AMENDMENT NO , 1 COURT
TO
LICENSE AGREEMENT
WHEREAS , on January 29 , 1996 a License Agreement was entered into
between INDIAN RIVER COUNTY, a political subdivision of the State of Florida ,
"County" , and JEFFREY C . ASHER, "Licensee'; and
WHEREAS , said License Agreement was recorded in Official Record
Book 1090 , Page 2792 of the Public Records of Indian River County, Florida ;
and
WHEREAS , a dock was erroneously constructed by another homeowner
on the riparian land of County which land is under license to Licensee ; and
WHEREAS , such construction error makes it necessary to amend the
License Agreement to provide an alternate location for Licensee to construct
and utilize a dock; and
WHEREAS , Licensee is also required to pay applicable sales tax on the
annual license fee ; and
WHEREAS , Jeffrey C . Asher's wife , Linda K. Asher, is now also an
owner of Lot 3 , Block 2 , Replat of Country Club Pointe , Unit 1 ;
NOW, THEREFORE , the parties agree as follows :

1 . Jeffrey C . Asher's wife , Linda K. Asher, hereby joins in as a party
to said License Agreement, and the term " Licensee " shall mean Jeffrey C .
Asher and Linda K. Asher.
2 . Paragraph 3 of the License Agreement is deleted in its entirety and
substituted with the following :
163 . Licensee has sought permission to utilize the
riparian land of County along the east right-of-way line of
Calcutta Drive , generally described as due east of the south
property line of Lot 14 and including the north 1 /3 of property
east of Lot 15 , Block 2 , Replat of Country Club Pointe
Subdivision , Unit 1 for the construction of a dock for the
personal recreational use of themselves and/or occupants of
said Lot 3 , Block 2 , Replat of Country Club Pointe , Unit 1 . "
3 . Paragraph 5 of the License Agreement is deleted in its entirety and
substituted with the following :
"5 . Licensee agrees to pay County $ 100 . 00 plus
applicable sales tax on January 29 , 2007 and each
anniversary thereof, for the exclusive right of Licensee
and/or occupants of Lot 3 , Block 2 , Replat of Country Club
Pointe , Unit 1 , to utilize said dock for the purposes stated
herein . "

4 . This Amendment No . 1 shall be recorded in the Public Records of
Indian River County, Florida .
5 . All other terms , conditions and covenants of said License
Agreement recorded in Official Record Book 1090 , Page 2792 remain
unchanged .
IN WITNESS WHEREOF , County and Licensee have caused this
Amendment No . 1 to be signed in their respective names .
