D I <br /> MEMORANDUM OF AGREEMENT <br /> This Agreement is entered into by Indian River County Board of County Commissioners , "the <br /> County" , and Teamsters Local Union No . 769 , "the Union . " <br /> The County and the Union mutually agree to the following terms and conditions set forth below : <br /> • Bargaining Unit employees will not receive anniversary increases or lump sum anniversary <br /> payments for FY 2009 /2010 , as listed in Article 33 . 1 of the Collective Bargaining <br /> Agreement . Additionally , the Union will not demand to bargain for the cost of living <br /> increases for FY 2009/2010 as listed in Article 33 . 2 of the Collective Bargaining Agreement. <br /> This Agreement will not affect the normal pay practices afforded in the collective bargaining <br /> agreement including, but not limited to , incentive pay , on - call pay , call -back pay , <br /> promotional increases , and/or probationary increases . <br /> • The County will not implement a furlough program that will reduce the regularly scheduled <br /> work week of full -time Bargaining Unit Employees for FY 2009/2010 . <br /> • General Non- Bargaining Unit Employees , under the purview of the County Administrator, <br /> shall not receive a COLA increase , anniversary increase or lump sum anniversary payment <br /> for FY 2009/2010 . This Agreement will not affect the normal pay practices afforded in <br /> County Policies including , but not limited to , incentive pay , promotional increases , and <br /> probationary increases . <br /> • As of July 6 , 2009 , two filled full -time bargaining unit positions are being recommended for <br /> elimination , 1 — Chief Operator (Sludge Facility) and 1 — Senior Maintenance Worker <br /> (Traffic Engineering) . Based on negotiations of this Agreement , the County agrees to fund <br /> the Senior Maintenance Worker and transfer the Chief Operator to a Treatment Plant <br /> Operator " C" position at the maximum of the range for a Treatment Plant Operator " B " <br /> position . Additionally, the County will agree not to make an additional reduction of the <br /> equivalent of 8 — 10 bargaining unit positions in the proposed FY 2009/2010 budget if the <br /> union agrees to forgo their FY 2009/2010 increases as defined in the first bullet point . <br /> • Bargaining Unit Employees and the Indian River County Board of County Commissioners <br /> must vote to ratify this Agreement . <br /> • If any of the aforementioned terms and conditions are breached or not accepted , or if either <br /> party fails to ratify the Agreement, then this entire Agreement is null and void .
