The Board of County Commissioners of Indian River County met
in regular session at the Courthouse, Vero Beach, Florida, on Wed-
nesday, May 11, 1966, at 8:30 o'clock A. M. Present were Robert
W. Graves, Chairman, D. B. McCullets, Jr,,Jerre J. Haffield, Donald
Macdonald and Dr. B. Q. Waddell. Also present were John H. Sutherland,
County Attorney, Edwin S. Schmucker, County Engineer, and Alfred H.
Webber and Ruth Elliott, Deputy Clerks.
The Chairman asked if there were any corrections or additions
to the minutes of April 6 and April 20, 1966. There were none
and on Motion by Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried, that the minutes be approved as
written.
Mrs. Gladys Vigliano, County Welfare Worker, presented her report
for the month of April and same was placed on file. Mrs. Vigliano
requested permission to attend a special meeting of the Florida
Association of County Welfare Executives to be held in Clearwater
on May 12, 1966. On Motion by Commissioner McCullers, seconded by
Commissioner Hatfield, and unanimously carried, the request was granted.
Mr. Homer C. Fletcher, Tax Assessor, stated to the Board that the
shutdown of the Fellsmere Sugar Mill would have a great impact on the
economy of the City of Fellsmere and that interested citizens were
seeking some means to return to the active land market, lands which
reverted to the State of Florida under the Murphy Act. These lands
have not contributed anything to the tax economy of the County, State
City of Fellsmere or Fellsmere Drainage District for over thirty-five
years, Mr. Fletcher read a letter he had written to the Comptroller
and also the Comptroller's recommendation that proper resolutions be
adopted by governmental agencies requesting the Florida Development
Commission to conduct a seminar to deal with this particular problem.
Mr. Joe Bussey and lr. Gilbert m h of the City of Fellsmere were
present and requested that the Board adopt such a resolution.

On Motion by Commissioner Waddell, seconded by Commissioner
Macdonald, the following Resolution was unanimously adopted:
RESOLUTION
NO. 66-21
WHEREAS, the City of Fellsmere has a number of real properties

located within the municipal limits which have reverted to the State
of Florida under the Murphy Act; and
WHEREAS, on said real properties there are presently unpaid
taxes outstanding to the Fellsmere Drainage District and the City
of Fellsmere; and
WHEREAS, on a public bid, as is required by the Trustees of
the Internal Improvement Fund, it is practically impossible to sell
these real properties on today's market; and
WHEREAS, because of the unexpected shutdown of the Okeelanta
Sugar Mill, a major source of income and employment to the citizens
of the City of Fellsmere has been eliminated; and
WHEREAS, the City Council of the City of Fellsmere is attempting
tofind means how these real properties can be sold in a practical
manner and is anxious to have assistance from various state agencies
in an effort to re -vitalize the economy of the community;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Indian River County, Florida, in regular session, this the llth
day of May, A. D. 1966, as follows:
1. The Board of County Commissioners of Indian River County,
Florida, solicits advice, help and suggestions in any way possible,
and as quickly as possible, from state agencies, particularly the
Comptroller and the Florida Development Commission, and other local
governmental agencies, with regard to the aforesaid matters.
2. The Board of County Commissioners of\Indian River County,
Florida, is prepared to meet with officials of state and local govern-
mental agencies at any time convenient to each such agency to present
their problems in detailed form.

3. The Board of County Commissioners of Indian River County,
Florida, requests meetings with state and local governmental agencies,
particularly the Comptroller, the Florida Development Commission, and
other governmental agencies, in an effort to find ways and means to
remedy the situation of the City of Fellsmere, Florida.
BE IT FURTHER RESOLVED that copies of this Resolution be for-
warded to the City of Fellsmere, the Fellsmere Drainage District,
the Comptroller of the State of Florida, and the Florida Development
Commission.

A number of residents of Whispering Palms Subdivision, including
Mr. Joseph Pappace, Mr. North, Mr. Minor and Mr. Odom, appeared before
the Board and stated their objections to the proximity of the dumping
operation of the Oslo Dump to their homes. After hearing the complaints,
Commissioner Waddell moved, seconded by Commissioner McCullers and
unanimously carried, that the Engineer be instructed to start landfill
operation on the west side of the County property so that the natural
stand of trees now there will be between the landfill operation
and Whispering Palms Subdivision. The Engineer was also requested to
plant a strip of Eucalpytus trees on the east side of the property to
act as a buffer.
Mr. E. S. Sweeten and Mr. Bill Roberson of the Florida Forest
Service presented a prepared lease for the Dale Wimbrow Park camping
facilities for'the Board to review.
Mr. Richard Saccardi of the Rockridge Property Owners Association
inquired about several problems that he had previously brought to the
attention of the Board. Commissioner Waddell reported that the Humane
Society is presently in no position to handle the dog situation and
that the Sheriff is compiling information from St-. Lucie County which
he will present at a later date. The County Engineer and the Board
viewed a profile of the drainage problem between 4th Court and 4th
Avenue and the Engineer was requested to enlarge the grate, if possible,
and put in an asphalt swale ditch behind the curb. The Engineer
assured Mr. Saccardi that the potholes in the street would be patched
as soon as possible.

that the Board of County Commis-
sioners of Indian River County,
Florida, will receive sealed bids at
the hour of 9:00 A. M. Wednesday,
May 11, 1986, and at said time pub-
licly open the same at the meeting
of said Board to be held in the
County Commissioners' Room, In-
dian River County Courthouse, Vero
Beach, Florida, for sale by the
County of one (1) wood frame house,
approximately 800 sq. ft. located
on Lots 20 and 21, Block 35, Original'
Town of Vero, -now City of Vero
Beach, Florida.
The house must be salvaged or
moved intact as the successful
bidder may desire from its location
within 60 days after bid is ac-
cepted.
The successful bidder shall be re-

April 21, 28, 1966.
The Chairman called for bids on the above Notice and no bids were
received. Commissioner Waddell moved, seconded by Commissioner Mc -
Cullers and unanimously carried, that the building be re -advertised
with site clearance but not removal of the concrete floor.
Commissioner Macdonald and Mrs® McMechan,representing the Wabasso
Civic Clubtreported that there have been complaints about the conditions
at the Wabasso Beach Park. Mr. and Mrs. Dillard,,sub-lessees, were
also present and stated that Mr. Paul Engler, of Chicago, is interested
in leasing the property but has requested a ten-year lease. The County
Engineer reported that he has also received a letter from Mr. Engler in
which he describes what he plans to do with the property. The matter
was turned over to the County Attorney and CommissionerMatdonald for
further study and the County Attorney was requested to prepare a
proposed lease.

Mr. William G. Taylor, Architect.,. presented sketches of the
proposed Courthouse annex. It was the opinion of the Board that
the sketches were very satisfactory.
John Charles Mitchell, Attorney for the Board of Trustees of
Indian River Memorial Hospital, requested the concurrence of the.
Board of County Commissioners in the redemption of $10,000 of hospital
bonds issued in 1959 as recommended by the auditors of the Trustees.
Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried that the request be approved, subject
to the limitation that the Board of Trustees does not borrow short
term operating money during the next year at an interest rate greater
than 4%.
David Wells, a student, appeared before the Board and requested
that he be issued a permit to carry a pistol. Mr. Wells was informed
that the Board':did not _feel tthat'`_he had presented sufficient reasons
to enable them to issue him a pistol permit and on Motion by Commissioner
McCullers, seconded by Commissioner Macdonald, and unanimously carried,
the request was denied.
Mr. Russell Burks requested the Board's approval of an extension
of the boundaries of his water and sewer franchise in the Gifford area.
He was informed that a petition should be filed and then the Board
will hold a public hearing on the matter.
The County Engineer presented and discussed the alignment of the
proposed Indian River Boulevard. A letter of objection was filed
from Maurice W. Provost, Director of the Entomological Research 'Center,
regarding the alignment at Oslo Road juncture as it affects State
interests. The, Courzty__Engineer Will get the approval of the City of
Vero Beach and the Indian River Farms Drainage District on the project.
Attorney John R. Gould presented the following Memorandum and
on Motion by Commissioner Waddell, seconded by Commissioner McCullers,
the following Resolution was unanimously adopted:

re: Erdle & Wilder Aircraft, Inc., in its own behalf and in behalf
of Peerless Insurance Company, v. Spillman, Board of County
Commissioners and Tuerk.
This is the suit which involves the destruction of the airplane
which Bob Spillman was flying at the time of his death. I have
discussed the case with most of you and the following is a brief
resum6 of the facts, the law and my opinion.
The suit is to recover damages for the breach of a bailment con-
tract. A bailment is the use by one person of another person's
tangible personal property (such as an automobile, an airplane, etc.).
The owner of the property is known as the "bailor" and the user of
the property is known as the "bailee". All that the bailor has to
prove is that the airplane was in good condition when it was de-
livered to the bailee and that it was either returned in a damaged
condition or not returned at all. At that point the burden of proof
shifts to the bailee who must prove that the airplane was carefully
and non -negligently operated and that its damage or destruction was
not caused by the carelessness or negligence of the bailee.
In my opinion, there is no evidence at all by which Indian
River County could sustain its burden of proof and I feel that
whatever Judge tried this case would be required to direct a
verdict for the plaintiff at the conclusion of the trial.
The original case sought damages of $16,885.00 which has been
reduced to $12,885.00 because a co-defendant, The Indian River Citrus
Bank, paid $4,000.00 to be released from the suit. The plaintiff
has offered to release Indian River County from the suit for the
same amount of money and, for the reasons stated above, I recommend
that you accept this offer.
If you choose to accept my recommendation, I suggest that this

RESOLUTION
NO. 66-22
WHEREAS, there is pending in the Circuit Court of the
Ninth Judicial Circuit of Florida in and for Indian River County,
case number 70, entitled Erdle & Wilder Aircraft, Inc., in its
own behalf and in behalf of Peerless Insurance Company, Plaintiff,
vs. Indian River County, a political subdivision of the State of
Florida, et al., Defendants, wherein the Plaintiff is seeking
damages in the sum of $16,885.00 from Defendants for the destruction
of an airplane owned by Erdle & Wilder Aircraft, Inc,, and insured
by Peerless Insurance Company and operated by one Robert Spillman
at the time of its destruction; and,
WHEREAS, another Defendant in said case has paid $4,000.00
to Plaintiff for a stipulation dismissing it as a Defendant in the
case, thereby leaving the sum of $12,885.00 actually in controversy;
and,
WHEREAS, Plaintiff has offered to settle said case against
Indian River County and to stipulate for the dismissal of Indian
River County as a Defendant in said case for the sum of $4,000.00;
and,
WHEREAS, Gould, Cooksey & Fennell, attorneys employed by
Indian River County to defend it in said case, have advised the
Board of County Commissioners that, in their opinion, said settle-
ment offer should be accepted, a copy of said law firmts opinion
being included in these minutes, NOW, THEREFORE:
BE IT RESOLVED by the Board of County Commissioners of Indian
River County, Florida, that Indian River County accept the offer of
Erdle & Wilder Aircraft, Inc., in its own behalf and in behalf of
Peerless Insurance Company, to settle said case against Indian
River County for the sum of $4,000.00;

Resolution No. 1827 adopted by the Vero Beach City Council per-
taining to municipal road tax was received and ordered incorporated
in the minutes of this Board as follows:

WHEREAS, the Board of County Commissioners of Indian
River County is authorized, under the provisions of Section
'336.59 of the Florida Statutes, to levy an -annual tax for road.
and bridge purposes; and
WHEREAS, under the provisions of,said Section 336.59 of
the Florida Statutes, it is provided that one-half of the
amount realized from such special tax on property within. the
.City Limits of Vero Beach shall be turned over to said City to
be used solely for, the purpose of maintaining and repairing
the roads and streets of said City; and.
WHEREAS, the Board of County Commissioners of Indian
River County, Florida' has submitted to the City Council of the
City of Vero Beach, an accounting for the taxes collected
within the City Limits of the City of Vero Beach, from October
1, 1963 to September 30, 1965, under the provisions of Section

.May 9, 1966
We hereby submit for your approval a suggested list of roads
for our proposed $500,000 loan under the Secondary Trust Fund.
It is our understanding that this program must be approved for,
alignment, right of way width and estimated costs.
1. The purchase of 80' of rights of way for the Wabasso
Bridge approach from U. S. #1 to the West Shore of
the Indian River, an approximate distance of 0.5 mile
at an approximate cost of $50,000. The alignment of
this project has been approved by the State Road
Department.
2.. The purchase of a minimum of 60' of rights of way for
the Old Dixie Highway from 19th Street to 14th Avenue
and 80' of rights of way from 14th Avenue to Glendale
Road, SR 612, a distance of 1.5 miles at an approximate
cost of $40,000. The centerline of this project atthe
north end has been approved by the Board of County
Commissioners and the Vero Beach City Council. Tentative
approval has been given to construct a drainage ditch for
this project which will; empty into the Indian River Farms
Drainage District canal. This proposed project is a
municipal type section from 19th Street to 14th Avenue.
The remaining portion to be a 24' pavement with open
Swale ditches with perhaps right and left turn lanes at a
few intersections.
3. The purchaseof variable widths of rights of way for Route
60, from the Florida East Coast Railway to the proposed

1-95, a distance of 7.5 miles at an approximate cost of
$140,000.
... The purchase of 80' of rights of way and the construction
of 27th Avenue (Emerson) SR 607, from Route 60 to the
South Relief canal, a distance of approximately 2.75 miles
at an approximate cost of $140,000. The construction
shall be a two foot wide strip on either side of the
existing pavement with_ a 24 foot wide asphalt cap and the
creation of right and left turn lanes at 1 mile intervals.
Note: A new school will be built at the Southwest corner
of Citrus Road and Emerson Avenue.
The purchase of 80' of rights of way and the re -construction
of 43rd Avenue (Clemanns) SR 611, from Route 60 to Citrus
Road, a distance of 2.0 miles at an approximate cost of
$130,000. This shall be the complete re -construction of the
road to provide an adequate base 24 feet wide and the
addition of right and left turn lanes at 1 mile intervals.
There should be a municipal type section construction for
.the first 350 feet south of Route 60 to preserve some parking.

Motion was made by Commissioner Waddell that the Clerk, on behalf
of the Board, write a letter of congratulations to the Volunteer Ambulance
Squad on their successful operation of the service. Motion was seconded
by Commissioner Macdonald and unanimously carried.
Commissioner Waddell moved, seconded by Commissioner McCullers and
unanimously carried, that Mr. Jack Jennings be employed to serve as
Administrator to the Board during the interim when Mr. Edwin Schmucker
is on leave of absence, at an annual salary of $10,000.
On Motion by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, the County Engineer was authorized
to have a street light installed at the intersection of Glendale
Road and Kings Highway.
On Motion by Commissioner Macdonald, seconded by Commissioner
Waddell, the Engineer was authorized to make application to the Corps
of Engineers for the causeway at Round Island.
Motion was made by Commissioner Macdonald, seconded by Commissioner
McCullers that the Engineer be authorized to advertise for the necessary
plumbing in the restroom facilities and a 4" flow well for Sebastian
Inlet Park and for steel forms to build the Clemman Avenue Bridge.
The Board discussed the county road program and the following
is a revised list of Road Construction Priority:
A. Oslo Road from Rangeline to Ranch Road.
B. Glendale Road from Kings Highway to Monroe Road
C. 50th Avenue from Route 60 to Walker Avenue
D. County Jail Driveway
1. 6th Avenue from 10th Street to U.S.#1 and 10th Street from
6th Avenue to U. S. 1
2. North Winter Beach Road from Lateral A to Rangeline Road
3. Clemmans Avenue from Route 60 to North c ford Road

4. Old Dixie & Oslo Road(Double curve) This is a state contract,
acquisition of right-of-way only.
5. Church Street in Wabasso- Engineer to scarify existing road
and sand seal.
6. Manatee Street from Roseland Road to Bay Street
7. Oslo Road from Ranch Road to 90th Avenue.
The County Engineer asked if a lifeguard should be hired for
Round Island Park. It was the opinion of the Board that it was not
necessary at the present time.
The Board authorized the County Engineer to build a marl road to
the ocean at Round Island Park for boat launching and also to request
Rural Sanitation Service for garbage collection, twice weekly, at
Round Island Park.
The Engineer presented a profile of 50th Avenue in::•Lake:.Park
Subdivision and suggested three or four side lot easements, --10' wide,
and a 25' rear easement for a ditch on the west side.
On. Motion by Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried, the County Engineer was authorized
to instruct the Port -o -Let Company to install two (2) additional units,
as they recommended, for approximately four months. These are to be
placed further down in the park until such time as permanent restrooms
are constructed.
The Board discussed the acquisition of right-of-way for the
construction of the bridge across the fork of the Sebastian River on
SR 512. The Board will make further contacts with property owners.
Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, that Mr. Kenneth Damerow be employed
to make a boundary survey check at the Sebastian Inlet Park.
On Motion by Commissioner.Macdonald, seconded by Commissioner
McCullers and carried, Commissioner Waddell and the County Engineer
were authorized to attend a Regional Planning Council meeting in.

carried, that the Beverage Department be notified that the application
for a beer and wine, consumption on premises, license for Gina°a
Restaurant does conform to the zoning regulations of the County.
The County Engineer presented to the Board specifications for
a tractor truck as recommended by a truck expert and on Motion by
Commissioner Waddell, seconded by Commissioner Macdonald and carried,
the Engineer was authorized to re -advertise for bids.
On Motion by Commissioner Waddell, seconded by Commissioner
McCullers and unanimously carried, the following right-of-way agreement
for Clemman Avenue, South of Walker Avenue, between W. A. Garrison and
Macie L. Garrison, his wife, was approved:
The West 18 feet of the East 43 feet of the East
10 acres of Tract 1, Section 4, Township 33 South,
Range 39 East.
The County will extend the existing 20 foot culvert
under the existing access to the above described
property, 10 feet to the West and construct head-
walls of cement and sand filled bags at both East
and West ends of the 30 feet of culvert, then fill
and grade to a finished driveway from Walker Avenue to
the West right of way line of the Indian River Farms
Drainage District ditch.
The County Engineer suggested that the Board will probably have
to adopt some regulation along the west shore of the river in the
Sebastian area as more submerged land applications are made in order
to standardize the method of submerged land applications. No action,
was taken.
The Engineer presented a profile of Eucalyptus Place Subdivision
and explained the drainage problem. No action was taken.
Commissioner Waddell moved, seconded by Commissioner McCullers and
unanimously carried, that the City of Vero Beach be reimbursed
$30,000.00, subsequent to the request of the following Resolution
adopted by the City Council of the City of Vero Beach:

WHEREAS, the City Council of the City of Vero Beach has
recognized the necessity for providing recreational facilities
for the happiness and well-being of the citizens of said city
entertainment
for the tourists who visit this section, and also to enable the
youth of the community and county to have constructive outlets
for their leisure hours, and
WHEREAS, during the past recent months the City of Vero
Beach has expended, on recreational facilities, the sum of
approximately $40,000.00, which consists of the installation
of additional soft-ball,fields, the construction and installa-
tion of additional shuffle -board courts, the necessary grading,
and drainage and placing of field lights upon said ball fields '
and of Indian River County4 as well as to provide

WHEREAS, all of these
been so recently installed
recreational facilities that have
by the City of Vero Beach, and at
the expense of the taxpayers thereof, as
well as.the other
recreational facilities of the City are available and are in
daily use by the citizens of Indian River County in general,

WHEREAS the City of Vero Beach, in addition to the large
sums expended in the construction of the recreational facilities
herein described, also defraysthe.cost of maintenance, super-
vision and operation of said recreational facilities, which
entails great expense upon the taxpayers; of the City of Vero
Beach
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
