The Board of County Commissioners of Indian River County,
Florida, met in regular session at the Courthouse, Vero Beach, Florida,
on Wednesday, March 8, 1967, at 8:30 o'clock A. M. Present were
Robert W. Graves, Chairman; D. B. McCullers, Jr., Vice -Chairman;
Donald Macdonald, Richard Bogosian, and Jack Dritenbas'. Also present
were County Administrator Jack G. Jennings; County Attorney Sherman
N. Smith, Jr.; and Deputy Clerks, Alfred H. Webber and Ruth Elliott.
The Chairman asked if there were any corrections or additions
to the minutes of February 8, 22, and March 1, 1967. There were none,
and on Motion by Commissioner McCullers, seconded by Commissioner
Dritenbas and unanimously carried, the minutes were approved as
written.
Mr. Angelo Sanchez, and several other residents of 50th Avenue
and -Mr. Jerre J. Haffield appeared before the Board seeking information
as to when 50th Avenue would be paved, stating that when they had
given the County easements for a drainage ditch on the west side of
their property, they had been promised that the road would be paved.
After considerable discussion, Commissioner McCullers moved, seconded
by Commissioner Macdonald and unanimously carried, that the matter
be tabled until the County Attorney can make an investigation of the
records pertaining to this situation.
Mr. Sil Perrella, President of the Sunshine Rehabilitation Center
of Indian River County, Inc., and Mss. Vera Palma, therapist, were present
and asked to be enlightened on the proposed $4,000 award to the Pioneer
Occupational Center for the Handicapped in Port Salerno; and they invited
the members of the Board to inspect the facilities of the local Sunshine
Center -

The Chairman read the foregoing Notice and bids were received
and opened as follows:
Diebold, Inc $2,144.00
Motion was made by Commissioner Macdonald, seconded by Commissioner
Bogosian and unanimously carried, that the bid of Diebold, Inc., be
accepted; and that the Tax Collector be authorized -to pay for same
out of the excess fees of his office.

A request by the Sebastian River Drainage District that the
County construct a bridge over Lateral L canal, approximately 1/2 mile
north of North Winter Beach Road, the cost of construction to be paid -
by the Drainage District, was discussed by the Board. The County
Administrator referred to a letter dated September 29, 1965, to the
District, wherein the cost of the bridge was estimated.at $760 a span,
or a total of $2,280; and he stated that, in his opinion, that the cost
at this time would be $1,260 a span, or a total of $3,780. After dis-
cussion, Commissioner Macdonald moved that the County Administrator be
requested to review this with the Drainage District and find out just
exactly what they had in mind and report back to the Board at the next
meeting. Motion was seconded by Commissioner Dritenbas and unanimously
carried.
Motion was made by Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried, that the proposal for a wayside park
facility on State Road 512,outlined in a letter from the District Eng-
ineer of the State Road Department dated February 23, be approved; and
the County agrees to make the necessary survey and transfer of title
of the site selected.
On the recommendation of the County Administrator, Motion was
made by Commissioner Macdonald, seconded by Commissioner Dritenbas
and unanimously carried, that the purchase of a counterweight for the
175-A loader from Florida -Georgia Tractor Company for $450.00 be approved.
The Administrator reported that the Planning and Zoning Commission
has made its tentative recommendation to this Board that the zoning on
North'
property described as the/7350' of the W% of the NES of the NWS of Section
27, Twp. 32S, Range 39E, be changed from Mi Industrial to R2 Single
Family District, as requested by Mr® A. T. LeFevre. Motion was made
by Commissioner Bogosian, 'seconded by Commissioner Macdonald and un-
animously carried that a public hearing be held on the above zoning change.

Motion was made by Commissioner Dritenbas, seconded by Commissioner
Bogosian and unanimously carried that the form of application for average
rate, submitted by the Ed Schlitt Agency, covering the buildings and
contents policies of the County's insurance be approved, and the Chair-
man be directed to execute 'it on behalf of the Board; further, that the
Ed Schlitt Agency be designated as agent of record for the County's
buildings and contents insurance and that the Chairman be directed to
advise the Florida Inspection and Rating Bureau by letter.
Mr. Frank Clavelin and Mr. Clint Fredell, representing the
Fellsmere Volunteer Fire Department, submitted a request for financial
assistance in order that the following proposals can be accomplished:
1. Bring Roster up to full strength - 30 men.
2. Insure these 30 men. Extimated cost $250.00
$5000 accidental death -$40.00 week salary supplement.
3. Bring all existing equipment up to a satisfactory condition:
(A) Trucks - Periodic inspection and maintenance.
(B) . Pumps
2 reserve pumps
cost $400.
(C) Hoses - replace all
new nozzles
4. Construct high level water
emergency use.
(A) Behind City Hall at well
(B) Carter Hall S/D at well
(C) Raise pipe on well on State Road 507
5. Purchase equipment suitable for fighting gas and electrical fires

After discussion, Motion was made by Commissioner Bogosian that,
subject to whatever requirements as far as auditing procedures are con-
cerned, that the Board allocate $1,000.00 from the Contingency fund to
be used as specified in the memorandum from the Fellsmere Volunteer Fire
Department •(listed above); and that an Item to Item transfer from Account
No. 951, Contingency to Account No. 682, Fire Control, of $1,000.00,
General Fund, be authorized. Motion was seconded by Commissioner Mac-
donald and unanimously carried.

Upon Motion by Commissioner Macdonald, seconded by Commissioner
Bogosian and unanimously carried, the Board requested that the Clerk
tabulate all bids received.
Robert Jackson,: Assistant':State':Attorney, appeared before the
Board and requested the Board to publish and pay for an advertisement
of a Notice of a Special Act which the State Attorney is asking all
counties in the Ninth Judicial Circuit to recommend and which would
enable the counties in the Circuit to supplement the salaries of the

State Attorney, Assistant State Attorneys, office expenses, secretarial
help and office equipments After considerable discussion, Motion was
made by Commissioner McCullers, seconded by Commissioner Macdonald and
unanimously carried that the Board publish the legal notice of local
legislation pertainingto supplementing the budget of the State -Attorney.
Mr. Frank Shearer appeared before the Board and requested the
County to install a street light at the entrance to Vero Beach Highlands
Subdivision. It was moved by Commissioner McCullers, seconded by
Commissioner Macdonald and unanimously carried, that the County Ad-
ministrator be requested to check this location and also the entrance
to Ixora Park Subdivision on 27th Avenue to see if they meet the criteria
of the County for the installation of street lights.
Mr. G. A. Perkins,-:, representing..Floraiina':Exploration Company,
was present in regard to his company's request to run-drilling•.tests
for minerals on all road rights-of-way maintained by• the County. After
discussion, Motion was made by Commissioner McCullers, seconded by
Commissioner Macdonald and unanimously carried, that the Board tenta-
tively approves the request of G. A. Perkins, on behalf of Floralina
Exploration Company, for permit for drilling on County roads as out-
lined- in letter of February 3, 1967, with the request that he submit
to the Countyhis proposal in writing, with a map of the approximate
locations of each place to be drilled; agreeing to furnish the County
on -the -spot geological data; to limit the drilling to not more than
sixty (60) days from beginning and to end not more than one (1) year
from this dates and to hold the County harmless from any liability and
not to interfere with traffic on County roads.
The Chairman read a letter from D. L. Bolin, on behalf of Atlantic -
Richfield Company, dated:.February 23, wherein he requests that his permit
request for mineral prospecting be held in abeyance until such time as
certain problems can be solved.

On Motion by Commissioner Dritenbas, seconded by Commissioner
McCullers and unanimously carried the Sample Ballot for the Second
Special Primary Election to be held on March 14, 1967, was approved
as submitted by the Supervisor of Elections.
Commissioner Macdonald moved, seconded by Commissioner McCullers
and unanimously carried, that the deed from Helen Hanson to the County,
conveying all of Block 29, Townsite of Roseland, with the special covenant
on behalf of the County to hold and use the property as a public play-
ground or for other public purpose, be accepted and ordered recorded.
A request was received dated February 27 and signed by eight
families living in the area of South 27th Avenue and SW 28th Avenue
(vicinity of and west of Ixora Park) that the County Commission take action;
against Mr. Milo Miller, Sr. living in same area to remove all junk cars,
livestock and unsightly debris on his property. The Administrator
noted that this condition existed prior to the adoption of the Zoning
Regulations. After discussion, the Administrator was requested to follow
the advise of the County Attorney and advise these people that the
Zoning Law is not retroactive and does not cover their complaint; if they
want to prosecute they should file their own complaint.
On Motion by Commissioner McCullers, seconded by Commissioner
Dritenbas and unanimously carried, the Administrator was authorized
to install an underground culvert in exchange for the 10' easement over
the Cafferata property on 45th Avenue in Tropicolony.
Motion was made by Commissioner Bogosian that the County Adminis,-.L
trator be authorized to consult with the Mosquito Control Board and the
Drainage District relative to improving drainage in the Gifford area,
with particular emphasis on the report that Dr. Flood submitted regarding
the contamination of wells, Indian River County Health Department test
runs of February 27, 1967 in the Gifford area; and, since this condition
may not exist in Gifford only, include any and all subdivisions in the
County. The Motion was seconded by..:.Dtitenbas and unanimously carried.
On Motion by Commissioner Macdonald, seconded by Commissioner
Bogosian, the following Resolution was unanimously adopted:

RESOLUTION NO. 67-16
WHEREAS, the Board of County Commissioners did designate
certain roads in this County for improvement; and,
WHEREAS, one of the roads so designated for reconstruction was
Dale Street, more commonly known as Powerline Road, in Roseland, Florida,
running from the northerly line of Section 30, Fleming Grant, southeasterly a
distance of 1320 feet; and,
WHEREAS, said road has been designated, used, established and
maintained by the Board of County Commissioners of Indian River County as a
public road for a period of more than seven (7) years immediately prior to the
date of adopting this Resolution; and,
WHEREAS, a map showing the location of the road right of way as
described below is attached to this Resolution, which map is to be filed in the
office of the Clerk of the Circuit Court of Indian River County, Florida; Now,
therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian
River County, Florida, in regular session on this 8th day of March, 1967,
that this Board does herewith certify that Dale Street, commonly known as
Power' line Road, running from the northerly line of Section 30, Fleming Grant,
southeasterly 1320 feet, has been designated, established and maintained by
the Board of County Commissioners of Indian River County, Florida, as a
public road for a period of more than seven (7) years immediately prior to
this date and that the right of way for said public road lies in and over the
following described lands as situated in Indian River County, to -wits
Westerly 35 feet of Lot 2 and Westerly 35 feet of Lot
13 and the Easterly 35 feet of Lot 3 and Easterly 35
feet of Lot 12, in Section 30, Fleming Grant, accord-
ing to the plat by S. B. Carter filed in the office of the
Clerk of the Circuit Court of St. Lucie County, Florida,
in Plat Book 1, page 179; said land now lying and being
in Indian River County, Florida;
and that the map attached to this Resolution shall be certified to by the
C1^1 --man and Clerk of the Board of County Commissioners and filed in the
office of the Clerk of the Circuit Court of Indian River County, Florida.

The Board then recessed at 12:00 noon and reconvened at 1:40 P.M.
The Clerk having tabulated the bids for equipment reported to the
Board. Mr. J. Oscar Stroberg, representing Diebold, Inc.:;:: appeared before
the Board and spoke of the advantages of the Legal Diebold Power Shelf
File, After considerable discussion, Motion::was made:. lby.:.Commiss-ioner-:t
Macdonald that the Board finds that the bid of Diebold, Inc., is $78.00
more than the lowest bid by Acme Visible Records, Inc., but the Board
finds that the Diebold bid is the best bid because the service facilities
offered are better, the Diebold facility provides lighting attached to
the file, has a mechanical safety feature and nylon roller bearings for
a quieter operation, which, in the judgment of the Board makes their
bid the lowest and best bid; and that the bid of Diebold, Inc, in the
amount of $3,530.00 be accepted for Item No. 11A. Motion was seconded
by Commissioner McCullers and unanimously carried.
Motion was made by Commissioner Dritenbas, seconded by Commissioner
McCullers and unanimously carried that the low bid of George Stuart, Inc.,
for Item Nos. 4A, 4B, 12C, 19A, 33,34, 34A, 35, 36, 37, 38,. 39, 39A, 40,
41, 42, 43, 44, 45, 46, 47, 48, 1B, 1A, 1C, 4A, 10A, 3A, 3B, 5A, 50, 51,
4CD, 527, 4B, 6B, 52, CL -1, C1-3, SO -1, SO -2, SO -3, SO -4, 1-R, for a
total of $20,939.95; and the low bid of O'Haire Office Equipment Company
for Item Nos. 84B and 60, for a. total of $1,241.73; and the low bid of
International Business Machines for Item No. Cb -2, for machines for:the
Clerk' -s office, for a total of $1,764.00, be accepted and the order
placed accordingly.
Commissioner Macdonald reported that the Trustees of the Internal
Improvement Fund have approved the dedication of the 491.04 acres, known
as the Hobart property, to Indian River County for public park and re-
creational purposes. He also presented a letter from the Kiwanis Club
in which they propose the name "Kiwanis-Hobart Park of Indian River
County" for this recreational area. Upon Motion by Commissioner Mac-
donald, seconded
ac-donald,seconded by Commissioner McCullers and unanimously carried,
the name proposed was officially designated as the name for the park.

Commissioner Macdonald requested the approval of the Board
for,the preparation of the requisition form to the Outdoor Recreational
Department for the additional acquisition of approximately 38 acres of
land at the Hobart Park and the preparation of the requisition request
for matching funds for development of the park; and further that when
these requisitions and applications are prepared that he be authorized
to deliver them in person to the Outdoor Recreational Director, Ney-
Landrum. After considerable discussion, on Motion made by Commissioner
McCullers, seconded by Commissioner Bogosian, the request was unanimously
approved.
The monthly reports of the County Agricultural Agent, the County
Welfare Worker and the County Service Officer were received and placed
on file.
On Motion by Commissioner McCullers, seconded by Commissioner
Macdonald and unanimously carried, the applications of Eugene Duck
Ross and Paul Stephens to the Southeast Florida Tuberculosis Hospital
were approved.
At the request of County Judge Miles B. Mank II, and on Motion
by Commissioner Macdonald, seconded by Commissioner Bogosian and un-
animously carried, the following Item to Item transfer was approved:

On motion by Commissioner Macdonald, seconded by Commissioner
Dritenbas and unanimously carried, the County Agricultural Agent's
request for out -of -county travel dated March 1 was approved.'
Motion was made by Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried, that the County Service Officer,
George Stokes, be authorized to attend the 16th;Annuai:.Service Officer's
School and Conference, April 29 to May 6 in Daytona Beach; and Ralph
• Harris, Clerk and Alfred H. Webber, Deputy Clerk, be authorized to attend
the Spring Conference of County Finance Officers Association in Cocoa
Beach, March 22 to 25, 1967.

Upon Motion by Commissioner Macdonald, seconded by Commissioner
McCullers and unanimously carried, the following Item to Item transfers
were authorized:

Motion was made by Commissioner Dritenbas that the County Admin-
istrator be authorized to install a pressure tank compressor attached
to the aerate tank, rebuild the aerating tank, purchase and install pipe
and water line distribution to picnic area, install discharge line from
the shrimp tank to the River and build dumping station to State Health
Department specifications, at the Sebastian Inlet Park. Motion was
seconded by Commissioner McCullers and unanimously carried.
The several bills and accounts against the County, having been •
audited were examined and found to be correct, were approved and warrants
issued in settlement of same as follows: General Fund, Nos. 6672 to 6767;
Road and Bridge Fund, Nos. 4237 to 4285; and Fine and Forfeiture Fund,
Nos. 669 to 676, both.inclusive. Soh bills and accounts being on file
in the office of the Clerk of the Circuit Court, and the warrants so
issued from the respective funds being listed in the Supplemental Minute
Book as provided by the rules of the State Auditor, reference to such
record and list so recorded, being made a part of these minutes.
There being no further business, on Motion made, seconded and
carried, the Board adjourned at 3:45 o'clock P. M.
