The.Board of County Commissioners of Indian River County met
in regular session on.Thursday, September 9, 1965, at the Courthouse,
Vero Beach, Florida. All members were present. Also present were
John.H. Sutherland, County Attorney; Edwin S. Schmucker, County
Engineer; and Alfred H. Webber and Ruth. Elliott, Deputy Clerks.•
The Chairman asked if there were any corrections or additions -
to the minutes of August 4 and August 9., 1965. There were none
and on Motion by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, the minutes were approved.
Mrs. Gladys Vigliano, County Welfare Worker, presented a
bill from Mecca Convalescent Home for oxygen for•Ethel E. -Bauer,
a county patient. Mrs. Vigliano.was requested by the Board. to
contact the patient's family concerning this bill.
.Mrs. Vigliano presented three quotations for an. air-conditioner
for her office and on Motion by Commissioner Waddell, seconded by
Commissioner McCullers and unanimously carried, the quotation from
D.-& J. Sheet Metal for. a 11,700 BTU, Coolerator Model R51221, Heat
and Cool, for $235.00, plus installation costs of $25.00, -was -accepted.
The County Engineer reported ,that additional.restroom facilities
were needed.at the Old -Health Center Building and estimated the cost
not to exceed $400.00. Motion was lade by Commissioner .Macdonald,
seconded by Commissioner Haffield.and unanimously carried; that
Commissioner McCullers check into the'situation.
Alfred H. Webber presented a proposal from Althea L. Irving for
janitoral service at the Old Health'Center Building for $50.00 a month,
which includes cleaning same' thoroughly twice a week, cleaning two rest
rooms, locking building at night and mowing the lawn. Upon Motion by
Commissioner Macdonald,. seconded' by Commissioner Waddell and unanimously

The Chairman read the foregoing Notice and asked if anyone
present wished to be heard. A letter from Sidney B. Krassner, Counsel
for General Development Corporation was read,
objecting to the proposed
change on behalf of General Development Corporation and tin the interest,
of the affected contract purchasers in Sebastian Highlands Unit Four.
Motion was made by Commissioner Macdonald, seconded by Commissioner
Haffield and the zoning change be granted, as recommended by `the Zoning
Commission, and that the zoning map be changed in order that the
following property be changed from -F1 Agriculture District to R3A
Retirement District: All that part of the Mk of the NE4 of Section
14, Township 31 S, Range 18 E, lying west of Roseland Road, containing'
approximately 31 acres.
County Agent Forrest McCullers reported. to the Board that as
agriculture has increased, the paper work of his office has doubled
and that he has secured the services of John McQuire, Assistant County
Agent of Brevard County, on a part-time basis at no cost to the County.
The Agriculture Extension Service is required to comply with the
Civil Rights Act and he is required to personally report to the Board
that he is complying with the Act.
The Board requested the County Agent to make recommendations
and suggestions. on planting and transplanting at the South County
'Beach Park.
At. the request of Tom Trent, Civil Defense Director, each member
of the Board appointed an alternate to serve should it be necessary
at the .time the Civil Defense Council needs to act.
Commissioner Waddell moved that the Civil Defense Director be
authorized to go to Jacksonville to confer with the Director of
Civil Defense should he find it necessary. Motion was seconded by
Commissioner Macdonald and unanimously carried.
Motion was:made by Commissioner Macdonald, seconded by Commissioner
Haffield,and unanimously carried that an expenditure not to exceed
$100 be authorized to 'repair the tile and door at the Civil Defense
office.
Motion was made by Commissioner Macdonald, seconded by
Commissioner Waddell and unanimously carried that the Clerk be reques.ted
to write the State Comptroller concerning the bill from Frank Electric
Company for wiring and labor at the.storage.building at the jail; and
to pay the authorized charge of $256.95 for double throw switch.

Upon the recommendation of the County Attorney and on Motion
by Commissioner Macdonald, seconded by Commissioner Haffield and
unanimously carried, a settlement of $3,450.00 ($3125 plus $325 Attorney
fee) for the right-of-way for West Wabasso Road, Parcel 137.1, owned
by Avesta S. Mowatt, et vir was approved.
The County Attorney reported that a Final Decree has been filed
in the case no. 6935, City of Vero Beach vs Homer C. Fletcher, as Tax
Assessor of Indian River County, et als., and that a petition for re-
hearing on the Final Decree has been filed. upon the recommendation
of the County Attorney, Motion was made by Commissioner Waddell,

seconded by Commissioner McCullers and unanimously carried, that
the County Attorney be authorized to join the Attorney for the Tax
Assessor in an appeal of this suit in the event that the petition
,for re -hearing is denied; and further, that the Board• officially
request the•Indian River County School Board and all other taxing
districts of Indian River County to take similar action.
Motion was made by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously carried that the Board request the Tax Collectors
office to investigate and take any action that is.feasible for the
collection of back taxes owed Indian River County by the Florida
East Coast Railway, and to pursue, if feasible,the same avenue of
collection that the City of Miami has taken.
The Deputy Clerk read for following letter and it was moved by
Commissioner Macdonald, seconded by Commissioner Waddell and unanimously
carried that Clerk be authorized to draw a warrant to Julian W.
Lowenstein, dated October 1, 1965, and turn it over to the County
Attorney:

You of course are cognizant of the fact that the Board of County
Commissioners entered into a lease purchase agreement with me on a
parcel of land near the South end of the County running from ocean to
river.
There is a mortgage on this property approximating $24,000.00, which
is the amount which the County.is to pay upon exercising itsoption
to purchase 100 feet of this land.
This mortgage carries an interest rate of 5% per annum, the thought
occurred to me that the County may be interested in paying the
$24,000..00 for the first release by September lst, in which case I would
rebate the County $400.00 which would represent the interest.saving.
In the event you could not arrange this financing by September 1st, I
would then be willing to rebate the County $300.00, if''the $24,000.00
would be forthcoming by October 1st.
In the event the County is interested in this proposition, I would
appreicate hearing from you at your liest convenience.,;

RESOLUTION
WHEREAS, the Board of County Commissioners of Indian River County
are in the process of constructing North Winter Beach Road between
Rangeline and Ranch Road; and
WHEREAS, in conjunction with this construction, the Sebastian
River Drainage District, a political subdivision of the State of
Florida, is improving and widening their existing canal in this
same area; and
WHEREAS, the Board of County Commissioners has acquired a
certain right-of-way from Robert W. Newman and Jane Newman, his wife,
without compensation, described as the South 30 feet of the North
921 feet of the West 562.15 feet of the East 762.15 feet of Section 12,
Township 32 South, Range 38 East; being .4 of an acre, more or less,
which said deed is recorded in Official Record Book 216, page 137; and
WHEREAS, the right-of-way from Robert W. Newman and Jane Newman,
his wife as described does not properly line up with North Winter Beach
Road and the Sebastian River Drainage District requires the said right -
of -,way for the construction of their canal; and
WHEREAS, The Sebastian River Drainage District owns a right-of-way
which is described as the North 30 feet of the South 62.5 feet of the
East 629.72 feet of the SES of Section 1, Township 32South, Range 38
East, would better suit the new road alignment; and
WHEREAS, the Sebastian River Drainage District has agreed to
exchange, without compensation, the rights-of-way as described above
as an easement to Indian River County, subject to the Sebastian River
Drainage District's paramount right to the use of this property for
the maintenance of thedrainage system owned by the Sebastian River
Drainage District; and
WHEREAS, the Board of County Commissioners are satisfied that the
above right-of-way acquired from Robert W. Newman and Jane Newman, his
wife, is required by the Sebastian River Drainage District and is not
needed for County purposes;

NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Indian River County, that the chairman and the Clerk
are hereby authorized to execute a deed to the'Sebastian River Drainage.
District for the property acquired from Robert W. Newman and Jane
Newman, Ids wife, as described above, in exchange for an easement
from the Sebastian River Drainage District to Indian River County,
subject to the Sebastian River Drainage District's paramount.right
to maintain their drainage facilities, which easement shall be used
for the construction of North Winter Beach Road by Indian River County
and said exchange is to be without any cash consideration other than
set forth in this Resolution.
The County .Engineer reported that Miss Durrance had re -submitted
the plans for a- building on the county -owned land leased to the West
Wabasso.Progressive Civic Club; but that the plans were still the same
and the estimate3cost of materials only was $5000.00 which did not
include any IabOr,whatsoever, septic tank, electrical. work. It was-
-the consensus of the Board that they were still Ln favor of building
a Small buildingto be used by the Health Department in that.areal but
'not a building of the size specified in the.plans submitted.

The following applications for License to Carry firearms were
approved on Motion by Commissioner Macdonald, seconded by Commissioner
Waddell and unanimously carried: Jan Kromhout, H. D. McClelland,
Leon G. Bass and O. F. Pippin.
Motion was made by Commissioner. Waddell, seconded by Commissioner
Haffieid and unanimously carried, that the Chairman and Clerk are
authorized to sign the Application for State Aid to Libraries.
Upon Motion by Commissioner Waddell, seconded by Commissioner

The County Engineer reported that the total estimate of engineering.
costs, contract and guard rail on Ranch and Oslo Roads is $260,000 dor
four. and one-half mile of road.. On Motion by Commissioner Waddell,
:seconded by Commissioner. Macdonald and unanimously carried, that the
Engineer is authorized to request the'State Road Department to let
the contract On 3' mile on Ranch Road and that the 1 mile on Oslo. will
be built by the County out of County funds.
Upon Motion by Commissioner Waddell, seconded - by Commissioner
Haffield and unanimously carried, the County Engineer was authorized
to retain a certified engineer to survey the approach to the Wabasso
Bridge from U. S. #1, have the plans drawn up and sett to the State.
Road Department.
After considerable discussion.of the Route 60 bypass at the main
canal, Motion was made by'Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried, that the.County Engineer and any
member of the Board are authorized to go to Ft. Lauderdale to discuss
the problem with Mr. Davidson of the State Road Department.
Mr. Homer C. Fletcher and Howard Heller of the National Cash
Register Co. appeared before .the Board with an.estimate for.an electronic
accounting.system, NCR #395, which Mr. Fletcher feels is necessary
to carry out the re -valuation program ordered by the State: Comptroller,
and to take care of the continuing growth of his office. Mr. Heller
was requested to submit his proposal for consideration of the Board
at their next Meeting.
Commissioner Waddell moved that the County Engineer be requested
to write Mr. Bill. Reams that the Board isof the opinion that if he
can get a 50' right-of-way for 10th Place, East of
20th Avenue, have
a private contractor build a road to meet county specifications, deed
it to the county without costs, then the County will accept maintenance
of it. The Motion was seconded by Commissioner McCullers and unanimously
carried.
At the request of Commissioner Waddell, the County Engineer
was instructed to place "Slow Children at Play" signs in Ixora Park

Subdivision and to cut the weeds at Hibiscus Airport Road and Old
Dixie Highway.
Upon Motion by Commissioner Macdonald, seconded by Commissioner
Haffield and unanimously carried, it was voted to hire a professional
planner to make a plan of AlA from Indian River Shores to the Sebastian
Inlet and to make a zoning recommendation for the Zoning Board to.
follow.
Motion was made by Commissioner McCullers, seconded by Commissioner
Haffield and unanimously carried that the Clerk and Alfred H. Webber,
Deputy Clerk, be authorized to attend the Fall Convention of the
County Finance Ofgicers Association at Clearwater, October 13 to 16, 1965.
Homer C. Fletcher, Tax Assessor, requested the Board to have the
plywood which he used during the most recent hurricane threat made
into portable storm shutters for his office. Upon.Motion by Com-
missioner Haffield, seconded by Commissioner Waddell, and unanimously
carried, the County Engineer was instructed to purchase the bolts,
drill the holes in the plywood and in the wall, and it will be
the responsibility of the Tax Assessor to have thestorm shutters,:in-
stalled when necessary.
J. Ralph Lundy, President of the Progressive Civic League of
Gifford, Inc., renewed their request for improvements on streets
moat frequently used in the Gifford Area, to -wit:
28th Avenue, from North to South Gifford Road
45th Street from the Railroad to 35th Avenue.
31st and 35th Avenues from North to South Gifford Road
29th Place from North Gifford Road to Gifford Elementary School
38th Place in South Gifford
33rd Avenue north to Lindsay Road
He stated that the 29th Place and 45th street problems are among the
most serious and the 33rd Avenue is also in need of attention. He
rcquebted that 29th%Place be paved and suggested that the School Board
might share the cost. Motion was made by Commissioner Waddell, seconded
by Commissioner Haffield and unanimously carried, that the County
Engineer have an aerial photograph made of the Gifford area, provided
the expense involved does not exceed $500.00, and to begin preliminary
right-of-way negdiations, particularly on 29th Place, from North
Gifford Road, to Gifford Elementary School,
The County Engineer reported'on the progress of..General Development
Corporation concerning the extention of the performance bond on
Unit 2, Vero Shores Unit #2. The County Engineer was requested to
inform General Development Corporation to have the necessary legal
papers prepared, along with an affidavit that there is no.person that
that ownsor has any right whatsoever to the property being vacated,
to be presented to the Board at their next meeting.
The County Engineer requested that the following right-of-way
agreement with Mr. W. E. Faulkner on Glendale Road, west of Kings
Highway be.approveds furnish 20 loads of shell to resurface an
existing road, and to trim -and hedge a double row•of Australian pines
in exchange for aright-ofway, 30' x 330'. Action on the proposed
agreement was postponed until the next meeting of the Board.
The following. right-of-way agreements on Citrus Road between
Emerson Avenue and Clemman Avenue were approved on Motion by Com-
missioner Waddell, seconded by Commissioner Haffield 'and carried:

Upon Motion.•by Commissioner Waddell, seconded by Commissioner
Haffield and unanimously carried, a speed limit of 35 MPH was established
on 44th Avenue between Route 60 and 22nd Street
'On Motion by Commissioner Waddell, seconded by Commissioner Mccullers,'
and unanimously carried, the County Engineer was authorized to attend
a short course. in coastal Engineering at Cape Kennedy, Nov'30 to Dec. 4,
1965.
Upon Motion by Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried, the Chairman and the Clerk were
authorized to execute the following Right -of -Way Agreement between
Indian River County and Florida Power and Light Company, in words and
figures, to -wit:

RIGHT OF WAY AGREEMENT
KNOW ALL MEN BY THZSE PRESENTS that INDIAN RIVER COUNTY, a
political subdivision of the State of Florida, in -consideration of
.the sum of One Dollar •($1.00) and other valuable considerations,
receipt of which is hereby acknowledged, does hereby grant to the
FLORIDA POWER AND LIGHT COMPANY, a corporation organized and
existing under'the laws of the State of Florida, whose address is
P. 0. Box 3100 (25 S.E. 2nd Avenue), Miami, Florida, and to its
successors and assigns (the term "assigns" meaning any person,
firm or corporation owning by way of assignment all rights under
this Agreement or a portion of such rights with the Grantee or
its other assigns retaining and exorcising the other rights), an
easement forever for a right of way 60 feet • in width to be used •
for the construction, operation and maintenance of one or, more
overhead electric transmission and distribution lines (including
wires, poles, "H" frame structures, towers, cables, conduits,
anchors, guys, telephone and telegraph lines and appurtenant equip-
ment) and one or more underground pipe lines (including appurtenant'
equipment) for the transmission of electricity, gas or petroleum
products in, over, under, upon and across the following described
lands of the grantor, situated -in the County of Indian River,
and State of Florida, and more particularly. described as follows:
Over, upon and across that certain parcel of land
designated as a park and lying immediately North of
Lot 13, Block X, of the Plat of Vero Tropical Gardens,
Unit 2, as recorded in Plat Book 6, at pages 64 and 64-A,
of the public records of Indian River County, Florida;
together with the right and privilege to reconstruct, inspect,
alter, improve, remove or relocate such facilities or any of
them on or under the right of way above described, with all rights
and privileges necessary or convenient for the full enjoyment or
the use thereof for the above mentioned purposes, including the
right to cut and keep clear all trees and undergrowth and other
obstructions within said right of way and all trees of such height
on lands of grantor adjoining said.right of way that may interfere
with the proper construction, operation and maintenance of such
facilities or any of them, and also including the right. of ingress
and egress over adjoining lands of grantor for the purpose of
exercising this easement or all or any of the rights granted here-
under.
The grantor, however, reserves the right and privilege to
use the above described right of way for public park purposes and
all other purposes except as herein granted or as might interfere
with Grantee's or assignee's use, occupation or enjoyment thereof;
and providedfurther that no buildings or structures other than
fences will be located or constructed by grantor on said,right-of
way. Grantor shall not excavate any portion of the righray'

I HEREBY CERTIFY that on this day, before me, an officer
duly authorized in the State and County aforesaid to take
acknowledgments., personally appeared Robert.W.-.G aves.and.

The County Engineer reported that a trailer is located on North
Gifford Road on land Mr. Parrish is purchasing from Nor. Raymond Smith
which is in violation of the zoning regulations of the County. The
County Engineer was instructed by the County Attorney to have the
Sheriff serve a Notice to all interested parties that the trailer must
be moved within two weeks.
The County Engineer was requested to contact Attorney. Charles
Herring, the Trustees of the I. I. Board in regard to the status of
the deeds to the land at the Sebastian Inlet and to discuss with'
Engineer Kenneth Damerow the right-of-way into the park.
The County Engineer presented an estimate of $275.00 from Don
Smith to .paint the exterior of the building purchased from Klingensmith
behind the Courthouse. Tt was the opinion of the Board to have
this painting done at such time there is a request for the space.
Upon Motion by Commissioner Macdonald, seconded by Commissioner
Waddell and unanimously carried, the County Engineer was authorized
to proceed with clearing the right-of-way on 44th Avenue, south of
Road 60, moving the ditch to the east right-ofway line, as previously
authorized in the minutes of July.7, 1965, and to rebuild the road.
The Monthly reports of the County Welfare Worker, the County
Agent and the County Service Officer were received and placed on
file.
A report from the State Road Department of the study for a
traffic signal at U..S.#1 and 12th Street was received and the
minimum warrants for signalization are not met at the present time.
On Motion by Commissioner Waddell, seconded by Commissioner Mc -
Cullers and unanimously carried, the installation of street lights
at the following locations were approved: Intersection of ALA and
Wabasso Beach Road, and intersection of Ranch Road and Route 60..
The several bills and accounts. against the'County, having been
audited, were examined and found to be correct, were approved, and
warrants issued. in settlement. of same as follows: General Fund, Nos.
4384 to 4484, both inclusive; Road and Bridge Fund, Nos. 2932 to 3001,
both.inclusive, Find and Forfeiture Fund, Nos. 439 to 450, both in-
clusive; Capital Outlay Fund, Nos. 125 & 126. Such bills and accounts
being on file in the office. of the•Clerk of the Circuit Court,the
warrants so issued from the respective .funds being listed in the
Supplemental Minute Book as provided by the .rules of the State Auditor,
reference to such record and list so recorded and, being made a part of
these minutes.
