| SECTION 1 
<br />The Board of County Commissioners of Indian River County, 
<br />Florida, does herewith find and determine that Spoil Islands located in the 
<br />navigable waters of the Indian River are to be used and enjoyed by the people 
<br />in a manner consistent with the public interest and in the further promotion 
<br />of thL ecology and environment surrounding said Spoil Islands. 
<br />SECTION 2 
<br />Spoil Islands are herewith established in the Intracoastal tidal 
<br />waters in the navigable waters lying within and off shore from any existing 
<br />lands bordering thereon in the County of Indian River said Spoil Islands 
<br />being more particularly identified, as set forth and located on a drawing 
<br />hereto attached and marked Exhibit A, and as such is made a part hereof 
<br />and this Resolution, together with said drawing, shall be recorded in the 
<br />public records of Indian River County, Florida, in the Book of Plats of said 
<br />County. Said Spoil Islands are shown on the attached Exhibit A which con- 
<br />sists of United States Department of Commerce, Nautical Chart 845 -SC, 
<br />12th Edition, dated September 8, 1973, which said map or chart consists 
<br />of sheets 1 through 4 inclusive. The Spoil Islands are super- 
<br />imposed in ink and identified by number on said map for the purpose of 
<br />clarification, and the following definitions and descriptions are made a part, 
<br />to -wit: 
<br />(Commencing from the North boundary of Indian River County, Florida.) 
<br />ISLAND # 1 - A parcel of land lying in the Indian River in the SW 
<br />1/4 of Section 30, Township 30 South, Range 39 East, lying West of the 
<br />Intracoastal Waterway, Southerly of Channel Marker "62" and Northwesterly 
<br />of Channel Marker "64", as designated on Nautical Chart 845 -SC. 
<br />ISLAND # 2 - A parcel of land lying in the Indian River in the NW 
<br />1/4 of Section 31, Township 30 South, Range 39 East, lying West of the 
<br />Intracoastal Waterway, Southwesterly of Channel Marker "64" and North- 
<br />westerly of Channel Marker "65", as designated on Nautical Chart 845 -SC. 
<br />ISLAND # 3 - A parcel of land lying in the Indian River in the 
<br />South 1/2 of Section 31, Township 30 South, Range 39 East, lying West of
