INTERLOCAL AGREEMENT <br />BETWEEN <br />INDIAN RIVER COUNTY AND <br />STATE OF FLORIDA DEPARTMENT OF JUVENILE JUSTICE <br />T#IS AG , EMENT (the "Agreement") is made and entered into this IT day of <br />2018, by and between Indian River County, a political subdivision of the <br />State of Florida (hereinafter the "County"), and the State of Florida Department of Juvenile Justice <br />(hereinafter the "DJJ"). <br />WHEREAS, Pursuant to Section 939.185, Florida Statutes, the County collects fees <br />specifically for the operation and administration of juvenile alternative programs; and, <br />WHEREAS, The County has requested DJJ assist the County to provide juvenile diversion <br />programs (civil citation or other diversion programs) and to receive funds to use for operation and <br />administration of such programs; and <br />WHEREAS, the County and DJJ desire to enter into this Interlocal Agreement to allow <br />DJJ to assist the County. <br />NOW, THEREFORE, in consideration of these premises and mutual covenants contained <br />herein, the parties agree as follows: <br />L GENERAL <br />This Agreement is entered into pursuant to Section 163.01, Florida Statutes, Florida <br />Interlocal Cooperation Act. This Agreement embodies the whole understanding of the parties. <br />There are no promises, terms, conditions, or obligations other than those contained therein, and <br />this Agreement shall supersede all previous telecommunications, representations, or agreements, <br />either verbal, or written, between the parties hereto. The above recitals are true and correct. <br />2. COUNTY <br />The County agrees to provide funds on an annual basis to DJJ to provide juvenile diversion <br />programs (civil citation or other diversion programs) for Indian River County. <br />3. DJJ <br />DJJ agrees to receive funds annually (State fiscal year ("FY") July 1 — June 30) for distribution. <br />Based on information provided by DJJ, the County agrees to pay $27,500 for the juvenile diversion <br />programs for FY 2018-2019. For FY 2019-2020 and thereafter, the County will remit to DJJ the <br />fees collected annually pursuant to Section 939.185, Florida Statutes. DJJ will invoice the County in <br />October of each FY. DJJ will annually identify a contracted service provider to provide juvenile <br />
