Heiser , Senior Attorney Department of Environmental Protection 3900 Commonwealth Blvd MS35 Tallahassee , FL 32399- 3000 RELEASE OF SITE DEDICATION THIS RELEASE OF SITE DEDICATION is made this day of 2009 by and between the STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION (successor in interest to State of Florida Department of Natural Resources ) , DIVISION OF RECREATION AND PARKS , whose mailing address is 3900 Commonwealth Boulevard , Mail Station 500, Tallahassee , Florida 32399 -3000 (" DRP") and INDIAN RIVER COUNTY , a political subdivision of the State of Florida , whose mailing address is 1801 27th Street , Vero Beach ; Florida 32960 -3388 (the "'County " ) . WITNESSETH : '..WHEREAS , the County owns the following described lands located in Indian River County , Florida ( " Property All of Government Lot in Section 14 , Township 31 , South Range 39 East Indian River County , Florida , lying east of the east right- of�way line of State 'Road A- 1 -A , EXCEPT the North 400 feet of same ; and .WHEREAS , the County acquired the Property with financial assistance provided by DRP in accordance with Chapter 161D- 5 , Florida Administrative Codes and WHEREAS , pursuant to the requirements of said rule the County was required to dedicate the Property to the public in perpetuity as an outdoor recreation area for the use and benefit of thre general public; and WHEREAS -.on February 8 , 1989 ,. the County executed the Notice of Limitation of Use/Site Ded catmn `that is recorded in Offcial Records, Book 082"2 ; Page '1755, , Public U Records of Indian River County (' Site Dedication- ) , and WHEREAS ; the .County h .as requested that DRP release the Property from the Site Dedication so that the County may dispose of the Prop.efty ; and WHEREAS , in consideration of D.RP ' s release of the Property from the Site Dedication , the County is willing to place a similar notice of limitation of use /site dedication on other lands owned by the County .
