Oslo Road Bridge Replacement
And Roadway Widening
AMENDMENT NO. 4 TO THE PROFESSIONAL ENGINEERING/LAND SURVEYING
SERVICES AGREEMENT BETWEEN KIMLEY-HORN AND ASSOCIATES , INC . AND
INDIAN RIVER COUNTY, FLORIDA.
This is an amendment to the existing Engineering/Land Surveying Services Agreement (AGREEMENT)
dated March 24th, 1998 between Kimley-Horn and Associates , Inc . (ENGINEER) and Indian River
County (COLTNTY) . This amendment addresses changes in " Section I - Project Limits and Description" ,
Section H - County Obligations, " Section III - Scope of Services " , " Section V - Compensation"
and
" Section XVI — Duration of Agreement" of the AGREEMENT .
Amendment Description
This Amendment includes the following :
" SECTION III — SCOPE OF SERVICES " is being modified to incorporate the following :
The ENGINEER will revise the current Oslo Road construction documents to extend the 5 -laning
of Oslo Road west of 20th Avenue approximately 2 , 640 feet to 27th Avenue, where the 5 -lane
section will tie-in to the existing 5 -lane section associated with the eastbound approach at the Oslo
Road/ 27th Avenue intersection. The County also desires several other modifications to the
construction documents that consist of the following :
• The County desires that the proposed sidewalk along the north side of the Oslo Road be
modified to consist of a two foot utility strip in combination with an eight foot pedestrian
sidewalk.
• The County desires that the sub -lateral canal, located along the south side of Oslo Road,
be enclosed from SW 19th Avenue to east of SW 18th Avenue .
• The County desires to have a westbound right turn lane at the entrance to the Timber
Ridge development.
• The County desires to have a plateau intersection at Oslo Road and SW 12th Avenue to
accommodate the potential future signalization of this intersection . The intersection will
be designed to accommodate a future southbound left turn lane on SW 12th Avenue .
• The County desires to have the corridor reviewed to determine where raised traffic
separators could be installed to assist in access management along the corridor. In
locations where it is applicable to have raised medians , non-irrigated landscape
improvement plans will be developed.
• The County desires to hold up to one public involvement meetings where the ENGINEER
will participate and prepare presentation materials for the meetings .

The COUNTY will provide the ENGINEER with the required topographic survey to enable design
of the additional 2 , 640 feet of roadway improvements .
Based upon the completed construction documents , this amendment will require revisions to the
following plan sheets :
Typical Section — 1 Sheet
Plan and Profile — 11 Sheets
Cross Section — 15 Sheets
Landscape Design — 6 Sheets
The extension of the western terminus will require the additional plan sheets :
Plan and Profile — 3 Sheets
Cross Section — 5 Sheets
Pond Detail Sheets — 2 Sheets
Signing and Marking — 2 Sheets
Landscape Design — 2 Sheets
Utility Design
The Engineer will develop construction documents to detail service extensions along Oslo Road
between 27th Avenue and Old Dixie Highway, within the limits of the subject improvements . The
water main, force main and sanitary sewer laterals will be needed to facilitate access to these
utilities following the roadway improvements .
Utility Permitting
The Engineer will incorporate these additional utility modifications within a FDEP domestic
wastewater and public drinking water permit. The consultant will coordinate with FDEP in
regards to obtaining these permits . The COUNTY will be responsible for all permit application
and agency review fees .
" SECTION V — COMPENSATION" is being modified to incorporate the following :
The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered pursuant
to this Agreement fees inclusive of expenses in accordance with the following :

The basic compensation mutually agreed upon by the ENGINEER and the COUNTY is as

"SECTION XVI — DURATION OF AGREEMENT" is being modified to incorporate the following :
The time for completion of the 90% design drawings, permit applications, and Engineer's Opinion
of Probable Construction Cost for the expanded project shall be six (6) months following
receiving the completed design survey. Once permits are received, 100% design drawings shall be
completed 90 days thereafter.
The AGREEMENT is hereby amended as specifically set forth here in. All other sections of the
AGREEMENT shall remain in full force and effect and are incorporated herein.
This Amendment No . 4 to the AGREEMENT regardless of where executed, shall be governed by and
construed by the laws of the State of Florida.
In witness whereof the parties have executed this Amendment this 21 st day of
September , 2004 .
