Re : Bella Vista Isles Force Main Extension Requirements
Dear Mr. Hotchkiss,
CJM Construction of South Florida Inc. ("CJM") would like to take this opportunity to thank you for your
assistance in resolving the "force main extension" requirements for the development project known as
Bella Vista Isles. We truly appreciate your diligent effort in resolving this issue .
We have reviewed the contents of your letter dated August 9, 2006 , and understand that this is a one
time accommodation .
It is our understanding that the Indian River County Utilities Department ("IRC") intends to undertake the
construction of the "force main extension". Accordingly, in lieu of constructing the "force main extension"
and inclusive of all extensions fees CJM will deliver a check in the sum of $ 16, 000 . 00 to IRC, as and for
full payment and settlement of this issue.
Additionally, you requested that our engineering consultant, Kimley-Horn & Associates Inc. (" KH") ,
provide construction observation services to IRC for construction of the "force main extension" and
certification upon completion , at no cost to the municipality. Accordingly, we have communicated with KH
and have provided them with a copy of your correspondence for review and consideration .
CJM will facilitate delivery, to your office, of five (5) signed and sealed copies of the engineering plans for
the "force main extension". Additionally, CJM has contracted with KH to provide construction observation
services for the "force main extension" to be constructed by IRC . KH has agreed to provide the requested
services provided your contractor gives adequate prior notice to KH of commencement, utility installation ,
and back-fill activities and such other prior notice and documentation as may be required by KH for
certification of improvements.
CJM will absorb the fees generated by KH for the construction observation services, inclusive of
certification, provided IRC ' s contractor completes construction of the "force main extension" , in
accordance with the plans provided , prior to completion of utility and infrastructure improvements at the
Bella Vista Isles project.
