' ✓/ " '/ ✓ L <br /> DEVELOPER AGREEMENT BETWEEN ' 3 y <br /> INDIAN RIVER COUNTY, FLORIDA <br /> AND <br /> S & S RENTALS, LLC <br /> THIS AGREEMENT, entered this () * day of 4T71pf , 2007, by and between <br /> INDIAN RIVER COUNTY, FLORIDA a political subdivision of the State of Florida, 180127`" <br /> Street, Vero Beach, Florida, 32960 hereafter called COUNTY and S & S RENTALS LLC, 400 <br /> HIGH POINT DRIVE, SUITE 500, COCOA, FLORIDA 32926, hereafter referred to as the <br /> DEVELOPER. <br /> WITNESSETH <br /> WHEREAS, the DEVELOPER has applied to develop a commercial development known as <br /> SUNOCO GAS STATION AND CONVENIENCE STORE on approximately 1 acre of land at <br /> CR512 / WATERVLIET AVENUE in Indian River County, Project Number SP-MA-06-12-62, the <br /> sketch and legal description is attached as Exhibit "A" and incorporated herein by reference, and; <br /> WHEREAS, the COUNTY is planning to make improvements to CR512 / WATERVLIET <br /> AVENUE and is in need of additional right-of-way along CR512 / WATERVLIET AVENUE; and <br /> WHEREAS, as a result of its development project, Developer is required to plan, construct <br /> and install a stormwater discharge to the CR512 drainage system; and <br /> WHEREAS, the COUNTY and DEVELOPER share mutual concerns with respect to <br /> improvements to CR512 / WATERVLIET AVENUE; and <br /> WHEREAS, both the COUNTY and DEVELOPER can mutually benefit each other through <br /> a joint effort that will provide needed right-of-way and stormwater management. <br /> THEREFORE, in consideration of the mutual terms, conditions, promises, covenants and <br /> premises hereinafter, the COUNTY and DEVELOPER agree as follows: <br /> 1. The above recitals are affirmed as being true and correct and are thereby incorporated <br /> herein. <br /> 2. The County has current plans to widen and improve CR512 / WATERVLIET AVENUE <br /> directly in front of Developer' s Property in the near future. In order to make the planned <br /> widening and improvements, the COUNTY agrees to purchase the following parcels from <br /> DEVELOPER: <br /> • approximalaly 0.08 acres along WATERVLIET AVENUE, <br /> • a 25 ' x 25' comer clip at the northwest comer of CR512/WATERVLIET <br /> 7:\PLANNING AND ZONINW&S ENTERPRISES, INCISS Rentals - 6evelopers Agreement Page 1 only.doc <br />
