HomeMy WebLinkAbout10/19/1966The Board of County met in regular session at nesday, October 19, 1966, WEDNESDAY, OCTOBER 19, 1966 Commissioners of Indian River County, Florida, the Courthouse, Vero Beach, Florida, on Wed - at 8:30 o'clock A. M. Present were Robert W. Graves, Chairman, D. B. McCullers, Vice -Chairman, and members, Donald Macdonald, Jerre J. Haffield and Dr. B. Q. Waddell. Also present were John H. Sutherland, County Attorney; Jack Jennings, County Administrator, and Alfred H. Webber and Ruth Elliott, Deputy Clerks. Mr. Billy Roberson, County Ranger,, presented a Cooperative Equip- ment lease between Indian River County and the Florida Board of Forestry for a_ fire truck to be used by the Sebastian Volunteer Fire Department. On Motion by Commissioner Macdonald, seconded by Com- missioner Waddell and unanimously carried, the Chairman was authorized to execute the lease and the addendum on behalf of the County. Mr. Thomas H. Trent, Civil Defense Director, reported that '.: ; Headquartersr_is "putting pressure on" to have an emergency operating center in the County, a place where the government could continue to operate regardless of what happens. He suggested a 30° x 30° addition to the Civil Defense Building and stated that the Federal Government would pay one-half of all expenses. After discussion, Commissioner Waddell suggested that this be held in abeyance until such time that there is a definite need for space, then build to shelter specifications and the building will serve a dual purpose. 9 1966 BOOK 10 PAGE 16 .. M. Wed- nesday, October 19th, 1966, and at said time publicly open the same at the meeting of said Board to be held in the County Commissioners' Room, Indian River County Court- house, Vero Beach, Florida, for sale by the County of one wood frame house, known as Bridge Tender's house located on the south side of the road at the Old Winter Beach Bridge Head, East bank of the Indian River. The house must be salvaged or. moved intact. Building must be completely removed and all debris cleaned up in a proper and work- manlike manner within thirty (30) 1days from time of bid acceptance. All bids must be in a sealed envelope, marked on the outside, "Bid for house, open date October I19, 1966," and shall be accom (panted by a good faith' deposit of ten, (10) percent of the total amount' of bid. If further information ds desired, prospective bidders may contact the office of the County 'Engineer. This the 21st day of September, 1966. BOARD OF •COUNTY COX MISSIONERS .OF INDIAN RIVER COUNTY, FLORIDA By: ROBERT W." GRAVES, Chairman Sept, 29, Oct. 6, 1966.. The Chairman read the foregoing Notice and no bids were received. The Chairman then read a certified copy of Resolution adopted by the Town Council of Indian River Shores in Special meeting on October 5, 1966, requesting the Board to tear down the Winter Beach bridge tender house inasmuch as said house has fallen into disrepair, is unsightly, dangerous and a nuisance to the community. Mr. Jennings, County Administrator, reported that the Mayor of Indian River Shores had requested that the proposal made at the last meeting be rescinded and that they will make @, Commissioner Macdonald moved, that, based on the Resolution received from the Town of Indian River Shores, it'appears .that they :are. not : des i�ods� 'of having the building(as requested at October 5 meeting), and that the Board re -advertise for bids for the sale of the Winter Beach Bridge tender house. The metion was seconded by Commissioner Haffield and unanimously carried. Upon Motion by Commissioner McCullers, seconded by Commissioner another proposal at a later time. OCT 19 1966 6OOK 10 PAGE 171,. Waddell, it was unanimously voted that the County develop this property as a County Park. Commissioner Macdonald reported that he has interviewed the applicants for concessionaire at Sebastian Inlet Park, and recommended that, before a decision is made, that these applicants be requested to appear before the entire Board, which they have expressed their willingness to do. The applicants will be requested to appear before the Board at 1:30 P. M., on November 23, 1966. Concerning FBI investigations, Commissioner Macdonald reported that he had been informed that the FBI would not do work of this ktind. However, Sheriff Sam T. Joyce, who was present, 'n felt that the FBI would run a check on finger prints and volunteered to write each applicant requesting that they go by the Sheriff's office of their respective locations and be fingerprinted. Upon Motion by Commissioner Waddell, seconded by, Commissioner McCullers and unanimously carried, the County Attorney and the Right - of -Way Agent,'Ted Williams, were authorized to attend a seminar on right of way condemnation to be held in Orlando on November 3 and 4. The County Administrator read a letter from Mr. J. A. Thompson,. Superintendent of the Board of Public Instruction, dated October 5, 1966, requesting that the Board waive the usual building permit fees for the construction of the two new elementary schools, at the corner .of Emerson Avenue and Citrus Road and on 43rd Avenue just off North Gifford Road. Mr. Jennings reported that the School Board has here- tofore paid these fees. Commissioner McCullers moved, seconded by Commissioner Macdonald, and unanimously carried, that -the Administrator notify the School.Board that, under the law, this Board cannot waive these fees. Mr. Jennings submitted plans for the concession building at the Sebastian Inlet Park with the changes the Board had requested at the last meeting and also a cost estimate of $3,731.20. Commissioner Waddell moved that the Administrator be authorized to advertise for bids for construction of the building; but, that we do not actually construct it until a tenant has been chosen, and he, together with the Board has determined the proper location for it. The Motion was seconded by Commissioner McCullers and unanimously carried. OCT 19 I : ` 6dbk 10 PAGE 18 Since the Wabasso Bridge is going to be so high, it will be impossible to have any fishing off of it, and thereupon, Commissioner Macdonald moved that a' Resolution be sent to the State Road Department requesting catwalks on the Wabasso Bridge, similar to those installed under the Sebastian Inlet Bridge. The Motion was seconded by Commissioner- Haffield and unanimously carried. RESOLUTION NO. 66-42 WHEREAS, the State Road Department of Florida has indicated that it is going to rebuild the Wabasso Bridge on State Road #510 over the Intracoastal Waterway from the Center Island across the Indian River over the East Channel of said river to.the East shore and make it into a high-level bridge in order to do away with the draw span; and WHEREAS, the sportsmen and fishermen in Indian River County have for many years used the Wabasso Bridge as one of the prime fishing areas in the county; and WHEREAS, with a high-level bridge it will be impossible to fish off of said bridge over the East Channel of the Indian River; and WHEREAS, it will be highly desirable for the safety of both the automobile traffic and the sportsmen to have catwalks under the bridge similar to the ones constructed over the Sebastian Inlet;. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- n4ssioners of Indian River County in Regular Session this, the 19th day of October, A. D. 1966, that it does hereby respectfully re- quest that the State Road Department build catwalks under the high- level bridge at Wabasso over the East Channel of the Indian River in order that the citizens of the State of Florida may continue to enjoy the fishing and in order to make said bridge as safe as possible. BE IT FURTHER RESOLVED, that a certified copy of this Resolution shall be forwarded to the State Road Department in Ft. Lauderdale, Florida. NO 10 RV 1 OCT 19 1 i Mr. Jennings read a letter from Mr. W. A. Coldwell, Park • Planner, State Board of Parks, in regard to information sent on the de- velopment of the Hobart Property. It was noted that this land has never been dedicated to the County by the Trustees of the II Fund. Commissioner Haffield moved that the Administrator be instructed to forward a certified copy of the Resolution adopted on February 23, 1966, (Minute Book 9, page 501), together with a letter of request based on the proposed planning being done here, to the Trustees, and, if a conference with members of the Cabinet is necessary, members of the Board be authorized to go to Tallahassee. The Motion was seconded by Commissioner Mac- donald and unanimously carried. The request, as presented by the Indian River County Health De- partment at the October 5 meeting, that a permit be_required from the Health Department specifying the requirements for adequate sewage disposal for a particular building and location, was read by the County Attorney., Dr. C. C. Flood, Director and.Mr. Bob Jennings, Sanitation Engineer, were present. Among those present, questions were asked and comments made by Mr. Frank Zorc, Mr. A. TO LeFever, Mr. Jack Dritenbas, Mr. Fred Baker, Mr. Floyd Wilkes, Mr. Bill Mc - Cullers, Mr. Floyd Grimm, Mr. Julian Lowenstein and Mr. Bob Rollins, most of whom were not in favor of regulations that were too costly, rigid and unrealistic. Mr. Wilkes suggested that the Board postpone any decision until it is known whether or not the .County will have a building code and building inspector on November 9. Motion was made by Commissioner Haffield that the Board follow the recommendation made from the audience and that the request be tabled until November 9 when a public hearing is scheduled on the building code. The Motion was seconded by Commissioner Waddell and passed, with Commissioner McCullers abstaining. OCT 19 1966 10 PACE 20 Tax Assessor Homer C. Fletcher introduced Mr. B. J. Mawhinney, Assistant Comptroller,and Mr. Billy Givens, Director of County Finance. Mr. Mawhinney stated that they have delivered to the Tax Assessor, approval of the recapitulation tables of the 1966 Tax Roll for Indian River County, and read a statement from Fred O. (Bud) Dickinson, Comptroller, in which he congratulated Mr. Fletcher for his compliance with the Order of the Supreme Court for 100%, full value property assessment. Commissioner Haffield moved that the Board reconvene. as a Board of Equalization on Monday, November 14,, 1966, at 8:30 o'clock A. M., and that the Notice of Reconvening be advertised. Motion was. seconded by Commissioner Waddell and unanimously carried. On Motion by Commissioner Macdonald, seconded by Commissioner Waddell, and unanimously carried, the following procedure was adopted for persons wishing to appear before the Board of Equalization: Before the Board will discuss the assessment of any particular piece of property, the owner should have discussed the tax assessment with the Tax Assessor. If he is still dissatisfied, he should file a formal', Petition to the Board of Equalization, in duplicate, with the Clerk. The Clerk will number the Petitions as they are filed and they will be considered in that order. Upon Motion by Commissioner Macdonald, seconded by Commissioner McCullers and unanimously carried, the Administrator was authorized to proceed with the placement of school bus stop shelters at the six (6) locations recommended by the Board -sof Public Instruction. Commissioner Waddell moved that the Beverage Department be notified that the. application of Maxine Coleman for a beer and.wine package sales only license, at 33rd Avenue and 43rd Street in Gifford, does conform to the Zoning Regulations of the County. Mr. Jennings reported that he has discussed the Minute Maid right- of-way proposal with the County Engineer and Administrator of St.. Lucie County and making all progress that they can at this time. Mr. Jennings presented a Petition, signed by ten property owners, dated October 18, 1966, requesting attention to a very bad drainage situation existing in the immediate vicinity of 45th Avenue and 18th OCT 19 1966 gobk 10 PAGE 21. 4Lig ht d.a-, 1 `,IS.. ...Vt... ° f .. Street in Tropicolony Subdivision. Mr. Jennings suggedtedjtwo' alternatives to remedy the situation: 1) run a ditch along the -rod right of way which would go through numerous driveways, culverts would have to be changed and would be expensive. 2) consider the possibility of condemning an easement along the south side of Lot 23, Block 3, Tropicolony for the length of the lot. After discussion, Commissioner Waddell moved that the Administrator be authorized to have an appraisal made of the particular easement and that the owner be offered the appraised value. The Motion was seconded by Commissioner McCullers and unanimously carried. The County Attorney submitted the' Performance Bond, Labor and Material', Payment Bond, Certificate of Insurance, and Contract between County, and Netto Construction Company for the construction of the Courthouse Annex. Upon Motion by Commissioner Waddell, seconded by Commissioner McCullers and unanimously carried, the Chairman was authorized to execute the Contract Elsie Jones of Ee3;lsmdreerequested finaricial-.-aid-from.-the County to build a nursing home for the colored. She was informed by the Board that the County cannot,by law, spend any money on private property. Dr. Flood volunteered to aid her in checking the availibility of federal funds for this purpose. Mr. George Stokes, Veteran Service Officer, requested that the rear steps to the Courthouse be remodeled to include a ramp or that the complete steps -be remade into a ramp so that disabled veterans in wheelchairs and those who have difficulty in manipulating steps can come into his. office. He also requested that, if the Board sees fit, that his parking space, which is the nearest' one to thNdoor be reserved for dibabled veterans. On Motion by Commissioner McCullers, seconded by Commissioner Macdonald and unanimously carried, the Admin- istrator was requested to make a cost estimate of the request and also to have Netto Construction estimate what a change order would involve to have a ramp in the new building. OCT 191 666k 10 pdGF 22 Mr. Jennings reported that the Zoning Board, after public hearing, has recommended to this Board the following: 1) that approximately 170 acres of land south of Oslo Road and east of U.S.#1 be changed from R1A Country Home District to R1 Single Family District, as requested by Mr. Julian Lowenstein; 2) that approximately 40 acres in the area of Citrus Road and Monroe Road be changed from R1 Single Family District to Agriculture District, as requested by Mr. Guy Poteat.; 3) that the Zoning Resolution be amended by adding the work "trailer" after the words "attached garages" in Section 5, R2A Multi -Family District, Sub- section G; and, 4)that the Zoning Resolutionbe amended by adding Para- graph 9, to Section 2, under EXCEPT AS,HEREINAFTER PROVIDED, (see minutes of 9/7/66 Bk.9, pg 702) Commissioner Waddell moved that a public hearing be held on November 9, 1966 at 8:30 o'clock A. M., on the above recommendations. The Motion was seconded by Commissioner McCullers and unanimously carried. Mr. Jennings read a letter from the Businessmen and Women's League of Indian River County, Gifford, Florida, requesting street lights in the Gifford area. After discussion, it was decided that there are three intersections in this area that meet the County policy for installing street lights. Commissioner Macdonald moved that the County Administrator be instructed to have street lights installed at the following inter- sections: 28th Avenue at North Gifford Road; 28th Avenue at South Gifford Road, and 28th Court at North Gifford Road. The Motion was seconded by Commissioner Haffield and unanimously carried. Upon Motion by. Commissioner Macdonald, seconded by Commissioner Waddell and unanimously carried, the following Item to Item transfers were approved: y GENERAL FUND FROM TO A/C 857.1 Sanitary Landfill Equipment $2,500.00 691.1 Sanitary Landfill Gen. Operation $2,500.00 ROAD AND BRIDGE FUND 422 Maintenance of Equipment 423 Gasoline and Oil $ 250.00 250.00 Commissioner Waddell moved that the pistol permits of Frank L. Clavlin and Earl Smith be approved for renewal, subject to the approval OCT 19 1966 BOOK 10 • PAGE 23 of the Sheriff. The Motion was seconded by Commissioner McCullers` and unanimously carried. The Annual Report of the County Welfare Department was received and"p/aced on file. The several bills and accounts against the County, having been audited, were examined and found to be correct, were approved and warrants issued in settlement of same as follows: General Fund, Nos. 6106 to 6140, both inclusive; Road and Bridge Fund, Nos 3951 to 3971, both inclusive; Fine and Forfeiture Fund 615 to 617, both inclusive; Such bills and accounts being on file in the office of the Clerk of the Circuit Court, the warrants so issued from the respective funds being listed in the Supplemental Minute Book as provided by the rules of the State Auditor, reference to such record and list so recorded being made a part of these minutes.
