The Board of County'Commissioners of Indian River County, Florida,
met in regular session at the Courthouse, Vero Beach, Florida, on Wed-
ne4day, October 5; 1966, at 8:30 o'clock A. M. Present were Robert
W. Graves, Chairman; D. B. McCullers, Vice -Chairman; Donald Macdonald,.
Jerre J. Haffield, and Dr. B. O. Waddell. Also present were Jack
Jennings, County Administrator, John H. Sutherland, County Attorney,
and Alfred H. Webber and Ruth Elliott, Deputy Clerks.
:.a The Chairman asked if there were any corrections or additions to.
the minutes of September 7 and September 21, 1966. There were none and '
on Motion by Commissioner Waddell, seconded by Commissioner Haffield
and carried, the minutes were approved as written.
Mrs. Gladys Vigliano requested that Will Taylor of Fellsmere be
placed in Elsie Jones home for nursing care at a cost to the County
of $50.60 per month. On Motion by Commissioner McCullers, seconded by
Commissioner Macdonald and unanimously carried, the request was approved.
Mr. Will Jones, Executive Vice -President of Minute Maid Groves,
and. Mr. Troup, Mr. Norris and Mr. Nichols, their Engineer, appeared
before the Board and submitted a proposal to grant to Indian River
County,, the necessary right of way for three miles of road from Oslo
Road to the County line. Mr. Jones showed the proposed route from
Oslo Road through St. Lucie County to Orange Avenue on a map which was
viewed by the Board. DUringc;theAiscu$sion.,, _ :t ,.wasrbrought out that
Minute Maid has drainage canals` on either side of the right' of way, the
distance from center of canals being 100 feet and also that Minute`Maid
desires to maintain the canals. Commissioner Waddell suggest4d that it
might be advisable to accept a 70' riljht of way but obtain a perpetual
easement from Minute Maid to drain the road bed into their ditches.
Commissioner Macdonald moved that the County Administrator be instructed
to join in with the St. Lucie County_ Engineer and meet with them in any
discussion and/or meetings regarding this project and report back to the
board at the next meeting. The motion was seconded by Commissioner Mc -
Cullers and unanimously carried.

Sam T. Joyce, Sheriff, requested an additional sum of $300.00 to
complete the plumbing and to buy necessary toilet facitlities for the
Jail Annex. On Motion by Commissioner Haffield, seconded by Commissioner
Waddell and unanimously carried, the request -was granted. (This request
was incorporated in the item to Item transfer subsequently approved at
this meeting)
On Motion by Commissioner Macdonald, seconded by Commissioner Mc -
Cullers and carried, the Civil Defense Director was authorized to
pay one-half of the cost of a new radio tower for the City of Sebastian
out of Civil Defense Funds received from the sale of surplus equipment.
Mr. Roland Miller, Mayor of the Town of Indian River Shores and
Mr. Kenneth Sharpe, Attorney, requested the Board to consider leasing
the: -old Winter Beach bridgehead property and bridge tender°s house to
the Town of Indian River Shores for public use. The Board was receptive
to the request and asked that Mr. Sharpe prepare an agreement, incorp-
orating in same 1) that the park would be open to the general public,
2) that the park would be maintained in a condition satis£acbory to the
Board of County Commissioners, 3) that picnic facilities would be
available by land and by water, and 4) that, in the event that a bridge
is built and it becomes necessary to use this property for this purpose,
the right shall be relinquished.
Charlie Warren of Wabasso, owner of Lots 10 and 11, Block 8, Colored
School Subdivision, appeared before the Board and requested the County
to open the road on the west boundary of Colored School Subdivison,
south of West Wabasso Road, as he would like to build on his lots and
does not have acdess to them. The County Administrator will check the
right of way situation and report back to the Board.
Commissioner Macdonald gage: a<:report.Lonthecconcession administration
workshop sponsored by the Regional Planning Council which he attended.
It was stressed very strongly the great need for securing land for parks
and recreational areas, that the quality of the service in the parks was
highly important to their success and that leases should be as long as
possible for th i concessionaire in order that they have continued interest
in the operation.

Gentlemen:
We are requesting that the County Commission authorize abandoning five
feet (5') of an existing fifteen foot (15') easement, the legal description
is as follows:
The west five feet (5') of the East fifteen feet (15)
of lot 13, Block 1, Ixora Park Plat #7, as recorded in
Plat Book 7, Page 36, Docket #3319, Public Records of
Indian River County, Florida.
Abandonment of this five feet (5') would leave the county with a twenty
foot (20') easement, ten feet (10') on each side of dividing lot line, for
maintenance of this storm drain should the need arise. We are enclosing
a copy of our engineers letter, dated Sept. 28, 1966, in which he makes.
note that the storm sewer is not located in the easement in question, but
in the ten foot (10') easement in the adjoining lot (lot 12, Block 1).
We.are making this request, since we are unable to use this lot unless
this section of the easement be abandoned.

Mr. Jennings. reported that he had checked with the State Road
Department and that the Double. Reverse Curve revision: -on SR 512

Mr. Jennings presented a letter from,Balicock Furniture Company
stating that they would be glad`to install, at the company's expense,
weather stations at five or six school bus sites designated by -the County.-•,
(or more 1f needed). It•waS'the desire of the Board to take the matter
to Mr. J. A. Thompson, School,Superintendent, to determine the number
and site designations.
Mr. Jennings read a letter from Mr. N. W. Van Ausdal, offering
to deed to the county right of way for Hobart Road. Upon Motion by
Commissioner Macdonald, seconded.by Commissioner McCullers and unanimously
carried, the offer was accepted.
Mr. Jennings reported that he had received letters of acknowledgement
from Senator Smathers, Senator Holland, REpresentative Rogers, and the
US.Corps of Army Engineer regarding appropriation of funds for beach
erosion study and stated that they would cooperate fully to get the
sum of $90,000 set aside.

by Mr. Jennings and several revisions were made by, the -Board and noted
by the Administrator.

Commissioner Waddell moved that the low base bid, excluding the
alternate, of Netto Construction Company, in the amount of $113,427.00
be awarded, provided it meets the specifications and recommendations of
the Architect. The Motion was seconded by Commissioner Macdonald and
unanimously carried.

Mr. Jennings reported that his Department has started preparing
the site for this construction and asked the Board decision on the
disposition of our palm trees which must be removed. It was the opinion
of the Board to offer them to the Garden Club or the City of. Vero Beach,
if they will move them.
The matter of title encroachment between Mr.. Norman Zaph and
the county -owned stump dump property on Kingsberry Road, (Tract 13,
Section 18, Twp 32s, Range 39 E¢,) was discussed and'tef"erded to the
County Attorney for study and recommendation.
Motion was made.by Commissioner Waddell, seconded by Commissioner
McCullers and carried, that the service contract with D & J Sheet Metal
Company for serviciing:all air conditioning units in the Courthouse once
a month, $40,00 a month, be renewed for the period of one year.
The County Attorney presented Crossing agreements between the
Florida -East Coast Railway Company and Indian River County for the

middle crossing in Gifford and the 4th Place crossing. Upon Motion
by Commissioner Waddell, seconded by Commissioner Haffield, the agreements
were approved and the following Resolution unanimously adopted as to
each agreement:

The County Attorney read a letter from Mary S. McCluer, City
• Clerk of Fellsmere, written on behalf of the Mayor, Members of the
Fellsmere City Council and Citizens of 'Fellsmere, thanking the Board
for the help and services' given that resulted in the recent transfer
of State owned lands to the City.
Commissioner Waddell moved that the execution otthe easement to
the Sebastian Inlet District (Sebastian Inlet Park) be authorized at
such time that the deed from the Trustees of the I I Fund is recorded.
The Motion was seconded by Commissioner McCullers and unanimously carried.
The County Attorney reported that an Order of Taking has been
secured in the condemnation suit, Indian River.County vs. Davis.(bridge
over North fork of Sebastian River, SR 512.
Commissioner Waddell moved that the Clerk be authorized to insert
in the Vero Beach Press Journal a legal advertisement requesting any
citizen of the County who wishes to be heard concerning a building code
or the adoption of a building code for Indian River County to appear
at 10:00 o'clock A..M., on Wednesday, November 9, 1966. The Motion
was seconded by Commissioner McCullers and unanimously carried. The
Administrator was requested to seek information from St. Lucie, Martin
Osceola, Okeechobee, and Brevard Counties, if they have building code,
get a copy and the cost of operating the department, less permit fees.
Upon Motion by Commissioner Macdonald, seconded by Commissioner
Haffield and unanimously carried that The Beach Bank.of Vero Beach
was designated as a County depository.
Upon Motion by Commissioner Waddell, seconded by Commissioner
Haffield and unanimously carried, the Chairman, Vice -Chairman and the
Clerk were authorized to sign signature cards for General Fund -Florida
National Bank at Vero Beach.
At the request of the State Board of Health, Entomological Research
Center„ Commissioner .. McCullers ,.moved;= seconded by -Commissioner=: Haffield
and:.unanimously carried, that Lawrence A. Webber be granted a pistol
Permit.

Belle Glade, October 18-19, and to Miami, October 24 to 27 was approved.
On Motion by Commissioner Macdonald, seconded by Commissioner
McCullers and carried, the appointment of John J. Morrison, as Deputy
Sheriff, was approved.
The Monthly Reports of the County Agent, the County Service Officer
and the County Welfare'Case Worker were received and placed on'file.
On Motion by Commissioner McCullers,'seconded by Commissioner
Macdonald and unanimously carried, George E. Stokes, County Service
Officer, was authorized to attend the Mid winter Conference, November
2 - 4, 1966, in St. Petersburg Beach, Florida.
Motion was made by Commissioner Haffield, seconded by Commissioner
Waddelland unanimously carried,, that the Clerk and Alfred H. Webber,
Deputy Clerk, be authorized to attend the County Finance Officers Assoc-:
iation Fall Conference in Miami Beach on October 12-15, 1966.
On Motion by Commissioner Macdonald, seconded by Commissioner

I would like to request the Board of County Commissioners
to consider a change in the present system of issuing build-
ing permits. The proposed change would require•a valid per-
mit from the health department specifying the requirements
for adequate sewage disposal for the particular building and
location.
In doubtful areas the health department may require a soil
profile or other pertinent information to be furnished by
the applicant.
A final inspection by this department will be performed to
insure compliance with the stipulations of the original
permit.
In the event of a. refusal by this department the applicant nay
present a sewage disposal system which is certified by a register-
ed engineer licensed to practice in Indian River County and which
will meet sanitary requirements.
If this is refused by the County Health Department the applicant
may request a special hearing by the Board of County Commissioners.

Dr. Flood and Mr. Bob Jennings, Sanitation Engineer, stated that
the Health Department needs a boat for River Pollution. Surveys. The
Board gave its approval, provided the Health Department has the necessary
funds in its budget.

Attorney John Charles Mitchell submitted the request of the Board
of Trustees of the Indian River County Hospital District that a "Public
Opinion Poll" be placed on the ballot•:at the General Election, November 8,
1966, regarding the proposed mental health facility, stating that the
Board of Trustees have indicated that they will bear any expense of

WHEREAS, the Board of Trustees of the Indian River County Hospital
District has requested that a "Public Opinion Poll" be included on the ballot
at the next general election to be held Tuesday, November 8, 1966, the pur-
pose of such poll being -to determine the wishes of the residents of the Indian
River County Hospital District with regard to a proposed mental health facili-
ty to serve said residents, and
WHEREAS, the Board of Trustees of the Indian River County Hospital

NOW, THEREFORE, BE IT RESOLVED that the Board of County Com-
missioners 9f Indian River County, Florida, at its regular meeting held
Wednesday, October 5, 1966, does hereby approve and permit the inclusion
on the ballot for the general election to be held Tuesday, November 8, 1966,
the following Public Opinion Poll as requested by the Board of Trustees of the
Indian River County Hospital District:

The several bills and accounts against the County, having been.
audited, were examined and found to be correct, were approved and
warrants issued in settlement of same as follows: General Fund, Nos.
6030 to'6105, both inclusive; Road and Bridge Fund, Nos.•3907 to 3950,
both inclusive, Find and Forfeiture Fund, Nos. 607 to 614, both inclusive.
Such bills and accounts being on file in the office of the Clerk of the
Circuit Court, the warrants so issued from the respective funds being
listed in the Supplemental Minute Book as provided by the rules of
the State Audits*, reference to such record and list so recorded being
made a part of these minutes.
There being no further business, on Motion. made, seconded and
carried, the Board then adjourned.
