LEASE EXTENSION <br /> This Agreement for Lease Extension ( "Amendment" ) entered into on the 18th day <br /> of November, 2008 , by Indian River County, a political subdivision of the State of Florida , <br /> 1801 27th Street , Vero Beach , FL 32960 ("County" ) , and Donald R . and JoAnne M . <br /> Staszewski , ( "Tenant" ) whose address is 1940 58th Avenue , Vero Beach , FL 32966 . <br /> WITNESSETH : <br /> The County purchased Tenant ' s property on April 17 , 2008 . The property contains <br /> a two story structure and is 0 . 459 acres in size ; and <br /> WHEREAS , the purchase of the property was in lieu of eminent domain , as the <br /> County is planning widening and improvements to the intersection of 58th Avenue and <br /> State Road 60 ; and <br /> WHEREAS , as part of the consideration for purchase of the property , the County <br /> agreed to lease- back the property to Tenant until January 31 , 2009 ; and <br /> WHEREAS , the Tenant has requested an extension to the lease and the County is <br /> not planning to begin road construction of the 58th Avenue/SR 60 project within that time ; <br /> and <br /> WHEREAS , the County has no objection to extending its lease with Tenant for an <br /> additional one year period , <br /> NOW , THEREFORE , in consideration of the mutual terms and promises stated <br /> herein , and other good and valuable consideration , the receipt and sufficiency of which is <br /> hereby acknowledged , the County and Tenant agree as follows : <br /> 1 . The foregoing recitals are true and incorporated as if fully restated herein . <br /> 2 . The first and second paragraph of that certain Lease Agreement dated April 17 <br /> 2008 is hereby amended to terminate on January 31 , 2010 , <br /> 3 . In the event that the County needs access to the property prior to the termination <br /> of this lease extension , the County shall notify the Tenants in writing and the <br /> tenants shall have sixty (60 ) days to vacate the premises . <br /> 4 . Except as amended herein , the terms and conditions of the Lease shall remain <br /> in full force and effect . To the extent of any conflict between the terms of this <br /> Amendment and the terms of the Lease , the terms of this Amendment shall <br /> control . <br /> 1 <br />
