MODIFICATION # 3 TO GRANT AGREEMENT BETWEEN THE DEPARTMENT OF COMMUNITY AFFAIRS AND INDIAN RIVER COUNTY This Modification is made and entered into by and between the State of Florida , Department of Community Affairs , ("the Department') , and Indian River County , (" Recipient') , to modify DCA Contract Number 06DB-3C- 10-40-01 -W 14 , award dated August 20, 2005 , ("the Agreement') . WHEREAS , the Department and the Recipient entered into the Agreement, pursuant to which the Department provided a grant of $ 7 , 500 , 000 . 00 to the Recipient under the Small Cities Community Development Block Grant (" CDBG " ) Program as set forth in the Agreement; and WHEREAS , the Recipient has requested an extension to the period of the Agreement, and WHEREAS , the Department and the Recipient desire to modify the Agreement by modifying the Attachment B , Activity Work Plan section thereunder; NOW, THEREFORE , in consideration of the mutual promises of the parties contained herein , the parties agree as follows: c 1 . Paragraph 3 of the Agreement is hereby revised to reflect an ending date of G February 19 , 2008 C`: rn 2 . The Attachment B , Activity Work Plan section of the Agreement is hereby deletWanr 4 replaced by the revised Attachment B , Activity Work Plan , which is attached he ar incorporated herein by reference . All provisions of the Agreement and any attachments thereto in conflict with this Modification shall be and are hereby changed to conform to this Modification , effective as of the date of the last execution of this Modification by both parties . 4 . All provisions not in conflict with this Modification remain in full force and effect, and are to be performed at the level specified in the Agreement. Austin. Please consider this as a request for an amendment for the above referenced Grant contract between the Florida Department of Community Affairs and Indian River County (Amendment #3) . The amendment is for a six (6) month time extension to more accurately reflect the pace of the county - s four approved projects . Those projects are : • Fire Station 44 (Oslo Road) • Wabasso Water Phase I ■ Wabasso Water Phase 11 • Rockridge Sewer The County is approximately ninety- five (95 %) complete with both the Oslo fire station replacement project and Phase I of the West Wabasso water system extension project. The Rockridge Sewer project, however, has been delayed due to circumstances beyond the County' s control, and Phase II of the Wabasso 1k ater project was only recently added to the CDBG DRI contract as a new activity . The Rockridge Sewer project is funded jointly by the Community Development Block Grant (CDBG) Disaster Recovery Initiative (DRI) program and the FEMA Hazard Mitigation Grant Program (IIMGP) The major reason for the Rockridge Sewer system delay has been the HMGP . As of this time, the County has been unsuccessful in obtaining permission from the ate Division of Emergeney Management (DEM) and FEMA to begin carrying out both the design phase and the construction phase of the Rockridge Sewer project In fact, the County, recent requested assistance from the CDBG management group to help expedite approval of prel*ct d by the HMGP management team . At this time, the County is moving forward with the project while simultaneously seeking AEA ' assistance in resolving the HMGP issues . To that end, the Rockridge Sewer project has ben bi� a contractor has been selected, and the County is ready to begin construction of the projeZ In addition, the County recently received DCA ' s approval to purchase a vacuum central sewer system for the Rockridge project from a sole source vender. A purchase order has now been issued for the equipment. With respect to Phase II of the West Wabasso Water project , plans and specifications were recently sent to the Department of Community Affairs for approval, and the County is soliciting for contractors to construct the project . After bids are received and Amendment #3 for the above referenced project is approved by DCA , the County will request DCA ' s approval of the low bidder and subsequently enter into a construction contract for this activity. In summary, the County is requesting an additional six (6) months to complete the construction of the DRI projects referenced above due to the expansion of the West Wabasso water line project and unforeseen delays with the Rockridge Sanitary Sewer project.
