The Board of County Caimissioners of Indiazf River County,
T' Florida, net at the Courthoua4,: Vero Beach, Florida, in a rear
meeting held at 8:00 o'clock, A. M., Wednesday, February 5, 1964.
All members were present. Also present were Ed Schmucker; County
Engineer, John Sutherland, County Attorney, and Al Webber and Freda
Wright, Deputy Clerks.
The. Chairman asked if there wtre A any changes. or additions
to be made to the minutes of January 8 and 22, 1964. There were
none and upon Motion made by Commissioner Macdonald, seconded by .
Commissioner Haffield and unanimously carried, the minutes were
approved as read.
At Webber reported that Miles B. Mank II, County Judge, .had
filed a.report of receipts and expenditures for the period of nine
months preceding October 1, 1963, when his office went on the Budget
system. This report was filed January 27, 1964, with the consent of
the State Comptroller.
Jim Howard of the Florida Forest Service of Indian River County,
appeared before the Board and gave a resume of their activities for
1963 and filed a written report with the Board.
The County Engineer presented a Contract Agreement from the
Florida East Coast Railway pertaining to maintenance costs of railway
crossings. After considerable discussion, Motion was made by Commis-
sioner Waddell, seconded by Commissioner Macdonald and unanimously
carried, that a figure of some kind be put in the Contract for an annual
maintenance amount not to exceed actual maintenance costs and furnish
or make the contract be actual maintenance costs subject to audit.
The County Engineer reported that drainage in unrecorded sub-
divisions have become a great problem. He reported that in the Howard
Preston Subdivision he has been unable to secure the necessary easements
for drainage. After considerable discussion, Motion was made by Commis-
' sioner Waddell, seconded by Commissioner McCullers and unanimously
carried, that an appeal be made to the Indian River Board of Realtors

and the same appeal to the Indian River Bar Association requesting
their cooperation in pointing out to their clients the possible
problems involved when buying property in unplated subdivisions, which
is that the County assume no maintenance on the access roads and assume
no responsibility for the drainage of these subdivisions.
The County Engineer requested permission to advertise for
radio antenna. After some discussion, the request was tabled.
The County Engineer reported that he had- reached an agreement
with Mrs. O'Steen for right of way on Church Street in Habeas() and
also there was one more parcel that he did not have to complete the
project. It was suggested that before any action be taken that he
get an appraisal on both of the properties.
Bill Taylor, Architect for Indian River County Health Center,
appeared before the Board and presented rough sketches of the new
health center. He stated that the reason things were moving so slowly
was because the application for funds had not been approved, but
should be approved this month.
. The County Engineer reported that he had had a request from
the Rockridge organization to set a speed limit on certain streets
in Rockridge. After some discussion, Motion was -made by Cbsmissioner
Waddell, seconded by Commissioner Macdonald and unanimoudly carried,.
that a 35 mile an hour speed limit be set on 17th Street from U. S. 1
to 3rd Court, on 6th Avenue from 14th Street to 18th Street and on
Rockridge Blvd. from U. S. 1 to 3rd Avenue.

Motion was made by Commissioner Waddell, seconded by Commis-
sioner McCullers and unanimously carried, that the low bid in the
amount of $4,540.56 of Maule Industries, Inc., be accepted.
Tom Trent, Civil Defense Director, appeared before the Board
and reported on his meeting with a representatives of the Civil Defense
Department of Jacksonville. After hearing his report, Motion was made
by Commissioner Macdonald, seconded by Commissioner Waddell and unanimously
carried, that the Civil Defense Director be authorized and requested to
request the Civil Defense Department of Jacksonville to transfer the
hospital facilities now stored in the Fellsmere school to some other

location when they desire to do so and that the Civil Defense Director
is authorized to move the Civil Defense office to the old county jail
building.
Commissioner Macdonald was appointed by the Chairman on the
liaison committee to work with the Civil Defense Director.
The County Engineer presented a report from St. Lucie County
outlining their various dump problems and after considerable discussion
the County Engineer was requested to get all costs and requirements
together pertaining to operating a sanitary land fill dump and then
further conbideratidn could be given the problem.
A request was submitted from the County Judge's secretary to
buy a used typewriter belonging to the Judge's office. The request was
denied.
Motion was made by Commissioner Macdonald, seconded by Commis-
sioner Hatfield and unanimously carried, that the County Engineer be
authorized to attend a meeting of the Flood Control in West Palm Beach
on February 7.
The County Engineer reported that Mr. Duerden would like some
action taken on the trailer on the property of Mr. Cowin in Sebastian.
Motion was made by Commissioner Macdonald, seconded by Coamissioner
Waddell and unanimously carried, that the County Enginelr be authorized
to exercise the regulations of the zoning law and take whatever steps
are necessary to make this property meet zoning requirements. .
Motion was made by Commissioner Waddell, seconded by Commissioner
Hatfield and unanimously carried, that in exchange for right of way on
16th Avenue from Les and Patricia Emarick, that we furnish culverts
and bulkhead to ditch on North boundary of his property.
The County Engineer presented a letter from the Fort Pierce
Junior College requesting the county to supply the use of, dump trucks
for filling the recreational area. After some discussion,'Motion was
made by Commissioner Waddell, seconded,by Commissioner McCullers and
unanimously carried, that the County Engineer be authorized to send
=cep trucks to Fort Fierce Junior College for Saturday, Feb. 8

and Saturday, February 15, as authorised in Section 550.131 and
550.14, Florida Statutes and as shown on page 145 County Commissioners
Manual, and any expenditures to be made be paid against the race track
fund,
Mr.. J. J. P. Hamilton appeared before the Board and filed a
Petition for abandoning easements in Winter Beach Estates Unit Two.
The County Engineer stated that there were no streets in this area.
Motion was made by Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried, that the following Resolution be
adopted.
RESOLUTION
tHEREAS, J. J. P. HAMILTON has applied to the Board of.County
Commissioners of Indian River County, Florida at its regular meeting
on February 5, 1964 to vacate all of the rights-of-way, easements or
alleys as shown on the Plat and dedicated by the owner of Winter Beach
Estates, Unit Two, recorded in Plat Book 1, page 49, and Re -plat of
that part of J. J. P. Hamilton's and E. W. Hamilton's land recorded
in Plat Book 2, page 28, Indian River County Records insofar as the
same may exist on the West h of the Southwest 34 of the Southeast 34
of Section 3, Township 32 South, Range 39 East, Indian River County,
Florida; said land being a part of Winter Beach Estates, Unit Two
and part of J. J. P. Hamilton's and E. W. Hamilton's land; and
WHEREAS, there was an apparent attempt in the replatting of
the J. J. P. Hamilton's and E. W. Hamilton's land which was recorded
in Plat Book 2, page 28 on February 10, 1934, to replat all of the
lands back to acreage and to do away with all streets, alleys, dedi-
cations, excepting, however, a road known as Winter Beach Bridge Road
(now known as North Winter Beach Road); and
WHEREAS, J. J. P. Hamilton has shown that he is the owner in
fee simple title to that property on which the easements, road rights-
of-way and alleys are sought to be released and vacated; and
WHEREAS, J. J. P. Hamilton has for many years maintained a

did not have any roads in said property other than North Winter Beach
Road; and
WHEREAS, said Board of County Commissioners, upon proof duly
shown, has found that there is not now, or ever has been, any use made.
by the public of said easements, road rights-of-way or alleys as shown
on the Plat of Winter Beach Estates, Unit Two or on the Repiat of land
belonging to J. J. P. Hamilton and E. W. Hamilton, except for North
Winter Beach Road (Winter Beach Bridge Road) which are herein sought
to be vacated; and
WHEREAS, said Board of County Commissioners has found that said
property is not located in any incorporated city or town, and that it
is for the best interest of the public and the owners of said property
that said plat be vacated insofar as the aforesaid easements are con-
cerned; and
WHEREAS, said Board of County Commissioners does further find
that it was authorized and empowered by Chapter 57-1412, Special Acts
of .1957, by Resolution adopted without public notice or hearing, to
vacate and abandon and to relinquish.and disclaim the rights:.of the
public acquired by dedication or otherwise to any and all, right-of-way
easments or alleys, either conveyed to said County or dfdicated to the
public by Plat or Deed recorded in said County.
BE IT, THEREFORE, RESOLVED by the Board of. County• Commissioners
.of Indian River County, Florida, this, the 5th day of February, A. D.
•1964 -in regular session that all of those easements, road rights-of-
way or alleys as shown on that part of Winter Beach Estates, Unit Two,
recorded in Plat Book 1, page 49, Indian River County Racords,_and on
the Plat'of that part of J. J. P. Hamilton's and!.$. W. Hamilton's
land as found in plat Book 2, page 28, Indian River.Couaty Records,
which are contained within the Wast 4 of the Southwest 4. of. the

provided, however, that this Resolution does not constitute abandonment
of any rights-of-way for U. S. Highway #1 or North Winter Beach Road
(Winter Beach Bridge Road) as the same now exist.
Motion was made by Commissioner McCullers, seconded by Commis-
sioner Waddell and unanimously carried, that John Gould and John Sutherland,
•Attorneys, be authorized to defend the suit against the county brought by
Nettie English.
A letter from Rockridge Property Owners Association requesting
the County to pave 17th'Street was received and after some discussion,
Motion was made by Commissioner Waddell, seconded by Commissioner McCullers

and unanimously carried, that the County Commissioners

for the paving of 17th Street which is a direct access

Mr. William Gartner and Mr. Larry Smith of the Research Divi-
sion of the State Road Department,.appeared before the Board and explained
a new material used in constructing roads and requested authority to use
Kings Highway as an experimental project. After considerable discussion,

and unanimously carried, that the Board of County Commissioners of Indian
River County, Florida, authorize the Research Division of the State Road Depart
ment to make experimental study of a portion of Kings Highway, known as
5O6 -A, for the purpose of determining the feasibility of using locally

Motion was made by Commissioner Macdonald, seconded by Commis-
sioner McCullers, and unanimously carried, to re -appoint Commissioner
Waddell as a member of the East Central Florida Regional Council.
Motion was made by Commissioner McCullers, seconded by Commis-
sioner Waddell and unanimously carried, to authorize the Clerk to have
the Clerk's Offices painted.
Commissioner McCullers stated that he was using County assis-
tance on Memorial Island and that this was being done at his request.
Motion was made by Commissioner Waddell, seconded by Commis-
sioner McCullers and unanimously carried, that the Sheriff be authorized
to build a shed on the jail property at a cost of approximately $450.00.
The Quarterly report of the Sheriff was received and filed with
the Clerk.
Motion was made by Commissioner Macdonald, seconded by Commis-
sioner McCullers and unanimously carried, to request the State Road De-
partment to make a survey of parking zones on South U. S. 1.
A copy of letter from Mrs. Vernon W. Khail to the Tax Assessor
complaining about taxes was presented by Al Webber, Deputy Clerk, but no
action was taken.
The Financial Report from the Indian River County Hospital
for the fiscal year ending September 30, 1963, was receivecy and filed in
the Clerk's Office.
Monthly reports were filed by the County Agent, the County
Welfare Worker and the County Service Officer.
.The several bills and accounts against the County, having been
audited, were examined and found correct, were approved and warrants is-
sued in settlement of same as follows: General Revenue Fund, Warrant
Nos. 2581 to 2634, both inclusive;.Road and Bridge Fund, Warrant Nos. 1685
to 1731 both inclusive; Fine and Forfeiture Fund, Warrant Nos.237 to 243,
both inclusive and Capital' Outlay, Warrant No. 84. Such bilis and accounts
being on file in the, Office of the Clerk of the Circuit Court, the Warrants
