The Board of County Commissioners of Indian River County met
in regular session on Wednesday, August 4, 1965, at the Uourthouse,
Vero Beach, Florida. All members were preabnt. Also present were
`John H. Sutherland, County Attorney; Edwin S. Schmucker, County
Engineer; and Alfred H. Webber and Ruth Elliott, Deputy Clerks;
The Uhairman asked if there were any corrections or additions
`to the Minutes of July 7 and July 19, 1965. There were none and
on Motion by Commissioner Caddell, seconded by Commissioner Mc—
Cu11•ers and unanimously carried, the minutes were approved.

The Chairman read the foregoing notice ano asked if anyone
present wished to be heard. There were rene and upon Motion by
Commissioner Macdonald,. seconded by Commissioner Haffield, the
following Resolution was adopted:
R.E S O L U T I O N
wHEREAS, the County Auditor, after tentatively as-
•eertaining the proposed fiscal policies of the Board of County
Commissioners of Indian Rive: County,. Florida, for the f:acal year
commencing on the 1st day of October, "65, and ending on the 30th day
p
of September, 1966, did prepare and present to the Board of County
Commissioners a tentative budget for said fiscal year for each of the
funds therein.as provided by law, including all estimated receipts,
taxes to be levied and balances expected to be brought forth and all.
estimated expenditures, reserves and balances to be carried over at the
end of.the year' and
WHEREAS, this Board did receive and examine said tentatative
budget for eacl fund and did require such.changes to be made as the
Board did deem necessary and the auditor's estimate of receipts other

than taxes not having/revised, this Board did preparea statement
summarizing all of the tentative budgets showing for each budget in the
total of all budgets the proposed tax millagas, the balances, the
reserves and the total of each major classification of receipts and
'expenditures classified according to the classification,of accounts
prescribed by the Comptroller of the State of Florida' and,
wHEREAS, this Board did cause said summary statement to be
advertised one time in a newspaper of general circulation published in
Indian River County, Florida, to -wits In the is.ue of July 22, 1965,
of the Vero Beach press Journal, as will more.fully appear by'proof of
publication thereof filed in the minutes of this Board' and,.
WHEREAS, this Board did meet at the time and place stated
in said advertisement for the purpose of hearing requests and com-
plaints from the. public regarding the budgets and for the purpose of
holding a public hearing and making whatever revisions in the budget
it may deem necessary'

NOW THEREFORE, BE IT RESOLVED by tbo Board of County
Commissioners of Indian River.County, Florida, that this Board does
herewith tentatively adopt the budgets for the funds of this Board
for the fiscal year beginning October 1. 1965,. and ending September 30,
1965, in the form as heretofore prepared, advertised, and rev's
BE IT FURTHER RESOLVED that the tentative budgets shall be
filed in the office of the. County Auditor as a public record and the
County Auditor shall transmit forthwith to the Comptroller of the
State of Florida, two '_opies of each of the tentative !budgets as
adopted, certified by the Chariman of the Board and by the County
Auditor asa true and correct copy of the budget .as adopted by this
Board, and
BE IT FURTHER RESOLVED that said budgets as tentatively
adopted by this Board shall be considered as finally adopted and as
official thirty (30) days from the date the budgets are transmitted to
the State Comptroller'sid no report of exceptions to the budget:aE1filed
has been made by the Comptroller.
Upon Motion by CommiEsiorer Macdonald, seconded ty Commissioner
Haffield and unanimously carried, the following Resolution was
adopted:
RESOLUTION
BE IT RESOLVER by the Board of County Commissioners of Indian.
River County, Florida, that the rate of taxation necedcary to meet
the expenditures of the Board of County Commissioners of Indian River
County, Florida, for.the fiscal year ending September 30, 1966, pur-
suant to the budget of said Board, as heretoiore pub'.tshed and approved,
is as hereinafter levied and that the tax rate as hereinafter shown
and set forth be and it is hereby levied on all taxatle property in
Indian River County, Florida Yur the year 1965 rith the rate hereinafter
set out, to -wit:
1. In order to meet the estimated expensed of the General 7und,•

it is determined and hereby deolar_i that a tax rate of Five and
seventy-five huneredth3 X5.75). mills upon the dollar be levied and
is hereby imposed.
2. In order to meet the estimat,a expenses. of the Road and
Bridge Fund, it is determined and herebj declared that a tax rate of
One and'twenty-five hundredths (1.25) malls upon the dollar be levied L
and is hereby imposed,
3. In order to meet the estimated expenses of the Pine and For-
feiture Pund, it is determined and hereby declared that a tax of
Two and two tenths (2.2) mills upon the dollar be levied and is hereby.
imposed.
4. In order to meet the estimated expeneee of the Capital Outlay
Pund, it is determined and hereby declared that a tax rate of Sixteen
hundredths (.16) mill upon the dollar be levied and is hereby' imposed.
5. In order to provide funds to the Indian River County Public
Health Unit, it ie determined and hereby declared that a tax rate of
Fifty-five hundredths (.55) mill upon the dollar be levied, assessed
and is hereby imposed upon all property lying and being in the County
of Indian•River, the proceeds of which. when collected shall be paid
to the State Treasurer of the State of.Plorida for the account of the
State Board of Health of the State of Florida, to be expended by said
State Board of Health as provided by Chapter 154, Plorida Statutes.

Gladys Vigliano, County Welfare Worker presented her report
for the month of July and stated that Jane Clackner (Mrs. W. A.)
had applied for nursing care for her husband; but that they have
been residents of Indian River County less than two years. Motion
was made by Commissioner J4aodonald, seconded by Commissioner Waddell
and unanimously carried, that the Application of Mrs. Clackner be
denied.
Mr.,John E. Corbett of the Florida East Coast.Railway appeared
before the Board and discussed the proposal for signals at various
crossings in the county. Upon Motion by Commissioner Macdonald,
seconded by Commissioner McCullers and unanimously carried, the
following counter -proposal was approved by the Board:
'A. The installation of seven "T" type signal lights and one
signal light and gate for the sum of 844,000 at the following crossings:
1. Bay Street 84,500.00
2. Hobart Road 4,500.00
3. North Gifford Road (gates) 11,500.00
4. Cemetery Road 4,500.00
.5. Aorth Wintea' Beach Road. 4,500.00
6. 4th Plaoe (Citrus, new. timbers) 5,500.00

B. The County.agrees to pay the above sum --of S44,000 over
a period ;of three budget ;;;ears.
C. The County agrees to pay 50% of the actual maintenance
charges and ask that an existing agreement on West Wabaseo Road
crossing be changed to this same term.
D. The Railroad will notify and receive approval from the
office of the County Engineer on maintenance programe.where there
is County participation.
E. The County will agree to the closing of an existing crossing
.in Gifford south of mile post 225 if the Railroad donates the right
.of way to the County for the construction of a road on the west side
of the railroad tracks between North Gifford Road and South Gifford
Road, a distance of approximately one—half mile.

Mr. V. E. (Kinky) Orth appeared before the Board and offered to
deed the ditch easement (17') along 44th Avenue to the County in return
for the same amount of land to run with land he already owns. After -
having viewed the property in question with Mr. erth, and after
considerable discussion, Motion was made by Commissioner Hatfield,
seconded by Commissioner Waddell and unanimously carried that the
County'Engineer.contact the property owners on the west side of 44th
Avenue to determine the cost of additional right of way.
. Commissioner Macdonald reported that,after further examination
of the application to purchase submerged land in the Indian River in
-in vicinity of the.Wayside Park in Sebastian, by Mrs. Bertha M. Kjorsvik,.
there is no justified objection to the application; and moved that .

RESOLUTION
WHEREAS, Florida's grim traffic death statistics reflect that
72% of last year's traffic fatalities occured on two-lane highways,
and
• WHEREAS, 65% of all highway accidents occur bn two-lane
highways, and
WHEREAS, current primary road financing capabilities limit
construction to a mere 240 priority miles of Pour -lane divided
highways during the next four years, and
WHEREAS, the interstate highway system is providing safer
highway conditions for long distance. travel but is not the answer
to short'distanoe intra -city travel, tourist promotion and industrial;
development, and
WHEREAS, the Legislature in recent session proposed an amend-
ment to Article IX of the State Constitution by more than a three -
Quarters majority, declaring that an emergency does exist, and
WHEREAS, the aforesaid proposed constitutional amendment
will authorize issuance of bonds not to exceed Three Hundred Million
Dollars for the construction of four -lane primary highways, and
WHEREAS, the projects enumerated in the proposed. amendment
will provide over 1200 miles of new four -lane highways to be con-,
struoted during the next four years,.and
WHER.^a.'S, the Ind. Riv. County Commission, cognizant of and •
conscientiously aware of the pressing needs for public safety,
industrial development and tourist promotion, and being -keenly
aware of the constant need for improvement in Florida's highways
so as to make them the safest and most traveled in the'United •
States.

equipment which is used by the Vero Beach•Fire Department when
'answering fire calls outside the city limits of the City -of Vero

THEREFORE, BE IT RESOLVED, that the Board of County

of the fire fighting equipment of'the county located at the Vero

enter into.a County .Fire Control Agreement with the'Florida Board of Forestry
for the protection of its forest and wild -lands; and
WHEREAS, the Control of timber, grass, and wild -laud fires in, and
adjacent to, suburban areas is esventiai to an effective forest fire control
program; and
WHEREAS, the COOPERATOR is actively engaged in the prevention and
euppreasion of all fires in, and adjacent to, suburban areas; and
WHEREAS, the COOPERATOR can more adequately carry out this ftnction
if additional equipment is available; and

NOW, THEREFORE, the parties td this agreement

do hereby agree, as
follows:
The FOREST SERVICE Agrees:
(1) To make available the equipment described on the attached addenda,
according to the terms set forth fn the addenda and in this agreement,
(2) That the title to allaccessories, tools, equipment, sirens,
etc. which are added to the equipment will remain with the COOPERATOR and
the COOPERATOR may remove same, prior to returning the equipment to the FOREST
SERVICE.

The COOPERATOR Agrees:
(1)' To maintain current liability and property damage insurance
for each piece of equipment listed on the addenda.
(2) To make the equipment available for inspection quarterly by
a representative of the FOREST SERVICE.
(3) That the equipment may not be sold, junked, or traded, but
must be returned to the FOREST SERVICE for final disposition.
It is Mutually Agreed:
(1) The permanent Florida Forest Service license plate will con-
tinue to be used on the equipment.
(2) The equipment will be.marked in a manner that will indicate
the cooperation between the COOPERATOR and the FOREST SERVICE.
This agreement will be effective from the date of execution by the
State Forester and will continue in force from year to year unless terminated
by either party by thirty (30) days written notice to the other, provided,
however, that all of the provisions herein are complied with.

and. acting officials have hereunto set their hands.

The Deputy Clerk submitted the resignation of James E: Roberts,
as County Veterans'.Service Officer, effective August 31, 1965, to
accept a position with the Florida Department of Veterans' Affairs in
Coral Gables, Florida. Upon Motion by Commissioner McCullers, seconded
by Commissioner Macdonald and unanimously carried, the resignation of.
James E. Roberts was accepted with regrets. Upon the recommendation
of Mr. Roberts and on Motion by Commissioner McCullers, seconded by
Macdonald, :and unanimously carried, Mr. George E..Stokes was appointed.
,as Indian River County Veterans' Service Officer, effective August 23.
and that he be authorized to attend the County Service Officer's
School in St. Petersburg from September 1 through September 15.
Mr. Prank Zoro reported that a property owner adjoining his
property has placed a number of bee hi-res along the property line
and he felt this was a hazard to the public. The problem was
referred to the County Attorney and the County Engineer to interpret
the zoning regulations to determine what can be done..
The County Engineer presented an aerial photograph showing
alternate routes for the Wabasso Bridge approach, and the Engineer
was authorized to discuss .L situation with Mr. Davidson of the
State Road Department.
Motion was made b' Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried that the County Attorney be instructed
to negotiate with Mr, George Heath, representing Takaho Corporation,
the following: That Takaho Corporation will convey to thCounty a
60' right-of-way, being the extention of North Gifford Road, with the
agreement that Takaho Corporation will retain possession of the property.'
during the 10 year period after the date of the deed, except however,
in the eventAhe use of the -property surrounding this right-of-way
changes from agricultural purposee to some other purpc3e, the County
could take possession of the right-of-way. In the event that Takaho
does not execute such an instrument within sixty days, then this right-
of-way shall be condemned..

Motion was'made by Commissioner S'1addell, seconded by Commissioner
Macdonald, and unanimously carried, that the Engineer request the State
Road Department to survey the feasibility of re-routing Road 60 on
the North side of the Main 'Canal.
The Engineer reported that the plans submitted by Miss Mary Lou
Durrance for a building on land leased to the West'Wabasso Progressive
Civic Club had been checked and that the estimate was higher than
expected. The plans are being revised and a new estimate will be made.

MoCullers and unanimously carried, that.the Beverage Department be
notified that the Application of Taylor M. King.for a 1APS (Beer,
package sales, only) license at King's Mile Inn Grocery at the corner
of Old Dixie Highway and 12th Street does, conform to the zoning
regulations of the County, and further, that the application of
J. C. Hargrove for a 2APS license (beer and wine, package sales, only)
at Hargrove Hot Spot, Lot 4, Block 3, Hargrove Subdivision, does
.conform to the zoning regulations of the County, the Resolution.
adopted in 1956 and.recorded .in Minute Book 5 page 2 having been amended.
The County Engineer presented a quotation for a Welbilt 5605R
Reverse Cycle Air Conditioner, installed, from Barker.Blectric Co of
3215.00 for the Clerk Circuit Court office. Motion was made by
Commissioner Waddell, seconded by'Cormiosioner McCullers and unanimously
carried,.that the quotation of Barker Blectric Co., be approved.
The County Engineer•reported.on the Cemetery on North Gifford
Road'ao.had been requested by the Board.
Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried that Indian River County enter into
a cooperative project with•the In{ian River County Mosquito Control
District to work with the Mosquito Control District's hydraulic. dredge
to fill all salt marsh property, approximately sixty -Dix (66) acres,
held by the county in the vicinity of Round Island for the dual purpose
of eliminating mosquito and sandfly breeding areas and creation of
a waterfront parksite. The depth of the fill will be in accordance
with established Mosquito Control practices and average approximately
two and oxte-half feet above present marsh elevation. The cooperative
plan is that the funds for the work will be derived frog three sourcese
a lump sum of 330,000 contributed to the Mosquito Control District
from the County, local funds of the Mosquito Control District for the
remainder of the cost except for that part contributed by the state as .,
matching funds for the total amount spent or}'the project by the Mosquito
Control District.
Upon Motion by Commissioner Macdonald, secor,4ci by Oommissioner
McCullers and unanimously carried, the payment of r to ',2,000 was
authorized to Edmund S. Lucarelli for right-of-way on Fellsmere Road,
SR 512, being Lots 1, 2, & 3, Block 16, Tropical Village Estates S/D.
Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously 'arried that the Performance Bond of General
Development Corporation on Vero Shores Unit Two be extended until
September 8, 1965.
Upon Motion by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, John R, Gould was authorized -to
initiate appellate proceedings in the case, Indian River County vs.
Vero Beach Development, Inc. and Ctntinental Casualty Company.
The County Attorney reported that the Zoning Board hag held
a public hearing on the request oVJames J. Hinkle for a zoning
change and han approved the rd.i:+ested change and on Motion by Comm
issiofter Waddell, seconded by vommissioner Macdonald and unanimouslj
carried, a public hearing on'the request; was set for September 8, 1965.
The several bills and accounts against the County, having been
audited,.were examined and found to be correct, were approved, and
warrants issued in settlement of same as follows: General Fund., Nos.4279
to 4357, both inclusive; Road and Bridge Fund, Nos.2866 to 2908, both
inclusive; Pine and Forfeiture .fund, Nos.426 to 438, both inclusive;
-and Capital Outlay Fund, Nos.120 to 122, both inclusive. Such bills
and accounts being on file in the Office of the Clerk o!'.the Circuit
Court, the warrants so issued from the respective funds. peing''risted
in the Supplemental Minute Book as provided by the rules; of the State
Auditor, reference to.such record and list do recorded 'being made a.
part Of these minutes.
