This Second Lease Modification Agreement ("Second Amendment") is entered into
effective as of July 1, 2008 ("Effective Date") by and between INDIAN RIVER COUNTY, a
political subdivision of the State of Florida ("County"), whose address is 1801 27h Street, Vero
Beach, Florida 32960, and TREASURE COAST HOMELESS SERVICES COUNCIL, INC., a
not for profit corporation organized under the laws of the State of Florida ("Council"), whose
address is 2525 St. Lucie Avenue, Vero Beach, FL 32960,
BACKGROUND RECITALS
A. Effective as of July 1, 2005, the County and the Council entered into a Lease Modification
Agreement ("Amendment"),
B. The County and the Council now desire to extend the term of the Amendment as set forth
herein.
NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency
of which are hereby acknowledged, and intending to be legally bound, the parties hereby
agree as follows:
1. From and after the Effective Date of this Second Amendment., the second sentence only of
Paragraph 1 of the Amendment shall be modified in its entirety to read as follows:
"The parties acknowledge and agree that the Released Premises are contemplated to be
needed by the County from the Effective Date through June 30, 2011 ("Release Term'."
2. The background recitals are true and correct and form a material part of this Second
Amendment,
3. All terms and conditions of the Lease, as amended by the Amendment, and not amended
herein, shall remain in full force and effect.
