ORDINANCE NO. 2014- 014 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, CREATING SECTION 214.11 <br />(SUNSET DATE) OF CHAPTER 214 (STATE ROAD 60 INTEREST <br />SHARE FEE ORDINANCE) OF THE CODE OF INDIAN RIVER <br />COUNTY PROVIDING FOR SUNSET OF THE STATE ROAD 60 <br />INTEREST SHARE FEE ORDINANCE AT 5 P.M. ON SEPTEMBER 30, <br />2015; AND PROVIDING FOR SEVERABILITY, CODIFICATION, AND <br />AN EFFECTIVE DATE. <br />WHEREAS, on July 1, 2014, the Indian River County Board of County Commissioners <br />(the "Board") voted to terminate the collection of the State Road 60 Interest Share Fee on <br />October 1, 2015; and <br />WHEREAS, in order to prevent confusion, the Board is enacting a sunset date into <br />Chapter 214 (State Road 60 Interest Share Fee Ordinance) of the Code of Indian River County in <br />order to codify this policy; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, THAT: <br />Section 1. Enactment Authority. <br />Article VIII, § 1 of the Florida Constitution and Chapter 125, Florida Statutes vest broad home <br />rule powers in counties to enact ordinances, not inconsistent with general or special law, for the <br />purpose of promoting the public health, safety and welfare of the residents of the county. The <br />Board specifically determines that the enactment of this ordinance is consistent with general or <br />special law, and is necessary and appropriate to promote the health, safety and welfare of the <br />residents of Indian River County. <br />Section 2. Findings. <br />The Board finds that the above "Whereas" clauses are true and correct, and hereby incorporates <br />such clauses as findings of the Board. <br />Section 3. Creation of Section 214.11 (Sunset Date) of Chapter 214 (State Road 60 Interest <br />Share Fee Ordinance) of the Code of Indian River County (the "Code"). <br />Section 214.11 (Sunset Date) of Chapter 214 (State Road 60 Interest Share Fee Ordinance) of the <br />Code of Indian River County is hereby created to read as follows: <br />CODING: Words in strike thio format are deletions to existing text; words in underlined <br />format are additions to existing text. <br />
