EXHIBIT 1 <br /> SCOPE OF SERVICES <br /> Jones ' s Pier <br /> • The FDEP will approve the use of RMO Level II with respect to the <br /> identified ground water impacts . <br /> • Following the completion of one year of quarterly ground water <br /> monitoring, the localized ground water quality will meet the minimum <br /> requirements for RMO Level II . <br /> • The Site will be used for conservation purposes . <br /> • Indian River County is amenable to the application of institutional <br /> controls as a remedial strategy for the Site . <br /> SCOPE OF SERVICES <br /> The following Scope of Services was prepared to address the soil and ground <br /> water impacts on the Site in accordance with the regulatory requirements of <br /> Chapter 62 - 780 , FAC . This scope of services is based on our knowledge of the <br /> Site , the current Site conditions , and our practical experience with similar <br /> contaminated sites throughout the State . <br /> Task I — Site Assessment <br /> The Limited and Expanded Phase ll Environmental Site Assessments ( ESA ) <br /> completed in June and July 2008 have provided preliminary data regarding the <br /> site - specific soil and ground water quality . However , based on our experience <br /> with FDEP and the requirements for Site Assessment Reports additional <br /> sampling will be required . <br /> The results of the Limited and Expanded Phase II ESAs suggest the presence of <br /> pesticides in the soil above either the ground water or the marine surface water <br /> default leachability SCTL , defined in Chapter 62 - 777 , FAC . However, no soil <br /> impacts were identified above the residential or commercial direct contact <br /> exposure SCTL . Furthermore , pesticides have not been identified in the ground <br /> water above the GCTL . One monitoring well exhibited elevated concentrations <br /> of ammonia above the GCTL . As such , KHA proposes the collection of site <br /> assessment data in association with Chapter 62 - 780 , FAC . <br /> The purpose of the site assessment will be to demonstrate that : <br /> • Pesticide compounds are not present in the soil above the residential or <br /> commercial default SCTL . <br /> • Low - level pesticide concentrations is the soil are not leaching into the <br /> ground water . <br /> • Pesticide concentrations are not present in the ground water above the <br /> GCTL . <br />
