c � STIPULATION OF PARTIES OPENING A HIGHWAY-RAIL GRADE CROSSING AT 53RD STREET AND CLOSING 71St STREET ( CEMETERY ROAD) HIGHWAY-RAIL GRADE CROSSING INDIAN RIVER COUNTY, FLORIDA Indian River County , hereinafter referred to as "COUNTY," Florida East Coast Railway , L . L . C . , hereinafter referred to as " RAILROAD , " and Florida Department of Transportation , hereinafter referred to as " DEPARTMENT , " by and through their undersigned representatives herebyfile this Stipulation of Parties as follows : 1 . The COUNTY filed applications with the DEPARTMENT to open a public highway-rail grade crossing at 53`d Street and close the highway-rail grade crossing at 71St Street (Cemetery Road) , Indian River County , Florida , pursuant to Section 335 . 141 ( 1 ) , Florida Statutes . Copies of the applications are attached hereto and made a part hereof as Exhibit "A 2 . The opening application is for a permit to construct a five-lane urban highway-rail grade crossing with sidewalks at 53`d Street, which will cross the RAILROAD at RAILROAD milepost 223+4730' located in Section 15 , Township 32 South , Range 39 East, north of the City of Vero Beach , under the jurisdiction of Indian River County, Florida , as set forth on the plans and maps , attached hereto and made a part hereof as Exhibit " B . " 3 . The highway-rail grade crossing to be closed at 71 st Street (Cemetery Road) is located at RAILROAD milepost 221 +2832 in Indian River County , attached hereto and made a part hereof as Exhibit "C . " 4 . The rail line , at each location , is classified as a mainline track, and operates up to twenty- four (24) trains per day. The current maximum train speed at each location is sixty (60) miles per hour. The RAILROAD right-of-way at each location is 100' in width . 5 . In negotiating the use of the RAILROAD' s property for the crossing at 53`d Street, the COUNTY agrees to pay the RAILROAD an annual , adjustable fee of no greater than an initial price of sixty (60) cents per square foot for use of said right-of-way within the license area . 1 6 . The COUNTY also agrees to enter into new License Agreements for W. Wabasso Road , 69`h Street ( North Winter Beach Road) , and South Winter Beach Road highway-rail grade crossings . 7 . Under the terms of the new license agreement for W. Wabasso Road , 69th Street (North Winter Beach Road) , and South Winter Beach Road , the RAILROAD, at the COUNTY' s expense , will be responsible for the maintenance of the trackbed and rail components plus the highway surface for the width of the rail ties within the license area . 8 . Under the terms of the new license agreement for W. Wabasso Road , 69th Street ( North Winter Beach Road) , and South Winter Beach Road , the COUNTY, at the COUNTY' s expense , will be responsible for the maintenance of the highway roadbed outside the railway ties and the roadway up to the edge of the railroad crossing surface to include but not limited to all pavement structure , pavement surface , shoulders , drainage , sidewalks , pavement striping , advance pavement markings , erosion control , tree cutting , mowing , and advance warning signs . 9 . Under the terms of the new license agreement for W. Wabasso Road , 69'h Street (North Winter Beach Road) , and South Winter Beach Road , the RAILROAD, at the COUNTY' s expense , will be responsible for the maintenance of the crossing warning devices . 10 . The new License Agreements for W. Wabasso Road , 69th Street ( North Winter Beach Road) , and South Winter Beach Road highway-rail grade crossings will include an annual license fee calculated by the number of square feet of right-of-way used for the crossing times the current market value of the property. The annual fee will accommodate roadway improvements , crossing inspections , gate replacement, train delays , storm damage , liability , and other hidden costs . 11 . The RAILROAD , at the COUNTY' s expense , will provide , furnish , or have furnished , all materials necessary and construct a concrete railroad crossing surface at 53`d Street in accordance with the DEPARTMENTs Standard Index No . 560, attached hereto and made a part hereof as Exhibit " D . " The 53`d Street grade crossing will be installed in conjunction with the 53`d Street roadway construction . 2 12 . Upon completion of the crossing at 53`d Street, the RAILROAD , at the COUNTY' s expense , will be responsible for the maintenance of all trackbed and rail components , plus the highway roadbed , for the width of the rail ties within the license area . 13 . The RAILROAD , at the COUNTY' s expense will provide , furnish or have furnished , all necessary materials and install at the new highway railroad grade crossing at 53`d Street, automatic railroad grade crossing warning devices , Type IV, Class III (Cantilevers , Flashing Signals and Gates) , in accordance with the DEPARTMENT' s Standard Index No . 17882 , attached hereto and made a part hereof as Exhibit " E ." 14 . The RAILROAD , at the COUNTY' s expense , will be responsible for the maintenance of the automatic railroad grade crossing warning devices at 53`d Street. 15 . The COUNTY, at the COUNTY' s expense , will be responsible for the construction and maintenance of the 53`d Street highway roadbed outside of the railway ties and the roadway up to the edge of the railroad crossing surface to include but not limited to all pavement structure , pavement surface , shoulders , drainage , sidewalks , pavement striping , advance pavement markings , erosion control , tree cutting , mowing, and advance warning signs . 16 . The RAILROAD , at the COUNTY' s expense , will upgrade the existing North Gifford control point with new electronics and signal equipment that will integrate with the new 53`d Street grade crossing warning devices . The estimated cost of this work is $2101000 . 00 . 17 . All work by the COUNTY within the RAILROAD' s right-of-way will be coordinated with the RAILROAD to ensure that all applicable railroad requirements such as flagging , insurance , etc. are adhered to. All work will be consistent with current Manual of Uniform Traffic Control Devices ( MUTCD) , American Association of State Highway and Transportation Officials (AASHTO) Policy, and Manual of Uniform Minimum Standards for Design , Construction , and Maintenance for Streets and Highways (Florida's Green Book) . 3 18 . Upon completion of the new rail crossing at 53`d Street, the RAILROAD will provide to the Department a copy of the executed License Agreement for the new crossing and signals and reference the FDOT Grade Crossing Number. 19 . Prior to the removal of the 71 st Street (Cemetery Road) crossing , or the construction of the new 53`d Street crossing , the COUNTY will construct a new parallel roadway connecting existing 71st Street (Cemetery Road) to existing 69th Street ( North Winter Beach Road ) . 20 . Once the parallel roadway has been completed and traffic is routed to the 69th Street ( North Winter Beach Road ) crossing , the RAILROAD , at the COUNTY' s expense, will then remove the railroad grade crossing surface and the roadway pavement within the RAILROAD right-of-way at the 71 st Street (Cemetery Road) crossing . Any of the crossing surface and roadway pavement left behind by the RAILROAD from the roadway removal process will become the property of the COUNTY and will be removed at the COUNTY' s expense . Removal may include but not be limited to pavement, lighting , cross drains , signs , etc. 21 . The RAILROAD , at the COUNTY' S expense , will restore the RAILROAD' s right-of-wayto remove evidence of the crossing at 71 st Street (Cemetery Road). Restoration may include but not be limited to the addition of fencing , natural vegetation , etc. The RAILROAD shall notify the COUNTY a minimum of forty-eight (48) hours notice prior to the start of any closure work. 22 . The COUNTY, at the COUNTY' s expense , will erect on each side of the closed crossing prior to permanent closure work being performed , Type III Barricades , Road Closed Signs ( R11 2) , and Advanced Warning Signs (W20 3) as identified in the DEPARTMENT' s Standard Index 600 as provided in Exhibit " F . " 4 23 . The RAILROAD , at the COUNTY' s expense , will remove the highway-rail grade crossing warning devices at the crossing located at 71s' Street (Cemetery Road ) . The COUNTY shall erect on each side of the closed crossing after closure work has been performed , if needed , signs and object markers as identified in the DEPARTMENT' s Standard Index 17349 as provided in Exhibit "G . " 24 . The RAILROAD will ensure that all applicable railroad requirements such as flagging , insurance , etc. are adhered to. 25 . This Stipulation of Parties has been executed by all parties having an interest in this matter,- and further, all parties of this Stipulation waive hearing rights provided by Chapter 120 , Florida Statutes , and request the DEPARTMENT to issue authority in accordance with Section 335 . 141 ( 1 ) , Florida Statutes , and Rule 14-57 . 012 , Florida Administrative Code , with this Stipulation of Parties . 26 . The DEPARTMENT authorizes the opening of the 53`d Street highway- rail grade crossing and the closure of the 71 st Street (Cemetery Road) crossing as evidenced by the execution of this Stipulation of Parties . Indian River County 1840 25 �" Street Vero Beach, Florida 32960-3365 Dear Mr. Davis : This is in response to your letter dated May 21 , 2004, to Mr. Charles Stone regarding the opening of a new at- grade crossing at 53r6 Street in Gifford, Florida. While reviewing our files and trying to find a way to resolve this matter, we found that Indian River County has nine crossings with outdated License Agreements that range from 1958 to 1978 . The language in the agreements does not properly address the current type of construction, insurance requirements , maintenance fees , etc . The Railway recognizes Indian River County' s past cooperation concerning crossing matters and will approve the 53rd Street grade crossing if the following stipulations are agreed upon and progressed in the following order. 1 . ) The County enters into new License Agreements for W. Wabasso Road, 697�' Street (N. Winter Beach) , and South Winter Beach Road. Under the terms of the new agreements the County will be responsible for 100 % of the signal maintenance. The County is currently responsible for 100% of the signal maintenance at W . Wabasso Road and splits this - cost 50/50 with the Railway at the other two locations . This additional cost will equate to $2 , 820 . 00 annually. The new agreements will also have a license fee that is calculated by the number of square feet of right-of-way used for the crossing, times the current market value of the property. This is an annual fee and will be approximately $ 3 , 500 . 00 per crossing. This fee is in all new Railway grade crossing License Agreements that require crossing upgrades to accommodate roadway improvements , or when a new crossing is constructed. The license fee is to cover hidden cost associated with the existence of the crossing such as crossing inspections , gate replacement, train delays , storm damage , liability, etc . I have enclosed an agreement for W. Wabasso Road for your review . I will forward the other two agreements should the County decide to move forward with this project. One Malaga Street • P. O. As information, this crossing is in close proximity to our Gifford Control Point therefore there will be an additional cost for replacing the old antiquated equipment that will not facilitate the signal equipment and electronics associated with the new crossing .
