NO - NAME ISLAND FDEP Survey Indian River County Project No . 0860 WORK ORDER NO . 7 ( Engineering/Surveying ) FOR PROFESSIONAL SERVICES AGREEMENT ANNUAL SURVEYING and MAPPING /GIS SERVICES WITH Kimley- Horn and Associates , Inc. In accordance with Contract No . 0725 2007-2009 This Work Order No . 7 is in accordance with the existing AGREEMENT dated November 6th 2007 between Kimley- Horn and Associates , Inc . (SURVEYOR) and Indian River County ( COUNTY) . This Work Order No . 7 amends the agreement as follows : SECTION I — PROJECT LIMITS This Work Order No . 7 is for the SURVEYOR to perform all related field and office Surveying and Mapping services in connection with the Mean High Water and boundary determinations of the NO - NAME - ISLAND bordering Round Island River side Park . SECTION II - SCOPE OF SERVICES As agreed upon between SURVEYOR and the COUNTY , the SURVEYOR shall provide Professional Land Surveying services to complete all tasks as outlined in this Work Order No . 7 , and per the attached Scope of Services and cost outline ( Exhibit A) . ( Cont) IRC Work Order #7 Round Island NO- NAME- ISLAND DEP Survey May 19" 2009 Agenda Page 2 of 3 SECTION III — TIME FOR COMPLETION & DELIVERABLES/WORK PRODUCT 1 . Project shall be completed as follows : • Task 1 , 30 calendar days of Notice to Proceed . • Task 2 , 45 calendar days of Notice to Proceed . 2 . Deliverables -The SURVEYOR shall provide the COUNTY : a . As defined in attached proposal and scope of services ( Exhibit A) and related digital AutoCAD and PDF files . b . Work Product and digital versions are to be prepared and submitted so that the COUNTY or other consultants can readily use it for the design and analysis of the area , as defined . It shall contain all information necessary for third - party surveyor to independently recreate and/or utilize the survey work . It is acknowledged all final products become property of the COUNTY and will be available for use by the public at large . c . The SURVEYOR ' S work product shall meet or exceed the minimum standards as defined by Sections II , III and IV. SECTION IV — COMPENSATION The COUNTY agrees to pay , and the SURVEYOR agrees to accept a total lump sum fee of $ 35 , 990 . 00 for the above described services rendered as identified in Sections I , II , and III of this Work Order No . 7 . All and /or any additional services not described hereon shall be pre -approved by the COUNTY . Approved additional services shall be invoiced at the rates disclosed in the approved fee schedule with the SURVEYOR for the contract year ( s ) of November 6 , 2007 through November 5 , 2009 . All invoicing shall include project number (0745 ) , Work Order No . (W07 ) and Contract Number ( 0725 ) . Payments shall be in accordance with the original Professional Surveying and Mapping /GIS Services Agreement , contract No : 0725 with the COUNTY and as stated in Section II , III and IV hereon . O ' Brien : Kimley-Horn and Associates , Inc . ( "KHA") is pleased to submit this letter agreement (the "Agreement") to Indian River County ("the Client") for providing survey and mapping services . Our scope of services, schedule, and fee are below . Scope of Services Task I — FDEP Mean High Water elevation determination This task will consist of the following : • Research tidal information from the FDEP database . • Submit for Mean High Water Procedural Approval through FDEP and copy to Indian River County. • Perform a tidal datum study at No Name Island in accordance with FDEP requirements . • Prepare and submit data to FDEP and copy to Indian River County. • Set 3 tidal benchmarks at Round Island Riverside Park/No Name Island . Benchmarks will consist of a 4 " x 4 " concrete monument with an identifying disk or a nail and disk set in the concrete bulkhead . Task 2 — Prepare a Mean High Water Line Survey of No Name Island Upon receiving the approved mean high water line elevation from FDEP this task will consist of the following : • Establish horizontal (NAD 83 /90) and vertical control (NAVD 88 ) on No Name Island • Establish the vertical location of the Mean High Water Line elevation around the perimeter of No Name Island, approximately 3 ,400 linear feet . ■ TEL 772 562 7981 FAX 772 562 9689 pppp� 'I Kimley- Horn EXHIBIT " A " and Associates , Inc . • Horizontally locate the Mean High Water Line around the perimeter of No Name Island . Provide approximate location of the existing wood river view platform, tower and bridge crossing to island . • In addition to existing deed description , write a metes and bounds legal description for No Name Island based upon the surveyed location of the mean high water line . • Locate the northwest and southwest section corners (and as applicable, corners of the Kansas Colony Plat) for Section 34-3340 and estimate the location of the Kansas City Colony Subdivision lot lines . • Prepare a signed sealed Special Purpose-Mean High Water Line Survey for initial review and then final submittal to FDEP and Indian River County. Additional Services Any services not specifically provided for in the above scope will be considered additional services and can be performed at our contract hourly rates . Deliverables Deliverables will consist of the initial submittal and 5 certified final copies of the Special Purpose -Mean High Water Line Survey . Schedule We will submit the tidal datum study data described in Task 1 to FDEP within 30 business days from written notice to proceed . We will provide those services described in Task 2 within 30 days of receipt of the approved mean high water line elevation from FDEP . KHA will perform the Scope of Services for a lump sum fee of $ 35 , 990 . All permitting, application , and similar project fees will be paid directly by the Client . Closure In addition to the matters set forth herein , our Agreement shall include and be subject to, and only to, the terms and conditions in the existing AGREEMENT dated November 6, 2007 , between Kimley-Horn and Associates, Inc . , (SURVEYOR) and Indian River County (COUNTY) under the contract number 0725 . ppprw � „ Kimley- Horn EXHIBIT "A" and Associates , Inc .
