HomeMy WebLinkAbout7/7/1965WEDNESDAY, JULY 7, 1965' The Board of County Commissioners of Indian River County met in regular season on Wednesday, July 7, 1965, at the Courthouse. Vero Beach, Florida. All members were present. Also present were John H. Sutherland, County Attorney, Edwin S. Schmucker, County Engineer, and Alfred H. Webber and Ruth Elliott, Deputy Clerks. The Chairman, Robert W. Graves, asked if there were any corrections or additions to the minutes of June 9 and June 28, 1965. There were none and upon Motion by Commissioner Macdonald, seconded by Commissioner Waddell and unanimously carried, the minutes were approved. Miss Mary Lou Durrance and Francis Whitfield submitted plans for a building on land owned by the County and leased -A° the west Wabasso Progressive Civic Club. The building would be used for meetings, demonstration home and health clinic, at an estimated cost, for.materials only, of $3,900.00. Miss Durrance stated that it would be furnished with money received from the Economic Opportunity Act; and asked the Board to furnish financial aid for the buildingi. Commissioner Macdonald moved that the plans be submitted to the County Engineer for examination and approval and that action be postponed until the Engineer's report is received. The Motion was seconded by Commissioner Haffield and unanimously carried. Attorney B. T. Cooksey and Attorney James L. Boring, representing the owner of Wyn Cave Subdivision, Edwin B. Duckett, appeared before the Board and stated that when the subdivision was platted there was an easement going to the ocean. This easement was subsequently changed by the County Commissioners at the request of R. A. Winn, from the south side to the north side of the property. The present owner finds that the present easement is untenable and it would be more comienient for ingreas and egress and.access to the ocean to have the easement in the twiddle of the property. at Wyncove Drive, and requested the Board to abandon the old easement and grant a new easement in the WOK . 9 ?ACE 251 / L 71965 alit. 7 19&5 BOOK 9 PAGE 252 middle of the property. Mr. George Heath, representing Mr. Morris Knowles, registered his objection to the change of the easement, stating that it would be putting a public walkway right in front of his bedroom window. It was the unanimous.opinion of the Board that they would oppose the change in the easement until the two owners can compromise on where they want the easement placed. 'Mrs. Gladys Vigliano, County Welfare Worker, presented a letter from Congressman Paul Rogers, requesting the county to aid Mrs. • Shelby (Geneva) Barnhill of Fellsmere.' She State�Welfare'-hasodenied Aid for_the:Disabled because investigationswbaVe shewa.that she is not totally disabled and therefore not eligible. Motion was seconded by Commissioner Haffield and unanimously carried. Mr. Y. G. Lanier was advised that the combination range and refrigerator, two oil paintings and air conditioner are not to go with the building: but that the 100 lin. feet of shelving does go with the building. This was satisfactory with Mr. Lanier. Dr. Robert 0. Vernon, Director, Division of Geology, Florida State Board of Conservation presented a proposed investigation of the water resources of Indian River County by the U. S. Geological Survey in cooperation with the County and the Florida Geological Survey. The investigation would cover a three-year period of data -collection, field studies, and report preparation at an annual cost to the County BOOP 9 ma 255 1UL 7 1965 JUL 71965 sou 9 PACE 256 of $12,500.00. Dr. Vernon stated that the proposed investigation would begin in January, 1966 and that the estimated cost of the partial year, January to September, 1966 would be $9,375.00. The Board postponed action on the proposal until a later date. Mr. H..E. Hales, Assistant to President, Florida East Coast Railway, presente&to the Board a proposal to install traffic -light type signal protection at the following crossings at a cost of $9,000 each, oT!which the county would pay one-half and the FECRR would pay one-halfa Bay Street, Hobart Road, North Gifford Road,' Cemetery Road, North Winter Beach Road, 4th Place (Citrus), 1st Street (Swords), and Lindsey Road. The Board felt that to eliminate the middle crossing between North and South Gifford Road, the railroad should give part of their right of way to connect this road with North and South Gifford Road and the railroad should install a traffic - light type signal at either North or South Gifford Road in return for the elimination of this crossing. An agreement for protection. at South Winter Beach Road wall executed several years ago but never installed and the Board was of the opinion that this crossing should be included in the proposal. Mr. Hales requested the Board to send a counter -proposal on the above items to the Florida East Coast Railroad for their consideration.. Mr. George Boone appeared before the Board and stated that he proposed to dredge a channel in front of his property north of Sebastian., Motion was made by Commissioner Macdonald, seconded by Commissioner Waddell and unanimously carried, that the Clerk be instructed to write a letter to whom it may concern that the Board does not have any objections to the application for proposed dredging by George Boone. Attorney Chester Clem presented a release signed by William. Wesley Fendley and Vivian Fendley stating that they have no objections to the vacation of the entire plat of the W. B. Hoover Subdivision and a Certificate from the Clerk of the Circuit Court that all State and County taxes on the property have been paid for the current year, 1964, and all preceding years. Thereupon, Motion was made by Commissioner Macdonald, seconded by Commissioner Waddell and unanimously' that the following Resolution be adopted: RESOLUTION WHEREAS, JOSEPH SCREWS has petitioned the Board of County. Commissioners to vacate the subdivision plat of the following property: The subdivision plat of W. E. There are a great many children walking alone said Avenue at high risk of their lives. Trent, Civil Defense Director, Motion was made by Commissioner Waddell, seconded by Commissioner Haffield and unanimously'carried that the payment of $37.02 to Starke for radio equipment acquired from the FAA be authorized. Motion was made by Commissioner Macdonald, seconded by Commissioner McCullers that the agreement between the Florida Merit System of Personnel Administration and the Board of County Commissioners of Indian River County. for and on behalf of the Civil Defense Unit by approved and authorized the Chairman and the Clerk to execute same. Upon Motion by Commissioner Waddell, seconded by Commissioner. McCullers and unanimously carried the tentative budget of the Indian River County Health Department for.the fiscal year July 1, 1965 to June 30. 1966 was accepted and approved by the Board. The County Engineer presented a proposed plan for the old Health Department building and on Motion by Commissioner Macdonald, seconded by Commissioner Haffield and unanimously carried that tbs. Engineer's proposed plan be approved. The County Engineer reported that there is a dump growing • '.. immediately north of the county dump in Oslo on property owned by Mr. ,R. S. Swing. Mr. Swing has offered to sell the 7.5 acres at $1500 an acre. Motion was made by Commissioner Macdonald, seconded by Commissioner Haffield and unanimously carried that the Engineer be instructed to negotiate with Whispering Palm Subdivision for a right of way into the county dump from Old Dixie Highway. The County Engineer was requested to invite Mr. Chelsie J. Senerchia, Fourth District Road Board Member, to meet with the Board at his first opportunity to review the county road situation. ¶he County Engineer reported that the two-hour parking restriction has been officially approved by the State Road Department on U. S. #1 between 1Sth street and 12th Street. Motion was made by Commissioner Waddell, seconded by Commissioner Macdonald, and unanimously carried that any and all board members and the County Engineer be authorized to attend the Trustees of the I. I. Board meeting in Tallahassee, on Tuesday, the 13th of July, 1965. The County Enginner recommended that a 35 mile per hour speed limit be set on 34th Avenue from 12th Street to 14th Street. On Motion by Commissioner Macdonald, seconded by Commissioner Haffield and unanimously carried that the speed limit be set as recommended. Motion was made by Commissioner Macdonald, seconded by Commissioner Waddell and unanimously carried that the following agreement with Mrs. Florence Mett for right-of-way on Fellsmere Road (State Road #512) - be approved: $825.00 plus moving the fence along 512 into her property: putting in no more than 15 loads of marl to improve the road into her property and to clean out the ditch going to her house. The County Engineer reported that the offer of $4,700 made to the owners of the right-of-way for the extension of Citrus Road between O. S. #1 and the railroad has been refused. He had a second appraisal made and,this figure was $7,800. The Board postponed further action until a later date. The County Engineer reported that the Tax Assessor has requested that storm shutters be made for his office as the records in his office cannot be replaced with money. The Board instructed the Engineer to examine the most essential windows in the Tax Assessor's office and gait a cost estimate of material needed. A petition was received with forty-six signatures requesting that Citrus Road from King's Highway (Lateral B) to Monroe Road be paved. On Motion by Commissioner McCullers, seconded by Commissioner Waddell and unanimously carried, the petition was ordered filed. The County Engineer presented a request from General Development Corporation that the streets and drainage structures in the following named streets in Vero Beach Highlands unit One be accepted for maintenance by Indian River County: sopt 9 PAGE 261 Y 19TH STREET S.W. Motion was made by Commissioner Waddell, seconded by Commissioner Haffield and unanimously carried that the request be granted. Motion was made by Commissioner Waddell, seconded by Commissioner McCullers and unanimously carried that the County Engineer be instructed to cover the ditch on 44th Avenue and re -dig it on the East R/'W line. The County Engineer reported on the preliminary investigations that had been made on the right of way of $lendale Road between Kings Highway and Monroe Road and the Board instructed him to continue negotiations to acquire this right-of-way. The County Engineer reported that out of thirty-six junk car problems, ten have already been moved and twelve have agreed to. move thew, A Petition was received, aigned by Mine property owners, requesting the County to improve the existing sixty -foot right-of-way .for Rosedale Boulevard extending one-half mile West from 90th Avenue, in order to give access to Tracts 7,8, 9 and 10, Section 10-33-38 which are to be inhabited and developed in the.near future. The Engineer was requested to determine the cost of clearing this right -Of -way. .Alfred'E. Webber, Deputy Clerk, presented the Clerk's Tentative Budget for the year ending September 30, 1966. Upon Motion by Commissioner Macdonald, seconded by Commissioner Waddell, the tentative 'budget was accepted by the Board. On Motion by Commissioner Waddell, seconded by Commissioner McCullers and unanimously carried the following Item to Item transfers ware approved: Road and Bridge Fund, From A/C•415, Free Labor to A/C 411, Supervisory Salaries, $300.00; General Fund, From A/C 951, Con- tingencies to A/C 261, Elections and Registrations, $750.00; and from A/C 951, Contingencies to A/C 542, Tubercular Hospitals, $1,000.00 The Monthly report of the County Service Officer was received' and placed on file. Motion was made by CouMasione Waddell, seconded ii, by Commissioner Haffield and unanimously carried that the request of the County Service Officer to take two weeks vacation in August be granted. The Deputy Clerk presented two Notices from the Trustees of the Internal Improvement' Board of Application to purchase submerged land in the Indian River by Lloyd & Associates, on behalf of Bertha M. On Motion by Commissioner McCullers, seconded by Commissioner Haffield and unanimously carried, the applications of Leonard Kinchen and Earnest Thomas for admission to the Southeast Florida T. B. Hospital were approved. On Motion by Commissioner Haffield, seconded by Commissioner McCullers and unanimously carried, the appointments of Albert John Pensah, Fondren Mitchell and J. President of the Citizens' Scholarahip'Foundation, recommending Miss Andrea Sheila Egan for a scholarship. Motion was made by Commissioner Waddell, seconded by Commissioner Macdonald and unanimously carried, that the Board award a $1,000 scholarship to Andrea Sheila Egan. The. Clerk was requested to write the Citizens Scholarship Foundation thanking them for this recommendation and asking their further help in recommendations for the remainder of the scholarship funds. Commissioner Macdonald reported that the increased use of the Sebastian Inlet area might well require consideration from a zoning standpoint in the near future. The County Engineer reported that the Board's request to the State Road Department to provide water and toilet facilities under their Primary Park Appropriations Program by Resolution adopted on May 19. 1965, has been denied. The several bills and accounts against the County, having been audited, were examined and found to be correct, were approved, and warrants issued in settlement of same as follows; General Fund, Nos. 4205 to 4278, both inclusive; Road and Bridge Fund, Nos. 2794 to 2865, both inclusive; Fine and Forfeiture Fund, Nos 420 to 425 both inclusive; and Capital Outlay Fund, Nos. 116 to 119, both inclusive. Such bills and accounts being on file in the Office of the Clerk of Clerk of the Circuit Court, the warrants so issued from the respective funds being listed in the Supplemental Minute Book as provided by the rules of the State Auditor, reference to such record and list so recorded, being made a part of these minutes.
