MODIFICATION TO
CONTRACT FOR CONSTRUCTION OF REQUIRED SIDEWALK
IMPROVEMENTS
NO . PD -01 -02 -08 -CFCSIDE -C1 (99100114=27447)
THIS SECOND MODIFICATION , made and entered into this 8th
y of
February , 2005 , by and between The Suntree Partners , a Florida general
partnership , hereinafter referred to as " Developer" , and INDIAN RIVER
COUNTY , a political subdivision of the State of Florida , by and through its Board
of County Commissioners , hereinafter referred to as "County" .
WITNESSETH :
WHEREAS , Developer entered into a Contract for Construction of
Required Sidewalk Improvements No . PD -01 -02 -08 -CFCSIDE -C1 (99100114=
27447) guaranteeing the completion of certain required sidewalk improvements
within Phase 1 of Citrus Springs Village "C P . D . and posted the required
security; and
WHEREAS , on February 3 , 2004 the Board of County Commissioners
approved i Modification to Contract for Construction of Required Sidewalk
Improvements No . PD-01 =02-08-CFCSID &C1 (99100114-27447 ) to extend the
date to October 28 , 2004 to complete the required sidewalk improvements as
well as to reduce the amount of security since a portion of the sidewalks had
been constructed and inspected ; and
WHEREAS , on June 1 , 2004 the Board of County Commissioners
approved a Corrective Modification to Contract for Construction of Required
Sidewalk Improvements - No . . PD-01 -02-08-CFCSIDE-C1 (99100114-27447 ) to
correct and clarify the performance bond number and amount; and
WHEREAS , the developer has requested an extension to complete the
remaining required sidewalk segment to March 5 , 2006 and has substituted cash
in the amount of $2 , 962 .40 and executed a Cash Deposit and Escrow
Agreement ; an
NOW, THEREFORE , IN CONSIDERATION OF THE MUTUAL
COVENANTS AND PROMISES HEREIN : CONTAINED , the parties agree as
follows :
1 . The sidewalk completion date is extended to March 5 , 2005 .
2 . The performance bond has been substituted with cash in the
amount of $ 2 , 962 .40 representing 115 % of the remaining required
Phase 1 sidewalk improvements . See Exhibit "A" attached hereto .
3 . All . other terms set out in the Contract for Construction of Required
Sidewalk Improvements No . PD =01 -02 -08 -CFCSIDE -C1
(9910011447447) , as modified , remain in full force and effect.
IN WITNESS WHEREOF , the parties hereto have set their hands and
seals on the day and year first above written .

SUBJECT : Citrus Springs Village "C" P . D . — Sidewalk Performance Bonds No .
MB4207 and MB4208
On January 11 , 2005 the subject project was inspected for required bonded
sidewalks . The sidewalk, located in Phase C-2 , bond No . MB4208 has been
completed and can be released . The sidewalk in Phase C- 1 is not complete at
this time . One lot does not have a house constructed on it and approximately
184 L . F . of sidewalk has not been constructed . The current cost for bonding the
remaining sidewalk will be :
184 L . F . x 4 = 736 sq feet
736 sq feet x $ 3 . 50 = $2 , 576 . 00
$ 2 , 576 . 00 x 115 % = . $21962 . 40
