new easement property; <br /> NOW, THEREFORE , THIS PARTIAL RELEASE OF EASEMENT is <br /> executed by the Board of County Commissioners of Indian River County, a . <br /> political subdivision of the State of Florida , whose mailing address is 1840 25t' <br /> Street , Vero Beach , Florida 32960 , to IR MALL ASSOCIATES , LTD . , 115 W . <br /> Washington , Indianapolis , IN 46204 , Its successors in interest , heirs and <br /> assigns . <br /> Indian River County does hereby release and abandon all right , title , and <br /> interest that it may have solely to the area described on Exhibit "A" attached <br /> hereto and made a part hereof, and the remainder of the Easement recorded in <br /> O . R . Book 1172 , Page 1053 et seq . is unaffected by this Partial Release . <br /> IN WITNESS WHEREOF , the Grantor has caused these presents to be <br /> executed in its name this 8th day of April , 2003 , <br /> Attest: J .
