WEDNESDAY, MARCH 24, 1965
The Board of County Commissioners of Indian River County met at
the Courthouse, Vero Beach, Florida; in a regular meeting held at
8:30 o'clock A. M., Wednesday, March 24, 1965. All members were
present. Also present were John H. Sutherland, County Attorney:'
Edwin S. Schmucker, County Engineer: and Alfred H. Webber and Ruth
Elliott, Deputy Clerks.
Mr. Frank Zorc, owner of Sun Acres Subdivision, appeared before
the Board and requested the Board to vacate and abandon a five foot public
utility and drainage easement on the rear lot lines of Lots 1 through 7,
Sun Acres Subdivision as there was an error in the written dedication
on the plat when it was recorded. On Motion made by Commissioner
Macdonald, seconded by Commissioner Waddell and unanimously carried,
the following. Resolution was adopted:
RESOLUTION
WHEREAS, under Chapter 57.1412, Special Acts of 1957,
the Board of County Commissioners of Indian River County, Florida,
was duly authorized and empowered by Resolution adopted without
publication, to vacate and abandon and relinquish and disclaim the
rights of the public acquired by dedication or otherwise, any and all •
rights of ways, easements, or alleys either conveyed to the said
county or dedicated by plat or deed recorded in said county, and
WHEREAS, FRANK L. ZORC and GWENDOLYN ZORC,
his wife, as the fee simple title owners, having duly petitioned the •
Board of County Commissioners of Indian River County, Florida, to
vacate and abandon a five foot public utility and drainage easement on
the rear lot lines of the following described property situate in Indian

River County, Florida, to wit:
Lots 1, 2, 3, 4,„ 6, and 7 of Sun Acres, a sub -division
in. Indian Rives, County, Florida, as shown in Plat
Book 5, Page 54, Indian River County Records.
and
WHEREAS, it appears that no notice thereof is necessary
and that the rights of adjacent parties will not be affected by the said
abandonment and that the said easement is not required for public use
or public purpose,
BE IT, THEREFORE, RESOLVED by the Board of County
Commissioners of Indian River County, Florida, that the five foot
public utility and drainage easement on the rear lot lines of the following
described property, to wit:
Lots 1, 2, 3, 4,,, 6, and 7 of Sun Acres, a Sub -division
in Indian River County, Florida, as shown in Plat Book
5, Page 54, Indian River County Records. •

be and the same is hereby abandoned and that all claim or right of the public
acquired by dedication or otherwise in and to the said easement is relinquished
and disclaimed.
The foregoing Resolution is adopted by the Board of County
Commissioners this Y S1' -day of March, 1965.

Charles A. Sullivan, Attorney at Law
Mr. W. D. Parsons, Chief of the Fellsmere Volunteer Fire • De-
partment and Mr. John Cann, Vice -President, appeared before the Board
and stated that the Dodge Fire truck which was transferred to the
County by the Sebastian Volunteer Fire Department, is not 4 -wheel drive,
and therefore would be of no use to their Department. Motion was made
by Commissioner Macdonald, seconded by Commissioner McCullers arid
unanimously carried, that the bills for a pump, hose and reels to
improve the two trucks now owned by the Fellsmere Volunteer Fire
Department be paid by the Board, not to exceed $500.00.
Colonel Whitcamp of the Rockridge Property Owners Association
reported that the community building at Rockridge Park is almost
completed at a cost of approximately $2,100..00 and invited the
Board members to an Open House to be held at 2 o'clock P. M., on
Sunday, April 4.
Rudy Hubbard, representing the Home Insurance Company, presented
an insurance proposal on additional property that is owned by the
County at Wabasso Beach, Ambersand Beach and Roseland, for an estimated
annual premium of $507.00. On Motion by Commissioner Macdonald,
seconded by Commissioner Waddell and unanimously carried, the proposal
. was accepted. The civic groups which have the buildings under lease
• were to be requested to continue paying the amount of their premiums
to the County as a refund to be applied against the premium paid by
the County.
Mr. Bill Shepard, regional group representative for Gulf Life
Insurance Company, presented a group hospitalization proposal for the
County to consider. He was requested to send a copy of the proposal
to each member.of the Board for study and consideration.'
Mr. Bill Snyder, representing Blue Cross -Blue Shield, spoke on
the, advantages of retaining Blue Cross for• our hospitalization insurance.

On Motion made by Commissioner. Waddell, seconded by Commissioner
Haffield and unanimously carried, the following Resolutions were
adopted:

On motion of Commissioner Waddell , seconded by Commissioner Hatfield
the following resolution was adopted:
WHEREAS, the State Road Department of Florida has authorized and requested

which has been surveyed and located by the State Road Department as shown. by a map
on file in the office of the Clerk of the Circuit Court of said County, and in the
office of the said Department at Tallahassee, and
WHEREAS, the said Department will not begin construction of said portion of
said Section in said County until title to all land necessary for said portion of
said Section has been conveyed to or vested in said State by said County, and said
lands are physicelly cleared of all occupants, tenants, fences, bvi ding:� and/or
other structures and improvements uponor encroaching within the limits of the land
required for said portion of said Section; and
WHEREAS, the said County is financially unable at this time to provide the
necessary funds to acquire said rights of way, borrow pits and easements; now there-
fore, be it
RESOLVED, that the State Road Department of Florida be and it is hereby re-
quested to pay for the rights of way, borrow pits and easements for said roes', in-
cluding the rer:ova1 of buildings, fences and other structures and improvanents there-
on, and for other e}penses of acquiring title to said: rights of way, borrow pits and
easements by purchaar nr condemnation, from such funds and under such conditions as
are set out in the contract hereto attached; and be it further
RESOLVED, that'said County, through its Board of County Commissioners, comply
with the request of said Department and procure, convey or vest in said State the
free, clear and unoncurbered title to all lands necessary for said portion of said
Section, and deliver to the State Road Department said lands physically clear of all
occupants, tnnsntf.t, fences, buildings and/or other structures and improvements situatt
upon or entx4aohIng within the limits of the lands required for said portion of said
Section and that the Chairman and the Clerk of this Hoard be and they are hereby
Authorized and directed to execute and deliver on behalf of said County to said De-
partment the Contract in the form hereto attached; and be it further
RESOLVED, that the attorney for this Board be, and he is hereby authorized
and directed to proceed to take the necessary steps for the County to acquire in the
name of said County by donation, punccase, or condemnction said rights of way, borrow
pits and easements for said portion of said Section„ and to prepare in the name of
said County by its County Commissioners all condemnation papers, affidavits and
pleadings, and prosecute all condeme ation proceedings to judgment; and. furnish to the
Department the abstract search provided for in said Contract.

WHEREAS, the State Road Department of Florida has authorized and requested

clear and has been physically cleared of all buildings, fences and other im-
provements; that all utility poles; lines, cables, pipes and .other facilities'
have been removed or adjusted as required for .construction of said project by
the State Road Department or such 'removal, and/or adjustments have been ar-
ranged for and will be effected without delay to the State Road Department and/or
its contractors; and the State Road Department is hereby requested to proceed

Motion was made by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously carried that the following right of way
agreements on Citrus Road, west of Emerson Avenue be approved:
1. L. L. Patterson 150', $225.00
2. L. R. Schmidt 150' 225.00
3. Rocco Mazzeo 100' 100.00
4. Fred Jordan 100' 150.00
5. Jack Murray 110' 165.00 plus agreement
to re -locate shrubs, drain field and
grease trap on Murray property.
and tentative approval was given to pay C. S. Orr, $500.00 for
right of way at the corner of Emerson Avenue and Citrus Road.
The County Engineer reported that settlement had been made on
the Peterson property on North Gifford Road for $4,000.00. Motion
was made by Commissioner Waddell, seconded by Commissioner Haffield
and unanimously carried, that the settlement be approved, subject
to the County getting a clear title to the property.
Motion was made by Commissioner Waddell, seconded by Commissioner
Haffield and unanimously carried, that the County Engineer is authorized
to advertise for bids to caulk and waterproof the North and Vast side
of the Courthouse.
The County Engineer reported that Mr. Dale Knisely had requested
the County to furnish pipe to extend the backstop at the Babe Ruth
League field, the approximate cost of which would be $97.00. Motion
was made by Commissioner Waddell, seconded by Commissioner Haffield
and unanimously carried that the County Engineer is authorized to
furnish to the City of Vero Beach the 30 pieces of pipe as requested.
On Motion by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously carried, the County Engineer and Ted Williams,
Right of Way Agent, were authorized to attend a meeting of Utility Liaison
Committee in Miami on March 31, 1965.
Motion was made by Commissioner Waddell, seconded by Commissioner
Haffield and unanimously carried, that the Engineer be instructed.to
proceed with right of way acquisition on Rangeline Road from Citrus
Road to the South County line.
Motion was made by Commissioner McCullers, seconded by Commissioner
Waddell and unanimously carried that the Board and the Clerk are
authorized to execute the Corrective County Deed under application
nos. 13595 and 13597 to correct the legal description in a deed
formerly given by Indian River County to the Indian River Farms Drainage
District and recorded in Deed Book 58, page 143. „•
Motion was made by Commissioner Waddell, seconded by Commissioner
Hatfield and unanimously carried, that the County Engineer is authorized
to purchase a tape recorder.
The County Engineer requested permission to repaint the Road
and Bridge offices and the Commission room. The Board. requested him
to bring a cost estimate to the next meeting.
Motion was made by Commissioner Waddell, seconded by Commissioner
Hatfield and unanimously carried that the County Attorney be requested
to draw up a bill giving the Board permissive power to have lots and
property cleared in the County.
Motion was made by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously -carried, that, after duly advertising and
holding a public hearing, and there being no opposition, and there
being present Senator Merrill P. Barber and Representative Art Karst,
the Board does hereby request the Legislative delegation to introduce
and have passed the following bills for the benefit of the citizens
of IBdian River County:
1. An Act for the condemnation of dilapidated buildings,
structures, or house trailers.
2. An Act covering the contracting with other governmental bodies.
3. An Act revising the county group insurance provisions.
4. An Act requiring vaccination of dogs.
5. An Act approving lights for streets, parks, etc.
6. An Act to repeal a population act which set up the Supervisor
of Registration's salary at $6,000.00.
7. An Act on welfare liens, allowing the County to file a lien.
8. An Act controlling junk, automobiles, trash, etc.
9. An Act covering permissive power to have lots cleared.

Two residents of Anita Park Subdivision appeared before the Board
with complaints of the dump located on South Gifford Road and urged
immediate action of the Board.. They were informed that as soon as
funds were available, a sanitary land fill program would be put into
effect.
At the recommendation of the County Engineer and with the approval
of the. members of the Board, the county policy of replacing rusted
out culverts under county roads which are not necessary for road
drainage is hereby eliminated. However, if the culvert purchased by
the property owner is at least 60' in length, the county will
continue the policy of providing. the labor to put it in.
Upon Motion made by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, the appointment, of James L. McCoy.
as a Deputy Sheriff was approved.
Alfred Webber, Deputy Clerk, presented a letter from the Rudy
Hubbard Agency stating that due to an error the premium on the proposal
presented on March 10 would be $1,778.00, in lieu of $1,535.00 as
quoted. Upon Motion made .by Commissioner Waddell, seconded by
Commissioner McCullers, and unanimously carried, the corrective bill
was approved and the Clerk instructed to issue warrant in payment of
same.
The.Deputy Clerk presented a letter from the City Council, City
of Sebastian, requesting its share of the road and bridge tax, as
set forth in Chapter 336.59 (2), Florida. Statutes. Mr. Webber informed
the Board that the Sebastian share this year would be approximately
$900.00. The Clerk was instructed to write Mr. Jordan, City. Clerk,
requesting a suggestion of a road project in that amount.
. Upon Motion by Commissioner Waddell, seconded by Commissioner
Macdonald, and unanimously carried, the following Item to Item Transfer
.in the General Fund was approveds From Account No. 951 Contingencies
to Account No. 685.2 Vero Beach

Chamber of Commerce Publicity - $150.00.
Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, that the Clerk is authorized to
advertise for bids for air conditioners for the Parole office and
the Clerk's office.
A letter was received from the Shoup Voting Machine Corporation
stating that effective July 1, 1965, the selling price of the Shoup
Voting Machine will be increased 4%, or approximately $75.00 per
machine. Mr. Webber reported that according to the Supervisor of
Registration, the County will need 10 additional machines next year.
The Clerk was instructed to write the Corporation and ask if the
machines were ordered now for delivery in February, would the contract
be executed in February, at the present price.
The County Engineer reported that Brevard County is going to
illuminate the fishing catwalks on their side of the Sebastian Bridge.
The County Engineer was requested to get more information on installation,
' maintenance and operating expense.
Motion was made by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously carried, that the Engineer is authorized to
have an appraisal made on the right of way for Citrus Road between the
railroad and U. S. 401.
Motion was made by Commissioner McCullers, seconded by Commissioner
Macdonald, and unanimously carried, that Senator Barber and Representative
Karst, be requested to introduce an amendment to the General Act to
provide an increase in the salary of the County Commissioner of Indian
River County from $200.00 to $300.00 a month.
Upon Motion by. Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, the applications of Jenny Hammel and
Edwin McKinney for admission to the Southeast Florida T.B. Hospital
were approved.

The several bills and accounts against the County, having been
audited, were examined and found to be correct, were approved, and
warrants issued in settlement of same as follows: General Fund, Nos.
3890 to 3923, both inclusive/ Road and Bridge Fund, Warrant Nos. 2570
to 2589, both inclusive/ and Fine and Forfeiture Fund, Nos. 374 to
384. Such bills and accounts being on file in the Office of the
Clerk of the Circuit Court, the warrants so issued from the respective
funds being listed in the Supplemental Minute Book as provided by the
•
rules of the State Auditor, reference to such record and list so recorded,
being made a part of these minutes.
There being no further business, on Motion made, seconded and
carried, the Board then adjourned.
