RELEASE OF EASEMENT <br /> WHEREAS , on February 16 , 2005 Craig Kovaleski and Carroll <br /> Stevens ( now known as Carroll Kovaleski) granted an easement for sidewalk , <br /> drainage and utility purposes to Indian River County, Florida ; said Easement <br /> being recorded in O . R . Book 1969 , Page 907 of the Public Records of Indian <br /> River County , Florida ; and <br /> WHEREAS , the legal description of said easement contained a <br /> scrivener's error resulting in the entire parent parcel being made subject to the <br /> easement; and <br /> WHEREAS , by a subsequent Corrective Easement , recorded in <br /> O . R. Book _, Page of the Public Records of Indian River County, Florida , <br /> Craig Kovaleski and Carroll Kovaleski (formerly known as Carroll Stevens) <br /> corrected the legal description to reflect the true intent; and <br /> WHEREAS , the Board of County Commissioners wishes to <br /> eliminate any cloud of title from the property not originally intended as an <br /> easement for sidewalk , drainage and utility purposes , <br /> NOW, THEREFORE , THIS RELEASE OF EASEMENT is executed <br /> on behalf of the Board of County Commissioners of Indian River County, a <br /> political subdivision of the State of Florida , whose mailing address is 1801 27Th <br /> Street, Vero Beach , Florida 32960 , Grantor, to <br /> Craig Kovaleski and Carroll Stevens (now known as Carroll Kovaleski ) <br /> 630037 th Street <br /> Vero Beach , FL 32966 <br /> their successors in interest , heirs and assigns , Grantee , as follows : <br /> Indian River County does hereby release and abandon all right, <br /> title , and interest that it may have in the following described easement : <br /> The South % of Tract 22 together with the South <br /> 95 feet of the North '/2 of Tract 22 , less the West 80 <br /> feet of the South 758 . 14 feet of Tract 22 and less <br /> the East 35 feet of the South 758 . 14 feet of Tract <br /> 22 all in the South 1/2 of Section 29 , Township 32 <br /> South , Range 39 East, according to general plat of <br /> lands of the Indian River Farms Company <br /> Subdivision as filed in Plat Book 2 , Page 25 of the <br /> 1 <br />
