RESOLUTION NO. 2009-011 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, OPPOSING SENATE BILL 630 (2009 <br />LEGISLATIVE SESSION). <br />WHEREAS, Senate Bill 630 introduced by Senator Bennett will prohibit <br />counties and municipalities from imposing or collecting impact fees for any purpose <br />from October 1, 2009 through September 30, 2012; and <br />WHEREAS, the State Legislature should focus on state issues and leave <br />local issues to local government; and <br />WHEREAS, impact fees are a uniquely local issue, involving the allocation <br />of the costs of growth between existing local taxpayers and new residents; and <br />WHEREAS, a prohibition on impact fee collection could jeopardize <br />economic development activity by removing a funding source to satisfy State imposed <br />concurrency requirements, as well as jeopardizing the repayment of loans made to fund <br />capital projects; and <br />WHEREAS, Senate Bill 630 is a direct attack on the local home rule <br />concepts embodied in the 1968 amendments to the Florida State Constitution, <br />NOW, THEREFORE, BE IT RESOLVED THAT: <br />1. The Board of County Commissioners of Indian River County, <br />Florida opposes Senate Bill 630. <br />
