Home My WebLink About2009-211 a /11 / AMENDMENT 5 FINAL DESIGN AND PLANS PREPARATION FOR CR 510 from CR 512 to east of 75"' Court This is an amendment to the existing Final Design and Plans Preparation services agreement (AGREEMENT) , dated November 17 , 2005 , by and between INDIAN RIVER COUNTY , hereinafter referred to as the COUNTY , and STANLEY CONSULTANTS , INC . , hereinafter referred to as the ENGINEER. This amendment addresses changes in Section III — Scope of Services, Section IV — Time for Completion , and Section V - Compensation" of the AGREEMENT . Amendment Description SECTION I - not applicable SECTION II — not applicable SECTION III - SCOPE OF SERVICES is being modified to incorporate the following : The ENGINEER and Betsy Lindsay, Inc agree to perform professional roadway design and related survey services in connection with the project as required and set forth in the following : A . SURVEY (Betsy Lindsay, Inc . ) The right of way file prepared by Burdette and Associates will be the basis for all survey work performed in this scope of work . All Burdette and Associates work will be accepted as correct. One day of survey work will be completed to randomly sample the Burdette work . The scope does not include field survey to support the preparation of any sketch and legal descriptions, or Temporary Construction Easement (TCE) sketches . 1 . Prepare Temporary Construction Easement (TCE) exhibit sketches Prepare a sketch illustrating each temporary construction easement . The sketch will illustrate the proposed right of way, the baseline of survey, and the TCE with dimensions . There are approximately ten TCE ' s requiring separate sketches . Each sketch will be prepared at a lump-sum cost of $ 110 per sketch . The remaining TCE ' s will be illustrated on the sketch and legal descriptions for additional right-of--way acquisition to be prepared by Betsy Lindsay, Inc . 2 , Prepare Legal Descriptions and Sketches Prepare a sketch and legal description for each parcel to be acquired as right-of-way and drainage ponds , and prepare sketch and legal descriptions for drainage easements and access easements . There are fifteen right-of-way acquisition parcels, two drainage pond sites , nine drainage easements , and two access easements . All TCE ' s adjoining the descriptions being prepared will be illustrated with dimensions . No legal description will be prepared for the TCE ' s . The fee for each sketch and legal description will be a lump-sum fee of $400 . 00 per legal description . (9 parcels along CR 510 + 5 parcels along 89"' Street + 1 parcel for canal realignment + 2 ponds + 9 Drainage Easements + 2 access easements = 28 total sketch and legal descriptions .) Please note that each sketch and legal description will be prepared one time based on the information supplied . If there is a change in ownership , or the size, shape or location of any parcel, additional fees will be required . We will submit each sketch and legal description in a dwf format for review . Any review comments will be addressed, and the final deliverable of the legal sketches and descriptions will be two signed and sealed copies , one PDF and the AutoCAD file . 3 . Finalize Right-of-Wasps Finalize the right of way maps based on the Burdette and Associates Microstation CAD files on an hourly basis not to exceed $4 , 300 . The right of way map will be submitted in a dwf format for review . CR 510 Amendment 5 Pagel of 4 8/3 /2009 The final deliverable will be one set of Mylars , a PDF and the CADD file . 4 . Locate Wetland Flays Locate wetland flags for up to 4, 000 lineal feet of wetlands . This task should be done within fifty hours by a two- man field crew. The wetland lines will be input into Microstation and a CADD file and surveyors report will be furnished to the ENGINEER . One day of a GPS field crew will be allocated to locate a random selection of Burdette control points and found monuments . This item will be billed on an hourly basis not to exceed $ 8 , 200 . 5 . Review Title Information Review the title information for three parcels . Modify the map to reflect the title information . This item will be billed on an hourly basis not to exceed $ 800 . 6 . Deliverables The final deliverables include two copies of the signed and sealed legal sketches and descriptions, one PDF and the AutoCAD file of the legal sketches and descriptions (delivered to the COUNTY) . A Microstation electronic file will be delivered to the ENGINEER illustrating the completed right-of- way map . Be ROADWAY DESIGN ( Stanley Consultants , Inc . ) Roadway design services will include updating the four roadway plan and profile sheets , four roadway cross section sheets, two signing and pavement marking sheets, quantities and cost estimates for the following tasks : 1 . Eliminate full median opening and left turn lanes between Station 127+00 and Station 135 +50 . 2 . Design full median opening for Sebastian Park PUD between Station 131 +00 and Station 139+20 , 3 . Redesign stormwater management system within Basin 5 to conform to geometric revisions between Stations 127 +00 and 139+20 . 4 . Eliminate right turn lane and entrance side street at Station 179+50 . 5 . Design left turn lane between Station 180+00 and Station 183 + 50 . 6 . Redesign stormwater management system within Basin 7 to conform to geometric revisions between Stations 179+ 50 and 183 +50 . C . SIGNING AND PAVEMENT MARKING PLANS (Stanley Consultants, Inc . ) Signing and pavement marking plans will include the following tasks : 1 . Redesign the signing and pavement markings between Station 127 +00 and Station 139+20 . 2 . Redesign the signing and pavement markings between Station 179+ 50 and Station 183 + 50 . SECTION IV — TIME FOR COMPLETION Submittal Dates The final right-of--way mapping and legal descriptions and sketch deliverables shall be completed within six weeks after notice to proceed . The wetland delineation reports shall be completed three CR 510 Amendment 5 Page 2 of 4 8/3 /2009 weeks after the wetland flags are located in the field . SECTION V - COMPENSATION The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered pursuant to this Agreement fees in accordance with the following : A . SECTION VI to XVII - not applicable CR 510 Amendment 5 Page 3 of 4 8/3 /2009 SECTION XVIII - ENTIRETY OF AGREEMENT This writing embodies the entire AGREEMENT and understanding between the parties hereto , and there are no other agreements and understandings, oral or written , with reference to the subject matter hereof that are not merged herein and superseded hereby . No alteration, change , or modification of the terms of this Agreement shall be valid unless made in writing and signed by both parties hereto . This AGREEMENT, regardless of where executed , shall be governed by and construed according to the laws of the State of Florida.
