7 <br />7/1/86 - FORMS <br />ENVIRONMENTAL PLANNING <br />Challacombe/Jefferson <br />ORDINANCE NO. 86- 56 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, <br />AMENDING SECTION 24: OFF-STREET PARKING AND <br />LOADING REGULATIONS, OF APPENDIX A OF THE CODE OF <br />LAWS AND ORDINANCES, KNOWN AS THE ZONING CODE, <br />PROVIDING FOR LIMITED REDUCTION OF REQUIRED <br />PARKING SPACES FOR THE PROTECTION OF TREES: <br />PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; <br />CODIFICATION; SEVERABILITY; AND EFFECTIVE DATE. <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA that, <br />A new paragraph, Section 24(b)(8) Appendix A of the <br />Code of Laws and Ordinances, Indian River County is hereby <br />created and shall read as follows: <br />The number of required parking spaces may be reduced <br />where a protected tree on a given site, as defined by <br />the County tree protection ordinance, is located <br />within the par area. The allowable reduction of <br />spaces shall be one space for each protected tree up <br />to a maximum of ten percent (10%) of the total number <br />of reauired parking spaces after meeting the <br />following requirements: <br />1) the off-street parking area shall contain_ a_ <br />minimum of ten (10) parking spaces, <br />2) the applicant shall agree to replace each <br />protected tree with a parking space in the event <br />of the death or removal of such trees used for <br />parking space reduction. <br />The Planning & Zoning Commission shall review and <br />authorize all parking space reductions based upon <br />protection of trees. <br />REPEAL OF CONFLICTING PROVISIONS <br />All previous ordinances, resolutions, or motions of <br />the Board of County Commissioners of Indian River County, <br />Florida which conflict with the provisions of this ordinance are <br />hereby repealed to the extent of such conflict. All Special <br />Acts of the legislature applying only to the unincorporated <br />portion of Indian River County and which conflict with the <br />provisions of this ordinance are hereby repealed to the extent <br />of such conflict. <br />
