Oslo Boat Ramp — IRC Project No . 0381 WORK ORDER NO . 1 ( Engineering ) FOR PROFESSIONAL SERVICES AGREEMENT WITH G . K . ENVIRONMENTAL , INC . This Work Order No . 1 ( Engineering ) is in accordance with the existing AGREEMENT dated March 153 2005 between G . K . Environmental , Inc . ( CONSULTANT) and Indian River County ( COUNTY) . This Work Order No . 1 amends the agreement as follows : PROJECT LIMITS This Work Order No . 1 is for the CONSULTANT to perform environmental services as required in Scope of Services for State and Federal Environmental Resource and individual permits . SCOPE OF SERVICES As agreed upon between G . K . Environmental , Inc . and Indian River County , the CONSULTANT shall provide environmental services to complete all tasks as outlined in this Work Order No . 1 and described as follows : TASK I — Permit Application Submittal Assistance / Meetings ( $ 39875 . 00 ) PHASE I : CONSULTANT to assist COUNTY staff and COUNTY ' S engineer and surveyor to complete required field work / meet / review work with COUNTY , review drawings , and permit application completion prior to submittal . GKE will coordinate and meet with surveyor , dredging companies , and State and Federal staff to review project . TASK II — Revised / Expanded State and Federal Seagrass / Submerged Resources Survey ( $ 2 , 970 . 00 ) PHASE II : Your project site is / may be located within the known range of Johnson ' s seagrass ( Halophilic johnsonii) a known federally listed species . Any proposed structure and/or work in waters of the state within the known range of Johnson ' s seagrass that does not have a valid and recent biological survey showing that Halophilia johnsonii does not occur at or adjacent to the project site will be further coordinated with the National Marine Fisheries Service ( NMFS ) under Section 7 of the Endangered Species Act and a determination of the " may affect" on the listed species will be made . The survey can only be conducted between April 1 and August 31 due to the limited growing seasons of this and other seagrass species . In order to ensure accuracy and to expedite the permitting process , it is highly recommended by regulatory agencies that a qualified biologist , such as GKE , complete the submerged resources and seagrass surveys . Oslo Road Boat Ramp September 8 , 2009 Agenda Page 2 of 5 TASK III — Benthic and Fish Surveys ( $ 3 , 520 . 00 ) PHASE III : Benthic invertebrates and fish sampling will be completed in channel area and adjacent mosquito control ( ease / west ) ditches . Results of these surveys will be presented in report form . Fish traps , seines , cast & dip nets and sediment coring devise / ponar grab sample will be used to collect data . Benthic samples will be filtered through sieve and contents identified . TASK IV — Revised Mitigation Plan ( $ 33300 . 00 ) PHASE IV : CONSULTANT will meet with COUNTY and permit agency staff to discuss mitigation options and inspect potential mitigation sites for compatibility and prepare a draft mitigation plan , based upon the ecological values of wetland impacts . TASK V — Uniform Mitigation Assessment Method ( UMAM ) ( $ 21860 . 00 ) PHASE V : CONSULTANT will conduct a Uniform Mitigation Assessment Method ( UMAM ) and /or a Wetland Rapid Assessment Procedure (WRAP ) of the wetlands located within the boundaries of the project site . UMAM /WRAP determines a numerical value for the ecological functions and ecological values of the existing wetlands and mitigation site . The UMAM/WRAP score can be used to determine what type / amount of mitigation will be required for the project site . The UMAM/WRAP score is based on vegetation , wildlife usage , hydrology , soils , water quality , success factor , and adjacent property . TASK VI — Revised Protected Species Survey ( $ 21750 . 00 ) PHASE VI : CONSULTANT will complete a detailed protected species survey on the referenced site . CONSULTANT ecologist will conduct a preliminary systematic survey for protected species in accordance with Florida Fish and Wildlife Conservation Commission ( FFWCC ) Guidelines . CONSULTANT ecologist will record all observations of listed protected species and features that may indicate species presence . Physical features may include , but are not limited to , tree markings , burrows , tracks , nests , scat , and cavity trees . CONSULTANT will request that the U . S . Fish and Wildlife Service ( FWS ) and the Florida Fish & Wildlife Commission ( FFWCC ) review their files for the presence of any listed species that may be present onsite . TASK VII — Revised Vegetation Survey ( FLUCCS ) ( $ 880 . 00 ) PHASE VII : CONSULTANT will conduct a systematic survey of vegetation using the Florida Land Use, Cover and Classification System (FLUCCS) , A Technical Report. FLUCCS was developed by the State of Florida , Department of Administration , Division of State Planning , Bureau of Comprehensive Planning , April 1976 . CONSULTANT ecologist will base the vegetative community descriptions upon field survey observations , SCS soil maps , and aerial photograph interpretation . Oslo Road Boat Ramp September 8 , 2009 Agenda Page 3 of 5 7 TASK VIII — Historical / Archaeological Resources ( $ 330 . 00 ) PHASE VIII : CONSULTANT will coordinate historical and/or archaeological resources with the Florida Department of State , Division of Historical Resources , State Historical Preservation Officer ( SHPO ) and request the state to review their files for historical and/or archaeological resources related to this area . GKE to review archaeological results if necessary with archaeological firm and obtain proposal to complete a Phase I Archaeological Survey if necessary . TASK IX — Response to AgencV Requests for Additional Information ( RAI ) ( $ 4 , 400 . 00 ) PHASE IX : Following agency permit application review , CONSULTANT will meet with County and Agency Staff , and respond to all environmentally related questions outlined in agency letters requesting additional information ( RAI letters ) . The above estimated cost is to cover two rounds of SJRWMD RAI responses . TASK X — Post Construction / Permit Compliance Assistance ( $ 31960 . 00 ) PHASE X : Post construction site inspection assistance with County staff and contractors including water quality (turbidity) monitoring during construction . TASK XI — Additional Services / AutoCAD Services ( $ 2 , 250 . 00 ) PHASE XI : GKE AutoCAD Services for the above GKE work . TASK XII — Coordinate with Dredging Company ( $ 2 , 200 . 00 ) PHASE XII : GKE will coordinate and meet onsite and review project and obtain bids from three ( 3 ) dredging companies . TASK XIII — Boat Ramp Usage Photography ( $ 15320 . 00 ) PHASE XIII : GKE to photograph the boat ramp usage on four (4) weekends ( 8 trips ) in order to obtain photographs of vehicles with trailer usage as requested by SJRWMD / ACOE . TASK XIV — Additional Channel Marker Permits ( $ 29860 . 00 ) PHASE XIV : GKE to apply for and obtain permits for two ( 2 ) additional channel markers from the USCG and the State of Florida . Oslo Road Boat Ramp September 8 , 2009 Agenda Page 4 of 5 TASK XV — Water Quality AnalVsis ( $ 1 , 980 . 00 ) PHASE XV : If necessary , GKE will provide a 24 hour water quality sampling event including : A . M . / P . M . (dawn / dusk ) sampling for dissolved oxygen , turbidity , salinity , pH , and temperature , within the impoundment ( impact areas ) and the lagoon . TOTAL COST $ 395455 . 00 NOTE 1 : The above costs include additional GKE staff, boat , fuel , and equipment . NOTE 2 : If required , following permit application submittal and agency review , GKE will complete any required additional environmental work / meetings . A separate amendment will be provided if necessary for any additional environmental permitting assistance costs . NOTE 3 : Due to the nature of this project , receipt of the State and Federal permits is estimated to take 12 to 18 months from submittal of a substantially complete permit application . Services Not Included The following services / fees are not included ( if required ) in this agreement , but will be coordinated and reviewed by CONSULTANT : 1 ) Surveying / engineering 2 ) Legal work 3 ) Engineered permit drawings 4 ) Water quality laboratory analysis ( HBOI ) COMPENSATION This section of the AGREEMENT entitled CONSULTANT FEES / COMPENSATION shall be revised in response to the Scope modifications set out herein .
