Order Provision
Dear Stephanie:
To effectuate the relocation of the frequency or frequencies licensed to the Incumbent
pursuant to the Frequency Reconfiguration Agreement (FRA) dated December 4 , 2007,
this letter serves as the official request (Change Notice) for the exercise of the FRA
change order (Change Order) provision, as required by the FRA .
On the original Inventory the radios and accessories listed on the attached EOWs were
not captured.
Please analyze the information provided here and contact Melanie Keegan at Shulman
Rogers to discuss how we will proceed.

SUBJECT: Request for Exercise of Frequency Reconfiguration Agreement
Change Order Provision
On December 4, 2007, the Board of County Commissioners approved a Frequency Reconfiguration
Agreement between Indian River County and Nextel South Corporation for radio rebanding. As a
part of the process Indian River County must authorize payment from Nextel to Shulman, Rogers,
Gandal, Pordy & Ecker, PA (Indian River County outside council) for services provided during the
rebanding process.
Attached is a Request for Exercise of Frequency Reconfiguration Agreement Change Order Provision
for services provided to this point in the process. This is a change order to the original Incumbent
Acknowledgment submitted for approval July, 10, 2008.
On May 13, 2008 , the BCC approved an agenda item that authorized the Chairman of the Board to
execute any future agreements for completion of the project..
RECOMMENDATION:
Staff recommends approval of the Incumbent Acknowledgement and authorization that goods and
services identified on the invoice have been performed.

Request for Exercise of Frequency Reconfiguration Agreement Change
Order Provision
Dear Stephanie :
Per Melanie Keegan' s conversation with Bill Towse, to effectuate the relocation of the
frequency or frequencies licensed to the Incumbent pursuant to the Frequency
Reconfiguration Agreement (FRA) dated December 4, 2007, this letter serves as the
official AMENDED request (Change Notice) for the exercise of the FRA change order
(Change Order) provision, as required by the FRA.
In order to complete the relocation contemplated by the FRA, Shulman Rogers
Gandal Pordy & Ecker incurred additional costs beyond what was estimated in the
original contract on legal advice, meetings, correspondence, filings, and other document
preparation. These costs amount to over $24,000.00. As such, we are requesting the
following changes to the work currently encompassed by the cost estimate (Cost
Estimate) itemized at Schedule C of the FRA:
