The Board of County Commissioners of Indian River County met in
regular session at the Courthouse, Vero Beach, Florida, on Wednesday,
June 22, 1966, at 8:30 o'clock A. M. Present were Robert W. Graves,
Chairman, Donald Macdonald, Jerre J. Haffield, and Dr. B. Q. Waddell.
Absent was D. B. McCullers, Jr., Also present were John H. Sutherland,
County Attorney, Edwin S. Schmucker, County Engineer, and Alfred H.
Webber and Ruth Elliott, Deputy Clerks.
Motion was made by Commissioner Waddell, seconded by Commissioner
Haffield and unanimously carried that a public hearing be set for
Wednesday, the 10th day of August, 1966 at 8:30 o'clock A. M., to
consider the extension of the sewer and water franchise held by
Russell Burks; and, that the local health department be requdsted to
submit a written report prior to the public hearing on the operation
of the sewer plant.
On Motion by Commissioner Haffield, seconded by Commissioner
Waddell and unanimously carried, the Bond of Roland B. Miller, as
principal and the Fidelity & Casualty Company of New York as surety,
in the amount of $5,000.00 was approved. Mr. Miller was appointed
by the Governor as a member of the Board of Trustees of the Indian
River County Hospital District to hold office from the date of June 16,
1966 to January 3, 1967.
The Engineer stated that he had received a proposal from Mr. Bud
Jenkins for the County to use his marl pit as a stump dump. The Board
suggested that Mr. Jenkins present his proposal to the City Council of
Vero Beach since the County does not have an immediate need for a stump
dump.

The Chairman read the foregoing Notice and bids were received
and opened as follows: Ace Concrete Service, $1,500.00. On Motion
by Commissioner Macdonald, seconded by Commissioner Waddell and un-
animously carried, and upon the recommendation of the County Engineer,
the bid received was accepted.
The County Engineer reported that he received a letter from
Attorney John Gould recommending that the performance bond on Vero
Beach Highlands Unit 2 be extended only if General Development Corp-
oration and the surety will consent to let the bond be amended so as
to specify the manner in which the work is to be done. Mr. Gould also
pointed out that the surety, Continental Casualty Company, is also the
surety on the Vero Beach Development, Inc., bond which pertains to Vero
Tropical Gardens and is involved in litigation at the present time.
Commissioner Waddell moved that General Development Corporation be
notified that Continental Casualty Company is not acceptable as a
surety and that specific plans by which the work is to be done must
be written into the bond. The Motion was seconded by Commissioner

Haffield and unanimously carried.
The County Engineer reported that he has received another letter
from Trustees of Internal Improvement Fund stating that the Outdoor
Recreational Planning Committee has recommended dedication of the
503.46 acres of land located Southwest of Wabasso, (Hobart land)
to Indian River County for outdoor recreational purposes but it will
be necessary to have from the County a tentative plan of development
before the Staff can recommend to the Trustees the dedication as
requested. The Board discussed several possibilities for development,
including picnic area, nature paths, bridle paths and stocking existing
lake with fish through the Department of Conservation. Commissioner
Waddell moved, seconded by Commissioner Macdonald and unanimously
carried, that the Engineer send the Trustees a tentative plan of
development which includes picnic area, nature paths, bridle paths,
fishing area, spread over a period of five (5) years and that an amount
be set up in the budget each year to finance the project.
On Motion by 'C aissioner Waddell, seconded by Commissioner
Haffield and carried, the Engineer was authorized to advertise for yearly
bids for materials to be opened August 17, 1966.
On Motion by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, the Board approved the County Engineer'
travel expenses to Titusville on June 15 to attend a meeting of the
East Central Florida Regional Planning Council; and alsoauthorized
him to go to Miami and Orlando to see trucks on specifications.
The County Engineer reported that he had an application for a
beer, consumption on premises license, for Kitty's Restaurant on 84th
Street which is 2100 feet from the Baptist Church. Commissioner Waddell
moved, seconded by Commissioner Haffield and unanimously carried, that
the Beverage Department be notified that the application does not con-
form to the zoning regulations of the County.

T -e Chairman asked if anyone present wished to be heard on the
foregoing Notice of Public Hearing. There being no one present, on
Motion by Commissioner Waddell, seconded by Commissioner Macdonald,
the following Resolution was unanimously adopted:

WHEREAS, THE Zoning Commission of Indian River County, Florida,
did after public hearing make its final report recommending changes
and additions to the Zoning Resolution of Indian River County, Florida;

WHEREAS, this Board did publish its notice of said recommended

Mr. Webber presented a proposal from Mr. Hoyt C. Murphy, Realtor,
for the sale of a small tract adjoining Round Island Park for $180
per front foot. The letter was received, placed on file and the matter
taken under consideration.
On Motion by Commissioner Macdonald, seconded by Commissioner
Haffield and unanimously carried, the Clerk was authorized to advertise
the Notice of the Equalization meeting to be held on August 1, 1966.
Commissioner Macdonald moved that, due to the inability of the
Board to give title to the property for which the deposit was made,
that the $100 deposit made by Mr. Treley Thompson be refunded to him.
Motion was seconded by Commissioner Haffield and unanimously carried.
Commissioner Macdonald stated that this was a triangular piece of
land adjoining the Kroegel property obtained by the State for right
of way for U.S. #1 but never used by the State, and that the Board
has not been able to reach an agreement with the State Road Department
to return this property to Mr. Thompson.
The County Engineer presented the following right of way agreements
for easements in Lake Park Subdivision and on Motion by Commissioner
Waddell, seconded by Commissioner Haffield and unanimously carried,
the same were approved by the Board:
S. Ra._ond Smith and Indian River County, the East 5 feet of the West
10 feet of Lot A, less the North 190 feet and the East 5 feet of the
West 10 feet of the North 15 feet of Lot 3 and the North 5 feet of Lot
1, Lake Park Subdivision in exchange for the following:

1. As many of the Eucalyptus trees as can be taken up without
excessive root damage will be moved back to the new easement line.
2. The hibiscus and other small shrubs will also be moved back
to the new line.
3. The smaller of the two sheds will be taken down and removed.
4. The larger storage shed and contents will be moved back to the
new line.
5. One Cocos Plumosa palm tree at the SW corner of the lot will
be left providing that it is not more than one foot over the Easement
line. The other palms in the group are to be removed.
Marshall Barnes and Indian River County the East 15 feet of the East
11 acres of Tract 6, Section 4, Township 33 South, Range 39 East in
exchange that the travelway for maintenance of the proposed drainage
. ditch will be constructed on the West 10 feet of the above described
easement and the proposed drainage ditch will be constructed to the
East of said travelway. Any and all excess dirt, not needed for the
construction of said travelway and said drainage ditch, will be de-
posited on the grantors adjacent land, at a location to be specified by
said grantor.
Mr. Ben Bailey representing Central Groves Corporation and Indian
River County: the East 15 feet of Tract 3, Section 4, Township 33
South, Range 39 East in exchange for the following:
1. Install 20 feet of 54 inch culvert for crossing the walker
Avenue ditch at the North end of the above described easement.
2. Install 20 feet of 18 inch culvert connecting the North-South
proposed drainage ditch with the Walker Avenue ditch at a maximum
elevation of 18.50.
3. Install 10 feet of 18 inch culvert in the new proposed drainage
ditch at a point 1/4 mile south of Walker Avenue at a maximum depth
elevation of 19.50.'

Commissioner Macdonald moved that Mr. Henry Thompson be advised
by letter that he is not authorized to make any charges to anyone using

the county property at the Sebastian Inlet for camping, picnicking,
or for any purpose. The Motion was seconded by Commissioner Waddell
and unanimously carried.
In connection with final approval of items in the County budget
for the fiscal year' -.1966-67, Commissioner Waddell moved that the
Board of Trustees of the Indian River Memorial Hospital submit a copy
of their complete budget together with a knowledgeable person to
explain it to this Board. The Motion was seconded by Commissioner
Haffield and unanimously carried.
Mr. Warren T. Zeuch, Jr. and Mr. A. E. Spinelli presented a
Report of Projects of the Indian River Safety Council as requdsted
by the Board. After discussing the matter, Commissioner Waddell moved
that $1,000.00 be budgeted for the year 1966-67 and the Safety Council
may requisition this money as needed for films and equipment. The
Motion was seconded by Commissioner Macdonald and unanimously carried.
The several bills and accounts against the County, having been
audited, were examined and found to be correct, were approved and
warrants issued in settlement of same as follows: General Fund, Nos.
5632 to 5664, both inclusive; Road and Bridge Fund, Nos. 3663 to 3683,
both inclusive; Fine and Forfeiture Fund., Nos. 566 to 568, both in-
clusive. Such bills and accounts being on file in the office of the
Clerk of the Circuit Court, the warrants so issued from the respective
funds being listed in the Supplemental Minute Book and provided by the
rules of the State Auditor, reference to such record and list so
recorded, being made a part of these minutes.,
There being nofurther business, on Motion made, seconded and
carried, the Board then adjourned
