SECOND AMENDMENT TO
INDIAN RIVER COUNTY EMERGENCY CONTRACT
[Sheriff' s Office 911 Center — Additional Repairs]

THIS SECOND AMENDMENT to Indian River County Emergency Contract ( "Second
Amendment" ) is made and entered this 15th day of February, 2005 , nunc pro tunc to January
18 , 2005 , by and between INDIAN RIVER COUNTY , a political subdivision of the State of
Florida ( "County" ) and BARTH CONSTRUCTION , INC . , 1717 Indian River Blvd . , Suite 202A ,
Vero Beach , FL 32960 ( "Contractor ' ) .
BACKGROUND RECITALS .
A . The County and the Contractor have entered into an Emergency Contract for Repairs to
an existing facility at the Sheriffs Office Complex dated September 28 , 2004 (the "Agreement" )
for the repair and construction of certain emergency projects at the Sheriff' s Office Complex .
B . Pursuant to Paragraphs 2 . 1 and 14 of the Agreement, the County and Contractor desire
to amend the Agreement to include the additional emergency work at the Sheriff' s Office
Complex as more fully set forth on Exhibit " 1 " attached hereto and made a part hereof.
NOW, THEREFORE , for good and valuable consideration , the receipt and sufficiency of
which are hereby acknowledged , and intended to be legally bound , the parties hereto agree as
follows :
1 . The Agreement is hereby amended to allow for the additional services by Contractor at the
Jail on the specifications and at the price more specifically set forth on Exhibit 461 , 91
2 . All remaining terms and conditions of the Agreement not changed by this Second
Amendment remain in full force and effect .
3 . The Background Recitals are true and correct and form a material part of the Agreement ,
as supplemented by this Second Amendment.
IN WITNESS WHEREOF , the parties have executed this Second Amendment as of the
day and year first written above .
