Penders Tentative Project Start Date : TBD Tentative Project End Date: TBD This Statement of Work ("SOW") will be performed under the terms and conditions of the attached Proposal between Thomas Penders & Associates, Titusville, Florida and Government of Indian River County (client) and is incorporated therein. 1 .0 The objectives of this SOW are to demonstrate that Thomas Penders & Objectives Associates: • Understands the problem, opportunity, and need. • Can describe an approach to meet the project' s requirements. • Has developed a fair estimate of time, costs, and schedules. • Has correctly identified the deliverables for the project. The objectives of this project are: • To assist Government of Indian River County in their assessment project of the Wabasso Beach Park Restoration survey area. • To assist Government of Indian River County in identification and assessment of prehistoric and historical archaeological sites within the project area. • To act as an archaeological consultant to Government of Indian River County including assessment and identification of cultural remains and act as a liaison to the Government of Indian River County and the Florida Division of Historical Resources 2,0 The scope of the project is limited to conducting an archaeological survey within Scope the defined project area. The project will include a records review, informant interviews, data analysis, field surface and subsurface surveys, and assessment of all sites located within the property boundaries. Every effort will be made to locate previously recorded and unrecorded archaeological and historical sites. In addition, each site will be tested to determine the boundaries of each identified site. The project will involve Thomas Penders & Associates assisting Government of Indian River County in the identification of archaeological sites. The project will also involve archaeological consultation as needed. In the event previously unrecorded archaeological sites are discovered, Thomas Penders & Associates will assist in the identification of cultural remains and provide support to Government of Indian River County as needed. This includes acting as liaison with Government of Indian River County and Florida Page 1 of 5 Division of Historical Resources personnel. 3.0 Thomas Penders & Associates approach to this project is based upon proven Approach methodology used successfully at several engagements. At a high level, the specific approach to this project includes the following major tasks: • Task 1 — Review of the Florida State Master Site File data to identify previously recorded prehistoric and historic archaeological sites within the project area and the immediate vicinity 6 • Task 2 — Conduct background research including, but not limited to the Indian River County Historical Society, Indian River County Government records, theses and dissertations at various Florida universities to identify possible historic and archaeological sites within the project area • Task 3 — Establish Areas of Archaeological Potential (AAPs) to customize the field survey for maximum coverage of high AAPS and test medium and low AAPS. • Task 4 — Interview local informants that live in the area who may have knowledge of unrecorded sites within or near the project. • Task 5 — Conduct an archaeological survey of the entire property to identify prehistoric site potential and determine exact areas of subsurface testing. • Task 6 — Conduct remote sensing and passive investigation techniques to identify site potential and determine exact areas of subsurface testing. • Task 7 — Identify and assess archaeological and historical sites and establish site boundaries. • Task 8 — Conduct a preliminary assessment of all sites and create a mitigation plan including sampling plan for Phase II testing (if necessary). • Task 9 — Analysis of all prehistoric and historic artifacts. • Task 10 — Present and review the final report with Government of Indian River County staff. • Task 11 — Thomas Penders & Associates will act as liaison with Government of Indian River County and the Florida Division of Historical Resources to ensure that the sites are properly protected. Thomas Penders & Associates consultants will work closely with the business and technical staff at Government of Indian River County to conduct a Phase I archaeological survey within the project area. Thomas Penders & Associates will attempt to locate unrecorded sites, relocate recorded sites and assistance in identifying solutions for protecting these sites. Thomas Penders & Associates will utilize the Florida State Master Site File data, Indian River County Government, FDEP title records, previous archaeological and historical survey reports, and other sources to identify sites and site potential within the project area and immediate vicinity. Thomas Penders & Associates will interact with Government of Indian River County staff members during the project to ensure that the planning effort remains on track with satisfying the requirements in the desired time frame. Thomas Penders & Associates will develop and deliver a final report that includes the results of all information gathering, field survey, analyses, conclusions, and Page 2 of 5 recommendations. 4.0 The final deliverable of this project will include the following: Deliverables • Three copies of the final report submitted to the Government of Indian River County outlining archaeological cultural chronology, methodology, identified sites and recommendations for protecting all sites on the property. Any additional copies of the report will be billed to Sunbeam Properties, Inc. • One copy of the final report submitted to Compliance Review, Florida Division of Historical Resources on behalf of Government of Indian River County for review • Any artifacts recovered during the survey. • Completed Florida State Master Site File forms for each site with site locations plotted on project maps. This SOW will be considered complete when Thomas Penders & Associates delivers all items as described in this section. 5.0 Thomas Penders & Associates bases its estimates and this SOW on the following Assumptions assumptions: • Preliminary data suggests there is a potential for historic and/or prehistoric sites within the subject property. • Thomas Penders & Associates will provide staff to assist Government of Indian River County in an archaeological survey of the project area. • Work will be performed within the defined project area and research at various institutions. Additional work that does not require on-site presence will be completed at Thomas Penders & Associates ' offices located in Titusville, Florida. • Government of Indian River County resources (personnel and information) will be available to assist in the completion of this SOW. • All information, verbal and written, provided by Government of Indian River County to Thomas Penders & Associates will be assumed to be true and factual. 6.0 Thomas Penders & Associates will appoint a Principal Investigator who will have Thomas Penders & explicit responsibility for the administration and technical direction of Thomas Associates Penders & Associates activities as described in this SOW. The Principal Responsibilities Investigator will be solely responsible for all research and consultation involved in the completion of this project. Mary H. Penders who acts as Office Manager and Archaeological Laboratory Technician will provide additional support. Penders (Office Manager/Laboratory Technician) • TBD (Field Technician(s)) Page 3 of 5 7.0 The responsibilities listed in this section are to be provided at no charge to Government of Thomas Penders & Associates. Thomas Penders & Associates performance is Indian River predicated upon the following responsibilities being fulfilled by Sunbeam County Properties, Inc: Responsibilities Government of Indian River County will designate a Contact Person to whom all Thomas Penders & Associates communications will be addressed and who has the authority to act for Government of Indian River County in all aspects of this SOW. This person will communicate project status with Government of Indian River County personnel and provide timely response to Thomas Penders & Associates requests, questions, and need for access. Government of Indian River County will designate business and technical project participants who will collaborate with Thomas Penders & Associates in all aspects of this SOW. These participants attend project meetings as scheduled by Thomas Penders & Associates. • Contract Manager — TBD • Technical Participants — TBD Thomas Penders & Associates requires that the Government of Indian River County provide copies of project maps, aerials, Phase I Environmental Site Assessment, and a letter of permission to conduct an archaeological survey on the property. 8.0 Any changes to this SOW will be submitted as a change order to be reviewed and Changes signed by both Thomas Penders & Associates' Engagement Manager and the Government of Indian River County's contact person. The change order will detail any changes to the project scope, price, schedule, and other terms and conditions of the Professional Services Agreement and this SOW. All change orders will be submitted on the Thomas Penders & Associates Change Order Document. No work will be performed as detailed on the change order until both, Thomas Penders & Associates and Government of Indian River County have signed this document, unless otherwise approved by both parties. 9.0 Thomas Penders & Associates acknowledges and accepts that there Liability are inherent risks in performing archaeological investigations ("fieldwork"). Thomas Penders & Associates hereby acknowledge, do now release, acquit and forever discharge Government of Indian River County the property owner, and all parties holding an interest in this property or proposed development, from all actions, claims, demands or damages accruing to me resulting from any known or unknown injury, loss or damage, sustained on the premises or during travel to and from the premises. This includes personal injury, sickness, or damage/loss to personal property. It is the responsibility of Government of Indian River County to notify any landowner, occupants, and/or tenants of the property that Thomas Penders & Associates will be conduct an archaeological, historical, and/or paleontological survey of the property. Thomas Penders & Associates has a zero tolerance for violence in the workplace. In the event that an associate of Thomas Penders & Associates is verbally or physically threatened by a landowner, occupants, and/or Page 4 of 5 tenants of the property Government of Indian River County will be notified that this contract will be immediately terminated and the retainer will not be returned. 10.0 Thomas Penders & Associates will tentatively commence work on December 28, Schedule 2006 and will complete this SOW on or before the tentative date of March 1 , 2007. The start and completion dates will be finalized upon the Government of Indian River County contract award and will last no longer than 5 weeks. Every attempt will be made to complete the project by the agreed date. However, conditions may exist that will cause delays such as, but not limited to, weather or environmental conditions such as excessive rain, flooding, fires, hurricanes, tropical storms, extreme heat; or being refused entry of the property by tenants or property owners. In such case, Government of Indian River County will be notified of the delay and every attempt will be made to expedite completion of the project in a reasonable time. 11 .0 The estimated cost of work to be performed under this Statement of Work is not to Compensation exceed $4,000.00. Payment is due upon completion of the survey. Payments will be made to Thomas Penders & Associates. 12.0 Your signature below signifies your acceptance of the Statement of Work.
