SUBJECT : Spikes Parcel Acquired as Part of New County Administration
Building Property
On October 21 , 2003 the Board of County Commissioners approved the
purchase of the Thelma Spikes ' residence as part of the property needed for the
new County Administration Building . On December 16 , 2003 we closed on the
Spikes ' property. As custodian of the County' s permanent records , I attach for
your records the following original documents :

AFFIDAVIT OF SELLER
STATE OF FLORIDA
COUNTY OF INDIAN RIVER
BEFORE ME , the undersigned authority, personally appeared Thelma Spikes ,
who being first sworn by me , says that :
1 . I am the owner of the following described property, located in Indian River
County, Florida :
The East 61 . 8 feet of Lot 1 , Block 7 , BOOKER T .
WASHINGTON ADDITION TO THE TOWN OF
VERO , according to the Plat thereof, as recorded
in Plat Book 2 , at Page 34 , of the Public Records
of St. Lucie County, Florida , said lands now lying
and being in Indian River County, Florida .
2 . There are no mortgages , liens , tax liens , taxes , interests arising under the
Uniform Commercial Code , encumbrances , or claims of any kind , nature , and
description whatsoever against the property except : None
3 . There have been no improvements , alterations , or repairs to the property
made within the past 90 days for which the cost of any part of it remains unpaid .
4 . All work , labor, material , and supplies that have been furnished , used , or
applied on the property within the past 90 days have been fully paid for and
discharged . There are no construction , materialman ' s , or laborer' s liens against
the property or any part of it , and no contractor, subcontractor, laborer,
materialman , engineer, architect , landscape architect , or surveyor has any lien or
right to lien against the property, or any part of it.
5 . There are no parties in possession of the property , and there are no
parties who have any right of or status in possession , use , or otherwise arising
from unrecorded leases , land contracts , sales contracts , options , or other
documents , except me .
6 . This affidavit is made for the purpose of inducing Indian River County to
purchase the property from me .
7 . There are no matters pending against me that could give rise to a lien that
would attach to the property between disbursing of the purchase price and
recording of the warranty deed from me to the proposed grantees , and I have not
and will not execute any instrument that would adversely affect the title .

Should it become necessary to initiate suit as a result of any covenant or
statement contained in this affidavit , I further agree to pay all attorneys ' fees and
court costs incurred by Indian River County.

POST CLOSING OCCUPANCY AGREEMENT
Indian River County and Thelma Spikes have reached an agreement to sell the
Spikes ' residence at 2645 17th Avenue , Vero Beach , Florida 32960 to Indian
River County . The parties agree that for a period of one ( 1 ) year from the
exchange of a deed from Spikes to Indian River County and the delivery of
$ 83 , 000 . 00 from the County to Spikes , that Thelma Spikes will be allowed to
occupy her former residence . The terms of such occupancy are as follows :
1 . No rent will be due from Spikes .
2 . Upon sale of the property, County will maintain liability insurance on the
property.
3 . Spikes will maintain any renter/fire insurance she may desire for her
possessions . Should the residence be destroyed by fire , the County will
be under no obligation to rebuild .
4 . Spikes will pay utility , electric , and solid waste fees attributable to
occupancy .
5 . Spikes may remove fixtures and/or make repairs at her own expense
during occupancy.
6 . County will collect pro- rated taxes at closing and thereafter cancel taxes .
7 . Spikes will surrender the property to the County at the end of the one ( 1 )
year period or in her discretion may notify and surrender the premises to
the County prior to Decembe4 2004 should she determine to move at
any earlier date .
