In accordance with Contract No , 0725 2007 -2009 This Work Order No . 4 is in accordance with the existing AGREEMENT dated November 6th 2007 between Morgan Eklund , Inc . ( SURVEYOR) and Indian River County ( COUNTY) . This Work Order No . 4 amends the agreement as follows : SECTION I — PROJECT LIMITS This Work Order No . 4 is for the SURVEYOR to perform ADDITIONAL SERVICES to Work Order No . 3 dated September 9th , 2008 . Services shall be related field and office Surveying and Mapping services in connection with the final alignment determination and mapping of the existing Right of Ways of Old Dixie Highway ( North ) , from US1 traveling north to 691h Street . Limits include all properties associated with the project . SECTION II as SCOPE OF SERVICES As agreed upon between Morgan Eklund , Inc . and Indian River County , the SURVEYOR shall provide additional Professional Land Surveying services as follows : In an effort to minimize conflicts between Public/ Private lands and impacts on existing boundary and physical feature positions ; the SURVEYOR shall perform adequate " ' due diligence " services completing additional detailed survey tasks to further determine the historical and encumbered Right-of-Ways , positions and mapping of said alignments . Minimal tasks as outlined below to accomplish the agreed upon goals and objectives of the project . " Minimum " Additional services as follows : a . Additional field and office research and reconnaissance . b . Additional survey control and property corner locations . c . Professional consultation , coordination with Carter Associates , Inc . d . Obtain , review, utilize survey drawings and related documents retrieved from Carter Associates , Inc . files . e . Determine the " best" Right-of-Way alignment and provide recommendation to the COUNTY , prior to final mapping . f. Continue with original task and Right- of-Way mapping project as outlined in original Work Order No . 3 with Morgan Eklund , Inc . dated September 9th , 2008 . SECTION III — TIME FOR COMPLETION & DELIVERABLES/WORK PRODUCT 2 . Completion and Deliverables : a . "Additional services" project completion shall be within 30 calendar days of Notice to Proceed . b . Following completion of the "Additional Services " ; Time for Completion and Deliverables shall continue and adhere Section III within the original Work Order No . 3 with Morgan Eklund , Inc . c . Prepare maps , documents and supporting files in a way that the COUNTY or other consultants can readily use it for the design and analysis of the area , as defined . It shall contain all information necessary for third- party surveyor to independently recreate and/or utilize the survey work . It is acknowledged all final products become property of Indian River COUNTY and will be available for use by the public at large . a . The SURVEYOR ' S work product shall meet or exceed the minimum standards as defined by Sections II , III and IV or the COUNTY will not approve the SURVEYOR ' S request for payment . SECTION IV — COMPENSATION The COUNTY agrees to pay , and the SURVEYOR agrees to accept , for the above described services rendered as identified in Sections I , II , and III of this Work Order No . 4 , for a Time and Material , Not to Exceed amount of $4 , 950 . 00 . Time and Material based on the established Fee schedule in accordance with Contract No , 0725 2007 -2009 . All and /or any additional services not described hereon shall be pre - approved by the COUNTY . Approved additional services shall be invoiced at the rates disclosed in the approved fee schedule with the SURVEYOR for the contract year( s ) of November 6th , 2007 through November 5th , 2009 . All invoicing shall include project number ( 0845) , Work Order No . 4 (WO 4 ) , Contract Number ( 0725 ) , itemized man - hours and materials expended to complete the scope of services . Payments shall be in accordance with the original Professional Surveying and Mapping /GIS Services Agreement , Contract No : 0725 with the COUNTY and as stated in Section II , III and IV hereon . All remaining sections of the AGREEMENT shall remain in full force and effect , and are incorporated herein .
