16 . 1 SUBRECIPIENT agrees to comply with the provisions of Section 202, Executive Order <br /> 11246 and with the guidelines for applicants on equal opportunity obligations for <br /> Community Development Block Grants in regard to construction contracts. <br /> 16 .2 SUBRECIPIENT agrees that it will comply with the following assurances : <br /> a. SUBRECIPIENT agrees to comply with all applicable Federal, State, and County <br /> laws, ordinances, codes and regulations . Any conflict or inconsistency between <br /> the above Federal, State or COUNTY guidelines and regulations and this <br /> Agreement shall be resolved in favor of the more restrictive regulations . <br /> b . In accordance with Title VI of the Civil Rights Act of 1964 (P . L . 88 - 352), no <br /> person in the United States shall, on the grounds of race, color, or national origin, <br /> be excluded from participation in, be denied the benefits of, or be otherwise <br /> subjected to discrimination under any program or activity for which <br /> SUBRECIPIENT receives Federal financial assistance . <br /> c . In accordance with 24 CFR 570 . 505 , property acquired or improved in whole or <br /> in part using CDBG funds in excess of $25 ,000 . 00 must be used as intended from <br /> the date CDBG funds are first spent until five (5) years after the closeout of <br /> COUNTY' S participation in the CDBG Program. Any transfer of the property or <br /> structure shall also be bound. <br /> d. If applicable, SUBRECIPIENT shall inform affected persons of the benefits, <br /> policies, and procedures provided for under HUD regulations . <br /> e. SUBRECIPIENT shall establish safeguards to prohibit employees or members of <br /> their board from using positions for a purpose that is or gives the appearance of <br /> being motivated by a desire for private gain for themselves or others, particularly <br /> those with whom they have family, business, or other ties. Should such possible <br /> conflicts, real or apparent, arise, SUBRECIPIENT shall disclose such situations to <br /> COUNTY and COUNTY Attorney' s Office for review. <br /> f. SUBRECIPIENT agrees further that it shall be bound by the standard terms and <br /> conditions used in the Grant Agreement between DEPARTMENT and COUNTY <br /> and such other rules, regulations or requirements as DEPARTMENT may <br /> reasonably impose in addition to the aforementioned assurances at or subsequent <br /> to the execution of this Agreement by the parties hereto . <br /> g. In accordance with the Drug Free Workplace Action of 1988 , SUBRECIPIENT <br /> certifies that it has a policy designed to ensure that SUBRECIPIENT' S workplace <br /> is free from the illegal use, possession, or distribution of drugs or alcohol. <br /> h. In compliance with Paragraph (2) (a) of Section 287 . 133 , Florida Statutes , a <br /> "person or affiliate who has been placed on the convicted vendor list following a <br /> conviction for a public entity crime may not submit a bid on a contract to provide <br /> any goods or services to a public entity, may not submit a bid on a contract with a <br /> public entity for the construction or repair of a public building or public work, <br /> may not be awarded or perform work as a contractor, supplier, subcontractor, or <br /> consultant under a contract with any public entity, and may not transact business <br /> with any public entity in excess of the threshold amount provided in Section <br /> 287 . 017, for category two for a period of 36 months from the date of being placed <br /> on the convicted vendor list.
