The Board of County Commissioners of Indian River County met
in regularse.ssion on Wednesday, November 10, 1965, at the.Courthouse,
Vero Beach, Florida. All members were present. Also.present were
John H. Sutherland, County. Attorney, Edwin.. S.S:chmucker, .County-
Engineer, and Alfred H. Webber and Ruth Elliott, Deputy Clerks.
The Chairman asked if there were any corrections or additions
to the minutes of October 6, and October 20, 1965. There were none,
and on Motion by Commissioner Macdonald, seconded by Commissioner
:Hatfield, and unanimously carried, the minutes were approved.
In.response to .the invitation extended. at the last meeting,
delegations again appeared wit.h•regard to the paving of Rosewood:Road.
The County Engineer presented a location map, showing all of the
existing improvements along the road, and the relationship of the canal
bank on the south side of the section line to the.north.right.-of-way
line. He stated that there exists now between 31 to 36 feet of width.
between the canal bank and the north right-of-way line. The Bridge
at wings Highway. was built 20 feet north of the .Section line, and
that ]tth Street, east of Clemman Avenue,.'was built 15 feet north of
the.Section line.
The Chairman stated that the County can pave ;the road on' the
existing right-of-way. The'County may.have to removea few shrubs
so that one can see to get on'the.street and may have to obtain a
little more right-of.-way'on the, west end, at Kings Highway.,
•
then asked if anyone present wished to be heard.
Mr. C. Ellis Duncan read a prepared statement, the same was
received and filed. Mr. Ralph Stognar expressed his views for the
paving of the Load. Mr. Duncan suggested that it might be -well to
have engineers from both sides work on this project and Offered his
services.

Motion was made by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously carried, that the County Engineer be instructed
to design and build and pave Rosewood Road on the existing right-of-way,
however, it may be necessary to acquire some right -of -may from Mr.
Graves on the west end, at Kings Highway; and that the Engineer .be
instructed to preserve all trees possible in exercising this project.

The Chairman read the foregoing Notice and bids were received
and opened as follows: InternatiorrlBusiness Machines Corporation,
One IBM "Executive" Typewriter with 13.' carriage, $594.00, less
trade-in allowance of $120.00, net bid price $474.00. Upon Motion by
Commissioner Macdonald, seconded by Commissioner McCullers, the bid
of.International Business Machines Corporation was accepted.
Mr.. Frank Zorc and hisattorney, James T. Vocelle, appeared before
the Board and Mr,. Vocelle stated that he has advised Mr. Zorc.that the
bees, .in their. location, are in violation of the Zoning Rules'and Reg-
ulat•ions.of the County, and requested that the Board stake appropriate
action. Motion was made by Commissioner Macdonald,:seconded by Care
missioner Waddell, and unanimously carried, that the County Engineer
be instructed to send a: formal notice, through the Sheriff's Department,
that Mr. Bruce Ward remove the bees, and, if he does not do,so, to
swear out a warrant -for his arrest.
Motion was made by Commissioner Waddell, seconded by Commissioner.
McCullers and unanimously carried, that the proposed plan for extending
_Colonial Terrace Subdiv1sion,•presented by James L.'Beindorf, be tentatively
approved.
Mr. Robert F. Lloyd, representing the St. Johns Drainage District,
asked that the Board request the State Road Department to give the
right-of-way requirements for the widening of'State Road 60 so that
the County can continue to negotiate with the .St. Johns Drainage District
in the acquisition of this'.right-of way. On Motion by Commissioner
Macdonald, seconded by Commissioner Haffield and _unanimously carried,
the request was granted.
J. Ralph Lundy,'of the• Progressive Civic League of Gifford, again
requested that something be done to relieve street conditions in Gifford,
that have existed .for..years and that have'been previously called to the
board's attention. He also asked that 31st Avenue and 20th Avenue be
checked for heavy traffic during Gifford Homecoming A.ctivities.this
week -end. Commissioner Haffield stated: that temporary improvements
have been made on the parade route, and moved that the County Engineer
be, authorized to pave_,2 th,:gourt-, which runs from North Gifford Road.,.
-north to the Gifford Elementary School and to pave .28th Avenue, and
further, to begin preliminary construction on 50th Avenue-frofn Road 60`.
to Walker.Avenue. Motion was seconded by Commis.sioner.Macdonald, and
..unanimously carried.

Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald•, and unanimously carried, that the bid of Hoyt C. Foster
for Item 1, of Naimey Enterprises, Inc. for Item 2, of Naimey Enter-
prises, Inc. for Item 3, of Denver L. Calloway for Item 4, of Billy M.
Moody for Item 5, of Naimey Enterprises, Inc., for Item 6, and of
Roy F. Jones for Item 7, be accepted; and, upon the recommendation
of the Civil Defense Director, that the bids received for Items 8 through
11 be rejected.
After considerable discussion concerning aerialphotographs,
the County Engineer was instructed to check with the East Coast Regional
Planning Council for recent low-level photos of the Gifford -area,
and to prepare a list of at least four to five miles before aerials
are pit up for bids.
Mr. David Langfitt appeared before the.Board and asked if they
were aware o.f the situation at the sebastian Inlet and he feels that
it has become a public health matter, He was told that the Board
was aware of the matter but that the Board was stymied until the County
gets title to the property. The. County Attorney reported that Mr. Charles
the agreement and
Herring i' preparing a letter to release/the deed from escrow and on
Motion by Commissioner Macdonald, seconded by Commissioner Waddell and
unanimously carried, the County Engineer was instructed,assoon as
the agreement is received, to give notice to all persons in possession
of any of the County's right -of. -way (140' from. the Inlet) to vacate
within sixty (60) days.
Commissioner Macdonald moved, seconded by Commissioner Waddell,
and unanimously carried, that .the Chairman appoint a committee to ex-
pedite the development of the Sebastian.Inlet Park in all of its phases.
The Chairman appointed Commissioner Macdonald as Chairman of the committee,
the County Attorney,, John H. Sutherland, and the County Engineer, Edwin
S. Schmucker.
Mr. Atkinson, railroad inspector from the Florida Public Service ;
Commission, informed the Board of a public hearing to be held December 9,
at 10:00 A. M. in the County Commission room, for the purpose of taking
testimony concerning the public need for.full restoration of passenger
train service over the Florida East Coast Railroad, equivalent to that
provided prior to the strike. The members of the Board. were urged to
make .an appearance at the hearing and support the effort.
The County Engineer. reported onthe proposed. approachto the
Wabasso Bridge and, after considerable discussion, Commissioner Waddell
moved that -the .curved section be changed to a straight tangent on the
short span at the west end of the new Wabasso Bridge, and that the.
County Engineer be instructed to request the State Road Department to
make.this change in the.plans, provided that it does not, in any way,
jeopardize the letting.of the contract for the bridge in November..
Motion was seconded. by Commissioner,Macdonald,and unanimously carried.
Mr. W. E. (Kinky) Orth. asked if the Board had received any
correspondence from his attorney, B. T. Cooksey, regarding the Tropicolony
"ditch, and he was informed that the Board had received no correspondence.
The County Engineer presented a proposal from C. R. Cruze to sell.
the west 18 feet of the east 43 feet of Tract 8,A Twp 33S, Range 39 E,
for $1,000.00, and'on Mention by Commissioner Waddell, seconded by
Commissioner McCu.11ers and unanimously carried, the offer from Mr.
Cruze was accepted by the Board.
Commissioner Waddell moved, seconded by Commissioner.Haffield and
'unanimously carried, that the State Road Department be requested to
-lean the drainage ditch, which they own, between Road 60 and the Main
Canal in the area of. 50th Avenue (approximately 1/4 mile west of where
Road 60 crosses -the Main Canal) .

Upon Motion by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, the County Engineer was authorized
to purchase the following parcels of right-of-way:
1. Frank Van Antwerp, North Winter Beach Road, $900.00
2, Henry Prange, North Winter Beach, Road, •$500.00
3. Mrs. Eli Walker, Glendale Road. $750.00
Commissioner Waddell moved that payment of $500,00 be made
to Mr. J. R. Graves for right-of-way on the north side of North Winter
Beach Road between Rangeline and Ranch Road, provided that the Engineer
and Mr. Graves agree on specific accesses to be built prior to the
exercising of .the agreement. The Motion was seconded by Commissioner
McCullers and unanimously carried.
The County Engineer reported that work had been completed on
Unit #1 of Vero Beach Highlands and that General Development Corporation
had requested that the $25,000 performance bond be released. Motion
was made by Commissioner. Waddell, seconded by Commissioner McCullers
and unanimously carried, that the bond be released.
On Motion by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously carried, the following out -of -county travel
was authorized: the County Engineer to Pensacola on December 9 to
.attend a conference of coastal county engineers; a trip to West Palm .
Beach by the County Engineer. and Foreman Eugene Hamilton to view the
sanitary land fill operation;.the County Engineer and Commissioner
Waddell to attend a meeting of the Board.of Directors of State Association
of County Commissioners in Gainesville on December 4 and '5; and. the
County Engineer, Commissioner Waddell, Mr. Luke Blume and Honorable
Merrill P. Barber to attend a Regional Planning Council meeting in
Titusville on November 17.
The County Engineer reported that Mr. Van Ausdale, President
of Hobart Brothers, Inc. had said that they will soon release an
80 acre parcel of land leased from the State and wondered if the
County would be interested in it. Motion was made by Commissioner
Waddell, seconded by Commissioner McCullets and unanimously carried
the County Engineer write to Mr. Parker of the Trustees of the Internal
Improvement Fund to check the possibility of the Trustees selling this
land to the County, even though we have no immediate plans for development
at the present time.
Motion was made by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously carried, that the County'Engineer be authorized
to advertise for bids for a portable.generat.or.
Commissioner Waddell reported that the Historical Society would
release the Erickson. Building if they be -allowed to'store some articles
there temporarily, and thereupon moved that the Attorney General's
office be offered the.•use of the Erickson Building for the two Assistant
Attorney Generals and their secretaries who will be assigned to the new
Appellate Court.. Motion was seconded' by. Commissioner Macdonald•and
unanimously carried..
.Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald and -unanimously carried, that the Beverage Department be
notified that the following applicat-ions,for a beer and wine, package
sales only, license,conform with the zoning regulations of the county:
Robert B. Allison for Instant Mart of Indian River, Inc. South U.S.1 and
15th Street; D. J;.•Hempy, Johnson's Grocery, 43rd Street" in Gifford;
Hilton W. Coleman, Johnson's Grocery at 33rd. Avenue and 43rd Street
and, further,- that•the application of Ragan Kline, for a whisky package
sales license for Klines Package Goods at Oslo Road and U.S. #1 be'
delayed and that the. County Attorney be requested to determine whether
or not the School of the Novitiates is, for zoning purposes, a church,
or a school, if either.
Motion was made by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously carried that the County Attorney prepare a
proper Resolution'thanking the Governor, the Cabinet and the Justices
of the Supreme Court of Florida for selecting Vero Beach as the site
for the new Fourth District'Court of Appeals and our offer to cooperate
fully with. this Court,

RESOLUTION
OF
BOARD OF COUNTY COMMISSIONERS
OF INDIAN RIVER COUNTY, FLORIDA
WHEREAS, the Legislature of the State of Florida, in the
1965 Session, passed enabling Acts for the creating Of a Fourth
District Court of Appeal of the State of Florida subject to the
ratification of the: constitutional amendment by the voters; and
WHEREAS, the passage of a constitutional amendment by the
.electorate occurred on Novewber 2, 1965, ratifying the Act -of the
Florida Legislature; and
WHEREAS, the Florida Legislature provided that the site of
.said Fourth District Court of Appeal would be determined by a
Special Selection Committee composed of the Cabinet of the State
of Florida and the Supreme Court of the State of Florida; and
WHEREAS, pursuant to said authority, the said Special'
Selection Committee did on November 3,. 1965, select and designate
Vero Beach, Indian River County, Florida as the location of said
Fourth District Court of Appeal; and
WHEREAS, the Board of County Commissioners of Indian River
County, Florida, acting for itself and for all .of the citizens of
Indian River County, does hereby take great pride in the fact
that Indian River County has been chosen as the location for the
Courth District Court. of Appeal; and
WHEREAS, the Board of County Commissioners of Indian River
County, Florida is deeply appreciative of the honor that has been
bestowed upon our county by the Selection Committee;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Indian River County, Florida, in regular session

1. That this Board does hereby extend its sincere thanks
and appreciation to the Governor, theMeMbers of the Cabinet and
the.Justices of the Supreme Court of the State'of Florida:for.the
expression of confidence accorded the citizens of the Indian River
area by the selection 9f Vero Beach, Indian River County, Florida,
as the location of the Fourth District Court of Appeal.
2. That this Board does hereby offer its continued support
•and cooperation to the fullest extent possible in the orderly de-
velopment, maintenance and the improvement' of the judicial system
in the State of Florida, by assisting in securing proper temporary
quarters for the Fourth District Court of Appeal as well as assist-
ing in securing proper permanent quarters for said Court.
3. That certified copies of this Resolution shall be for-
warded to. the Governor, Members of the Cabinet and the justices of
the Supreme Court of the State of Florida.

The monthly reports of •the County'Service Officer, the County
Welfare Worker and the County Agent were received and placed on file.
Motion was made by Commissioner Macdonald, seconded'by Commissioner
Waddell and unanimously carried that the performance bonds dcposit'ed in.
Escrow for clean up after moving of the buildings west afthe Courthouse
be released, $30.00 Alfred Fletcher and $130.00, Y. G. Lanier.
The Clerk submitted the Annual Financial Report which was signed
to be forwarded to the Comptroller's office.
The Clerk was instructed to write the Comptroller, the• Attorney
General's office and the State Auditor for an opinion as to whether or
not $30,000 out of the Capital Outlay Fund can be used for improvements
on the City Hall to accommodate the Fourth District Court.of Appeals.
On Motion by Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried,.the petition of Edward A. Kistler
for admission to the Southeastern Tuberculosis Hospital was approved.
Commissioner Waddell moved that the Board exercise its first
option under the lease -purchase agreement for Lots 14,15, and 16,
Kansas city Colony Subdivision, and that the lease payment. of $5,7.60.00
by paid; also that the County Attorney be requested to prepare a closing
statement on the first purchase from Mr. Fred F. Liebert and Mr. A. L.
Liebert for $12,000.00, and that the Clerk be authorized .to make payments
accordingly. Motion was seconded by Commissioner McCullers and unanimously
carried.
On Motion by Commissioner Macdonald, seconded by Commissioner
Waddell and unanimously carried, the County agrees to pay a sum equal.
to 2/3 of the total cost of the construction of the second floor of
the City Hall and the parking lot, and reserves the right to approve
the final plans for the temporary quarters of the Fourth District Court
of Appeals.
The. County Welfare Worker was instructed to notify.all nursing
homes that,before they accept any person they expect the County to pay
for, they must have authorization from either the County Welfare Worker
or the Board of County Commissioners..

The County.Engineer reported that the State of Florida owns 31/2
acres of land north of Oslo Road and west of Lateral G•which, in his
opinion, would be suitable for dumping junk cars. He, stated that
if there were no objections he.would write the Btate requesting
further information concerning this land. No objections were expressed.
The several bills and accounts against the County, having been
audited, were examined and found to be -correct, were approved, and
.warrants issued in settlement of same as.follows: General Fund, Nos.
4655 to 4764, both inclusive; Road and Bridge Fund, Nos. 3098 to 3160,
both inclusive, and Fine and Forfeiture Fund, Nos 467 to 478, both
inclusive. Such bills and accounts being on file in the. office of
the Clerk of the Circuit Court, the warrants so issued• from thea
respective fuinds.being listed in the Supplemental Minute Book as
provided by the rules of the State Auditor, reference to such record.
and list so 'recorded and being made a part of these minutes.
