The Board of County Commissioners of Indian,River County,
Florida, met at the Courthouse, Vero Beach, Florida, In a regular
meeting held at 8:00.o'clock, A. M., Wednesday, November.6, 1963. .
All members were present. Also .present were Ed Schmucker, County.Engi-
neei , John Sutherland, County Attorney, and Al Webber and Freda.
Wright, Deputy Clerks.
The Chairman asked if there were any changes or additions to
be made to the minutes of October.9 and 23, 1963. There were none
and upon Motion made by Commissioner Macdonald, seconded by Commis-
sioner McCulaers and unanimously carried, the minutes were approved

The Chairman read the foregoing Notice and asked if anyone
present wished to be heard. There being no one, Motion was made by
Commissioner Waddell, seconded by Commissioner Haffield and unanimously
carried, that the following Resolution be adopted.
RESOLUTION
The following Resolution was introduced by Commissioner

and unanimously carried:
WHEREAS, the Board of County Commissioners of Indian River County,
Florida, did receive and examine and tentatively adopt a proposed budget
of excess receipts and their expenditures for the fiscal year ending
September 30, 1964; and,
WHEREAS, this Board did cause a summary statement thereof to be
advertised one time in a newspaper of general circulation published in
Indian River County, Florida, to wit: in the issue of October 24, 1963,
of the Vero Beach Press Journal, as will more fully appear by proof of
publication thereof filed in the minutes of this Board; and,
WHEREAS, this Board did meet at the time and place stated in
said advertisement for the purpose of hearing requests and complaints of
the public regarding said Supplemental Budget and for the purpose of
holding a public hearing and making whatever revisions in the budget it
may deem necessary; NOW THEREFORE,
BE IT FURTHER RESOLVED, that the Board of County Commissioners of
Indian River County, Florida, does herewith tentatively adopt said Sup-
plemental Budget for the fiscal year ending September 30, 1964, in the
form heretofore tentatively adopted and duly advertised.
BE IT FURTHER RESOLVED, that said Supplemental Budget shall be
filed in the Office of the County Auditor as a public record and the
Clerk hereof shall transmit two copies of_the Supplemental Budget as
adopted to the Comptroller of the State of Florida and said Supplemental
Budget shall be considered as finally adopted and official upon approval •
as to form by the Comptroller.

Max Zimmerman appeared before the Board and presented a
petition requesting the Commissioliers,to provide ne4ded drainage in
the Howard and Preston Subdivision. After much discussion, •the
County Engineer was.requested to look over the situation to see if,a
little relief could be given on the North Gifford Road, but it was.
also pointed out by the Chairman that this was an unrecorded subdi-•
vision and private property and the county could not legally help
them.
Representatives of the Indian River County Businessmen
and .vomens' League, Inc., of Gifford, appeared before the Board to,
inquire about improvements of streets in the Gifford area. They
were advised that this was a slow project, that a survey had to be
made nand then ri_ ;ht -o yx: had to be acquired, before any improve -
monis could be made.

located on Lots 6 and 7, nzmbersand Beach Nc. 1, according to Plat
filed in Flat Book 3, page 70, public records of Brevard County,
Florida, now situate and being in Indian diver County, Florida, and
being used for public park purposes; and
AhE'vEAS, the Arabersand Beach Association, Inc., a non-profit
corporation, isa corporation formed for the purpose of promoting
:comMunity interest and welfare and for the improving and conducting
b..of the above Beach Park, and it appearing to the Board that it would
be to the best interest of the County that this Lease be entered into
with' said corporate body; and
WHEREAS, this Board is satisfied that said property is re-
quired for such use and it is not needed for County purposes;
NOW,,THEREFORE, be it resolved by the Board of County Com-
missioners of Indian River County, Florida, in regular session on
-this, the 6th day of November, 1963, that the Lease presented here-
with is hereby approved and the Chairman and Clerk of this Court
are hereby authorized and instructed to make, execute and deliver
said Lease for and in behalf of said County.
The County Attorney reported that everything was in order
for the exchange of the Mutinsky property. Motion was made by Com-
missioner Waddell, seconded by Commissioner Macdonald and unanimously
carried, that the County Attorney is authorized to complete the trans-
actioli and the Clerk is authorized to pay the expenses in connection
with same.

The Chairman read the foregoing Notice and opened bid as
Pippin Tractor and Equipment $3,890.00
There being no other bids, Motion was made by Commissioner
Macdodald, seconded by Commissioner Haffield and unanimously carried,
that the bid of Pippin Tractor and Equipment in the amount of $3,890.00
be accepted.
Ralph Lundy of Gifford appeared before the Board to inquire
about the traffic light for New U. S. 1 at Gifford. He was advised
that the State Road Department had been or would be requested to make
a traffic survey to determine just what is necessary.
Lisbon Futch and Kenneth Damerow appeared before the Board
and presented an aerial photo of the Sebastian Inlet. After consider-
able discussion, Motion was made by Commissioner Macdonald, seconded
by Commissioner Waddell and unanimously carried, that the County
Engineer be authorized to define, legally describe and advertise the
bulkhead line for the area on the south side of the Sebastian Inlet
and following the shore line south to the present beginning point of
the existing bulkhead line lying just south of the Sebastian Inlet.
This description to be made by Beindorf and Damerow who have prepared
the land corners -in association with the aerial photographs presented.
There shall also be described a traverse of the spoil area which is
approximately 500 feet wide and lying between 1400 feet and 5000 feet
Southwesterly of the intersection of ALA and the Sebastian Inlet.. And
to further authorize the basic application to be made with) the Trustees
of the Internal Improvement Fund.for the.above described spoil area
and to immediately send to them a marked aerial photograph showing the
proposed area to be used for the park and fill area to be used by the
Sebastian Inlet Commission. This aerial should also indicate a 150
foot 'easement .parallel to the south shore of the Sebastian .Inlet, and
Connecting AIA and the proposed spoil park area. This. 150 foot ease-
ment is to.be used by Indian River County and the.Sebastian Inlet Com-
7aissiom pp, an access and maintenance easement. Also to maintain a mini-
-ling100 foot wide canal leading from a .bay ' area into the Indian River.-

BE IT FURTHER RESOLVED that a copy of this Resolution be
forwarded to the East Central Florida Regional Planning Councih,.
the Florida Development Commission and the Home Finance Agency.
Motion was made by Commissioner idaddell, seconded by.Commis,-
sioner Raffield and unanimously carried, that the County Engineer,
Commissioner Waddell, Commissioner.Macdonald and the County Attorney
are authorized to attend :.regional Council meeting in Leesburg. on
November 13; Commissioner ':7addell is authorized -to attend the meeting
of State Association of County Commissioners in Tallahassee on
November 23; that the County Service Officer is authorized to attend
a meeting n St. Petersburg on November 21 and 22 and that the County

forwarded to the Board of County Commissioners of St. Lucie County,
Florida, with the request that they assist Indian River County in
acquiring this very important public facility and that a copy of this
Resolution be forwarded to the Trustees of the Internal Improvement
Fund, Tallahassee, Florida.
Motion was made by Commissioner McCullers, seconded by Commis-
sioner Waddell and unanimously carried, that public equipment cannot
be used on radar station as this is private property.
Motion was made by Commissioner Macdonald, seconded by Commis-
sioner Waddell and unanimously carried, that a 45 mile an hour speed
limit be placed on 20th avenue between 12th street and Glendale Blvd.
Motion was made by Commissioner Macdonald, seconded by Commis-
sioner McCullers and unanimously carried, that Tom Trent be appointed
as C ivil Defense Director of Indian River County at a salary of $200.00
monthly and that the City Council be requested to contribute $100.00 a
month toward his services and that the Clerk send a letter to the City
Council with this request.
Motion was made by Commissioner Macdonald, seconded by Commis-
sioner Waddell and unanimously carried, that the Annual Financial Report
of the County be accepted.
The following monthly reports were received and ordered filed•;
The County Service Officer, the County Agent and the County Welfare Worker.
Motion was made by Commissioner Macdonald, seconded by Commissioner
Haffield and unanimously carried, that the Clerk be authorized to make
monthly payments to the following on items budgeted: Alfred Lane, lawn
care, $40.00; Florida Child Welfare Service, $500.00; Humane Society of
Vero Beach, $150.00; G. Edward Baker, Zoning Dept., $40.00;' Indian River
County Payroll.A/C, Blue Cross Premiums -Co. share, $100.00; Philip Nourse,
State Attorney, $72.42; George Heath, State Attorney, $72.42; Clerk,
Orange County, Public Defender, $183.25; -Sheriff's Budget, 1/12 of
year and County Judge's Budget, 1/12 of year, also quarterly check,
Indian River:County Library Assn., $2,500.00.
Motion was made by Commissioner McCullers., seconded by Commis-
sionerWaddell and unanimously carried, that the Clerk is authorized to
pay. election. officials 10c per mile for travel expense.

The annual report of the sheriff 'was 'received. and ordered filed.
Motion was made by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously carried,, that the Minutes of November 20, 1962,
be amended to read "the Tax Assessor and the Tax Collector be authorized `
to share the cost of the data processing and tax billing machine, such
cost to be paid from fees accrued by the offices, in lieu of "that troy
and homer be authorized to advertise for_bid for the machine." and the
Tax Assessor is hereby authorized to make this purchase from. his current
fees and amend his budget for equipment for an additional amount of
$5,000.00.
.Motion was made by Commissioner Hatfield, seconded by Commissioner
;;=addell and unanimously carried, that the Sheriff be authorized to ad-
vertise for sale by the County all excess equipment.
The several bills and accounts against the County having been
audited, were examined and found correct, were approved and warrants
issued in settlement of s._tme as follows: General tevenue Fund, Warrant
cos. 2334 to 2405, both incl.ustve; aoad and Bridge Fund, Warrant Nos.
1501 to 15.50, both inclusive; Fine and Forfeiture Fund, Warrant Nos.

Monday, November 18, 1963
The Board of County Commissioners of Indian River County met
at the Courthouse, Vero Beach, Florida in a special meeting which
officially•convened at 9:10 o'clock P. M. on Monday, November 18,
1963. All members were present. , Also present were John H. Sutherland,
County Attorney; Edwin Schmucker, County Engineer; and Alfred H.
Webber, Deputy Clerk.
Mr. Conrad Tuerk, Mr..Roland Miller, Mr. Alex MacWilliam,
Mr. Jack Jennings, Miss Alma Lee Loy and others appeared and
expressed disagreement with the resolution adopted by the Board of
County Commissioners at the regular meeting on November 6, 1963,
wherein the Board notified the Trustees of the Internal Improvement
Fund of its unanimous disapproval of the application of Mr. Fred Tuerk
for purchase of submerged land in the Indian River containing 352.23
acres, more or less, a hearing on said application to be held by the
Trustees of the Internal Improvement Fund at Tallahassee on Tuesday,
November 26, 1963.
After considerable discussion, it was moved by Commissioner
Macdonald, seconded by Commissioner McCullers and unanimously carried,
that the Board rescind its action of November 6, 1963, in adopting
the resolution in question, and that the following resolution be
adopted in its place:
