The Board. of County Commissioners of Indian River County
met at the Courthouse, Vero Beach, Florida, in a Special.
Yeeting held at 8:15 o'clock A. I,:., .Tue3day, December 28,1965.
iresent were; Vice Chairman D. B. i,:cCullers, Commissioner
Donald D:acdonald, Commissioner B. Q. Waddell and Commissioner
Jerre J. Haffield. Also present were; County Attorney John
H. Sutherland, County Engineer Edwin S. Schmucker and Deputy
Clerk Alfred H. 'Webber. Chairman Robert W. Graves was absent.

On motion made:by..Commissioner Waddell, seconded by
Commissioner Haffield, it was unanimously voted to authorize
the Clerk'to draw Warrant #3222 on Account #451 of the Road
and Bridge Fund in the amount of $2496.81 payable to Ralph
Harris, Clerk Registry of Court Funds_.. This was .to cover the
additional amount necessary to pay the Judgement on the
Condemnation Suit for ?labasso Road (Court Case #60).
County Engineer Schmucker discussed future intersections
of Interstate Highway #95 with Glendale Road and Oslo Road, and he
recommended an overpass for Glendale Road and an'.interchange
at Oslo Road. On motion made by Commissioner Waddell,, sedonded
by'Cormissioner Haffield, the following Resolution was unanimously
adopted;

RESOLUTION
WHEREAS, Interstate I-95 is now in the survey and planning stage
in Indian River County; and
WHEREAS, it is a non -access highway which will cause a barrier
through the entire length of the County approximately seven miles west
• of the Indian River; and
WHEREAS, there is a formulated•and planned county road system
established by this Board in Septemller 1958; and .
WHEREAS, to the best of our knowledge, there is planned two
interchanges at Fellsmere Road and State Road 60 and two. grade separation
structures at Citrus Road and Oslo Road which would not be sufficient.to
maintain East-West access for existing arteries or sufficient entrance or
exit to this facility,
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Indian River County, Florida, in Special Session on this the 28th
day of December, 1965, does hereby respectfully request the State Road
Department to include two additional grade separation structures, one
being at the intersection of 90th Avenue and the. other at Glendale Road,
and as well, change the grade separation structure for Oslo Road to a
standard interchange,
BE IT FURTHER RESOLVED that a certified copy of this Resolution be
forwarded to the State Road Department, Fort Lauderdale, Florida.
County Engineer Schmuck.er informed the Board that it
was necesoary to adopt a revioed contract with the State Road
Department of Florida regardin State Road #510.
On motion of Commissioner Wide. • , seconded by Cox i.ssioner /J!irP el
the following resolution was adopted:
WHEREAS, the State Road Department of Florida has authorized and requested
INDIAN RIVER. County to furnish the necessary rights of wady, borrow pits and ease-
ments for that portion of Section 88050, State ,Road 510, extending from State
Road 5 in Wabasao Northeasterly across Indian River to State Road A1A,
whi^.h hAo been surveyed and located by the State Road Department as shown by a map.
on file in the office of the Clerk of the Circuit Court of said County, and in the •
office of the said :apartment at Tallahassee, and
WHEREAS, the said Department will not Begin construction of said portion of
said Section in said County until title to all land necessary for said portion of
said Section has been conveyed to or vested in said State by said County, and said
lands are physically cleared of all occupants, tenants, fences, buildings and/or
other structures and improvements upon or encroaching within the limits of the land
required for'said portion of said Section; and
WHEREAS, the said County is financially unable at this time to provide the
necessary funds to acquire said rights of way, borrow pits and easements; now there-
fore, be it
RESOLVED, that the State Road Department of Florida be and it is hereby re-
quested ;,e pay for the rights of way, borrow pits and easements for said road, in-
cludir.g the removal of buildings, fences and other structures and improvements there-
on, and for other expenses of acquiring title to said rights of way, borrot- pits and
easements by purchase or condemnation, from proceeds of Florida State Development
Commission bonds or secondary gasoline tax funds (Section 16, Article IX, of the
Florida Constitution, Chapter 26321, Laws of Florida, Extraordinary Session, 1949),
whichever is available, under conditions set forth in the contract, of whichthis
resolution forms a part; and be it further
RESOLVED, that said County, through its Board of County Commissioners, comply
with the request of said Department and procure, convey or vest in said State the
free, clear and unencumbered title to all lands necessary for said portion of said
Section, and deliver to the State Road Department said lands physically clear of all
occupants, tneants,, fences, buildings and/or other structures and improvements situate
upon or encroaching within the limits of the lands required for said portion of said
Section and that the Chariman and the Clerk of this Board be and they are hereby
authorized and directed to execute and deliver on behalf of said County to said
Department the Contract in the form hereto attached; and be it further
RESOLVED, that the attorney for this Board be, and he is hereby authorized
and directed to proceed to take the necessary steps for the County to acquire in the
name of said County by donation, purchase, or condemnation said rights of way, borrow.
pits and easements for said portion of said Section, and to prepare in the name of
said County by its County Commissioners all condemnation papers, affidavits and
pleadings, and prosecute all condemnation proceedings to judgment; end furnish to the
Department the abstract search provided for in said Contract.

County Engineer Schmucker reported that the windshield
of an Automobile owned by Denver Calloway of the Tax Collectors
Office had been broken by t falling Palm Frond while the• car
was parked on County•property.next to the Courthouse and
stated that the accident was not covered by theCounty's
Liability Policy. On advice of Counsel no further action
was taken.
On motion made by Commissioner Waddell, seconded by
Commissioner Haffield, it was unanimously voted to approve
the transfer of the Beer and Wine License from the Former
owner to the Present.owner of the Beachwood Super Larket on
Old Dixie Highway in as much as this License conforms to
County Zoning requirements.
On motion made by. Commissioner Waddell, seconded by
Commissioner Haffield, it was unanimously voted to hold a
hearing on January 19, 1966 at 9:00 o'clock A. Y., in the
County Commissioners Room with regard to proposed zoning
changes on a parcel of land North of North }linter 'Beach Road
on the Viest shore of the Indian River.
