The Chairman read the -foregoing notice and asked if anyone
present wished to be heard. Mr. Harvey Foe, Attorney representing
various property owners, was recognized by the Chair and at this time
presented argument and objections against the bulkhead line as advertised
by the Board. His main argument was that the bulkhead line traversed
land and this, in his opinion, was illegal.
Mr. Charles Herring, Attorney representing a group of property
owners in the bay area, requested that the bay included in the bulkhead
line description be left out entirely. After much discussion, Motion
was made by Commissioner Macdonald, seconded by Commissioner McCullers
and unanimously carried, that these groups get all information, surveys,
etc. together and meet with a committee at a later date and that no
action be taken on the bulkhead line at this time. The Chairman
appointed Co;mnissioner .vaddell, Commissioner Macdonald and the County
Engineer to serve on this committee.
yrs. Janet H. Showalter, Chairman of the Republican Executive
Committee, appeared before the Board and presented a list of persons
that she would like placed on the election board. She was informed by
the Chairman that the Boar would take it under ;.advisement.
Mr. .John Erickson who is obtaining right of way for Florida
Power and Liht Company ed before the Board and stated that

sixty foot easement through Von) Tropical Gardens Subdivision. The
County attorney advised hi.: tc- consult thr \ttornevs for Florida Power
and L.iht Company as he felt sure they would know what procedure is
necessary tc he followed.
After further considering Mrs. Showalter's request, the Chairman
requested the Clerk to write and advise her that the election officials
have been selected for the next election and should she or any other
person have any bona fide complaint against any election official in the
county, present it to the Commissioners and we will make any desirable changes.
Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, that the following named persons have
been selected to serve on the election board on May 5, 1964.

Bill Taylor, Architect for Health Center, appeared before
the Board and presented prelimary plans for the Health Department and
requested that site survey, plot plan and soil inspection, legal des-
cription and attorney's opinion and order an abstract and examine the
abstract and title opinion, be authorized. Motion was made by Commis
sioner Waddell, seconded by Commissioner Macdonald and unanimously
carried, that the above requests be authorized. Motion was made by
Commissioner Macdonald, seconded by Commissioner McCullers and
unanimously carried, that the preliminary plans be approved and the
contract executed.

BE IT RESOLVED by the Board of County Commissioners of
Indian River County, Florida, that this Board does herewith find
and determine as follows:
1. That KENNETH K. ATHA and MARGARET M. ATHA, his• wife,
sole owners of HAVEN VIEW SUBDIVISION, a subdivision of Indian
River County, Florida, filed a Petition before this. Board on the
4th day of March 1964 requesting the Board to adopt a Resolution
to close, vacate, abandon, renounce and disclaim any right of the
County and the public to a certain park area located in said
HAVEN VIEW SUBDIVISION, which said park was acquired by dedication
of said subdivision plat and is more particularly described as
follows:
That certain park area adjacent to Lot 12
HAVEN VIEW SUBDIVISION a subdivision as per plat
thereof recorded in Plat Book 5, page 23, and
re -plat thereof recorded in Plat Book 5, page 61
Public Records of Indian River County; said park
area is situate, lying and being in Indian
River County, Florida.
2. That this Board adopted a Resolution on the 4th day
of March 1964 declaring that the Board of County Commissioners of
Indian River County at a definite time and place would consider
the advisability of exercising the power granted to it with
respect to the vacation and abandoning of parks.
3. That this Board has published a notice thereof in the
Vero Beach Press -Journal a newspaper in general circulation in
Indian River County, Florida; said notice being published at
least two weeks prior to the date stated therein for such public
hearing.
4. That said park described above is not a state or
federal park and is not maintained by the County of Indian River,
the State of Florida, or the United States and is not incorporated

natural disaster plan presented by Civil Defense Director, -Tom Trent,
be approved and that he be authorized to spend $50.00 to have copies •
printed and that he and Ed Schmucker be authorized to go to Starke
for the purpose of purchasing equipment.
The County Engineer reported that he knew of forty acres
of land for sale that would make a good marl pit. He was advised
to check into the matter and find out just what it could be purchased
for.

WHEREAS, E. E. Carter did file a petition with the
Board of County Commissioners of Indian River County, Florida,
requesting said Board to adopt a resolution to vacate, abandon,
discontinue and close certain public streets and utility ease-
ments as hereinafter described, and,
WHEREAS, a public hearing was duly held by the said
Board on April 8, 1964, pursuant to Notice thereof duly published
in the Vero Beach Press Journal, a newspaper of general circula-
tion in Indian River County, Florida, which said publication was
had two weeks prior to the public hearing as required by law, and,
WHEREAS, the Board of County Commissioners, has duly
considered the same,

BE IT RESOLVED that the following described public

BE IT FURTHER RESOLVED, that notice of the adoption of
this Resolution shall be published once in the Vero Beach Press
Journal, a newspaper of general circulation in Indian River County,
Florida, and proof of publication of the Notice of Adoption of
this Resolution shall be recorded in the deed records of Indian
River County, Florida, as required by law.

Jack Davis appeared before the Board in order to work
out a settlement for his property in regard to right of way for West
Wabasso road. After considerable discussion, Motion was made by
Commissioner Waddell, seconded by Commissioner Macdonald and
unanimously carried, that this Board replace the two existing
fences with two new ones, before the old fences are torn down, that
two culverts are to be furnished and compensation as follows:

L. B. Vocelle, Attorney representing Mr. and Mrs. Kendall
appeared before the Board and stated that the Kendalls had been given
a notice of violation with regard to a trailer being kept on their
property at the corner of road 60 and Lateral A. He stated that the
trailer had been there for some time and that it was necessary in the
operation of their business because they were out of town a good
portion of the time and that it housed a caretaker. After hearing Mr.
Vocelle, Motion was made by Commissioner Waddell, seconded by Commis-
sioner McCullers and unanimously carried, that the County Engineer be
requested to withdraw the Notice of Violation from the Kendall's
property and that the matter be tabled.
A Resolution adopted by the Inlet Navigation District was
received and filed.
Three requests for submerged land were received and there
being no objection, they were filed with the Clerk.
The County Engineer asked the Commissioners if they desired
to have a maintenance contract on the airconditioners in the Court House.
He was advised to get the filters and have the janitor install them.
They did not feel it was necessary to put them under contract.

obtained as described above, and if'there should be any demand by the
State Road Department for any costs involved in the abandonment, it
shall be borne by Indian River County.
The County Engineer reported that Hobart Brothers have approxi-
mately 80 acres that could be used as a park site and suggested that the
Commissioners go to look over the property.
Commissioner Macdonald reported that Mr. Joe Michael had requested
that the Board consider constructing a bridge across the river at Sebastian
instead of Wahasso. The Chairman stated that plans were too near com-
pletion for the new Wabasso bride to even consider another crossing,

Motion was made by Commissioner Waddell, seconded by Commis-
sioner Hatfield and unanimously carried, that the County Engineer is
authorized to negotiate for right of way along ditch 1)-4 for the first

for beer and wi.ne license for Guy's Grocery Store be denied because it

After much discussion about: l i e guard for public beach at
Wabasso and the public beach known as ?mbexsand beach, Motion was made
by Commissioner Waddell, seconded by Commissioner Hifi e1 d and unanimously
carried, that Luther Perkins be hred as life guard for Anbersand Beach,
working first on weekends starting on the weekend of ipril 1.8th., then
on monthly basis, starting June 1 through Labor Day.
Motion was made by Commissioner Macdonald, seconded by Commis-
sioner Waddell and unanimously carried, that the County Engineer be
requested to write the State Road Department and request another traffic
survey in the Gifford area, in view of the fact that the ''previous survey
was not favorable and in view of the fact that there has been another
fatal accident in the area since the survey has been made.
Motion was made by Commissioner Macdonald, seconded by Commis

sioner Waddell and unanimously carried, that the County Engineer be
instructed to request the State Road Department to make a traffic survey
in the area of U. S. 1 from the Sebastian River Bridge for 5 or 6 blocks
South.
A letter was received from Dalrymple Insurance Agency regarding
obtaining some of the county's insurance. The County Engineer was re-
quested to write to Mr. Dalrymple and advise him that we are in the
process of compiling a list of all,tile insurance policies of the
county and that at the time of the expiration of any or all of these

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Indian River County, Florida at Regular Session this, the 8th day
of April, A. D. 1964,that the Lease presented herewith by the City
of Vero Beach, Florida is hereby approved and the Chairman and Clerk
of this Board are hereby authorized and instructed to make, execute,.
and deliver said Lease for and in behalf of said County, and that said
Lease shall be for a period of thirty (30) years with the provis
that the Lease may be terminated by Indian River County at any time
during its existence by giving the City of Vero Beach eighteen (18)
