The Board of County Commissioners of Indian River County, Florida,
met in regular session at the Courthouse, Vero Beach, Florida, on
.Wednesday, May 24, 1967, at.8:30 o'clock A. M. Present were Robert
W. Graves, Chairman; Donald Macdonald, Richard P. Bogosian, and Jack
U. Dritenbas. Absent was Vice -Chairman D. B. McCullers, Jr. Also
present were Sherman N. Smith, Jr., County Attorney; Jack G. Jennings
County Administrator, and Alfred H. Webber and Ruth Elliott, Deputy
Clerks:
Mr. Bertram J. Bellay and his attorney, L. B. Vocelle, were
present to petition and request the Board to abandon the plat of
Bell-Acyres, Unit 1, releasing the dedication of the easements as
well as the park, and stated that the street shown on the plat serves no
property other than Mr. Bellay's; that no conveyances have been made
other than Lots 23 and '24 to Mr. Bellay's son; the only home built is
that of Mr. •Bellay located on Lot 2. After discussion, it was moved
by Commissioner Macdonald, seconded by Commissioner Bogosian and un,-
animously carried, that the County tentatively approves the request of
Mr. Bertram J. Bellay for the abandonment of the subdivision known
as Unit 1, Bell-Aycres according to the plat filed in Plat Book 6,
page 59, subject to Mr. Bellay publishing a Notice of Public Hearing
as'required by law.
On Motion by Commissioner Dritenbas, seconded by Commissioner
Macdonald and unanimously carried, the Board tentatively approved
the approach and zoning plan for the Vero Beach Municipal Airport
as submitted by Floyd Boyer, Airport Director, and directed that
a public hearing be held. The plan will limit and regulate future
building or structure heights in the vicinity of the airport.

The County Administrator read a letter dated April 26 from
the State Road Department advising,Of an application from the owner
of Block 3, Northwood Subdivision, for the release of surplus right
of way in front of this block. The Board noted,viewing the right of
way map, that city water and power lines run • through this right of way
and that this is in an area where a service road could be used at the
present time. Commissioner Macdonald moved, seconded by Commissioner
Dritenbas and unanimously carried, that the request be denied.

NO. 67-29
ON MOTION of Commissioner Macdonald , , seconded by
Commissioner Dritenbas , the following Resolution was adopted:
WHEREAS, the State Road Department of Florida has established loca-
tion for that part of State Road 512 designated as Section 88040
Job 2507 , between Sebastian River Bridge and Approaches.
and proposes to construct and maintain the same as a part of its Secondary Road
program; and, Whereas, Indian River County is vested with all right
of way required for said.road;
NOW, THEREFORE, the Board of County Commissioners of Indian River
County does hereby affirm that it is vested with all of the required right of
way for said portion of said State Road, and that said*right of way is legally
clear and has been physically cleared of all buildings, fences and other im-
provements; that all utility poles, lines, cables, pipes and other facilities
have been removed or adjusted as required for construction of said project by
the State Road Department or such removal, and/or adjustments have been ar-
ranged for and will be effected without delay to the State Road Department
and/or its contractors; and the State Road Department is hereby requested to
proceed with the construction and maintenance of said portion of said State
Road; and Indian River County hereby agrees to save harmless the
State Road Department, its contractors, agents and employees, from all claims
arising out of such construction and maintenance of said road within the right
of way aforesaid and to defend any and all lawsuits to completion and satisfy
any and all judgments therein made, at the County's expense.
NOW, THEREFORE, the Board of County Commissioners of Indian River
County, does hereby authorize the execution of a deed conveying the herein-
above described property to the State of Florida for the use and benefit of the
State Road Department.

RESOLUTION NO. 67-30
AREAS, the Zoning Commission of Indian River County,
Florida, did after public hearing make its final report.recommendng
changes and additions to the Zoning Resolution of Indian River Codnty,
Florida;. and,
• WHEREAS, this Board did publish 4.ts notice of said reconmiended
changes and additions and did, pursuant thereto, hold a public hearing
in relation thereto at which parties in interest and citizens were
heard; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of
Indian River County,_ Florida, that the Zoning Resolution of Indian
River County, Florida and the accompanying Zoning Map, pe changed
as follows:
1. That the Zoning Map be changed in order that the
following described property, situated in Indian River County, Florida,
to wit:

The Board requested the County Administrator to plot on
a larger map, the businesses licensed for consumption on premises
in the Gifford area, and the location of churches and schools, giving
the date of the beverage license, and the date of construction of
church and school; and that the requests for' transfer of the beverage
license for the Davis Grocery, Chicken Shack and Blue Seas be tabled
until the map and prohibiting Resolutions adopted previously have
been reviewed by the Board.
Mr. James V. Slade, Mrs.. Murray Michaels and Mr. Don Sembler
were present to again thank the Board for their action regarding
dredging in the Indian River and reported that a study will be made
by conservation groups to determine whether dredging of the river
opens up wells causing freshwater seepage into the river.
Tlie Chairman appointed Commissioner Dritenbas, Commissioner
McCullers and Sherman N. Smith,County Attorney, as a committee to
work on the administrative aspects of the County Building Code.
Civil Defense Director Thomas H. Trent requested approval
of the purchase of a high frequency transiever, with associated
power supply, in order to receive and send messages with CD District
Headquarters in Orlando who has changed their frequency, making the
local system incomplete. The estimated cost to be $454.00. The
Board tabled the request and suggested Mr. Trent see if other
arrangements can be made through the Sheriff's Department or ham operators.
On Motion by Commissioner Macdonald, seconded by Commissioner
Dritenbas and unanimously carried, the Civil Defense Director was
authorized to attend a CD meeting in Jupiter, May 29.
The Board again discussed the objections voiced by Mr. Eugene
•
Cobb at the May...1O meeting pertaining to the r/w of Dale Street in
Roseland and it was the opinion of the Board that the 70' right of way
is necessary and the County Administrator was requested:to so adviseoMr.

The County Administrator presented a feasibility report
covering the projects listed in the Master Plan prepared by the
Progressive Civic League of Gifford. After discussion, the following
action was taken:
Motion was made by Commissioner Macdonald, seconded by
Commissioner Bogosian and. unanimously carried that the County Administrate
be authorized to proceed with the paving.of 1) 43rd„ t'xPeet., from
U.S.#1 (old) to 28th Avenue; 2) 31st Avenue between North and South 1.
'Gifford Roads 3) 33rd Avenue from North Gifford Road to H-2 Canal, in
accordance with his recommendations.
Motion was made by Commissioner Bogosian, seconded by
Commissioner Dritenbas and unanimously carried., that the culverts
at the following locations : 1) 31st.. Avenue, andtNQrth;Gifford Road'
:2) . 35th Avenue and North Gifford Road 3) 33rd Avenue and North. Gifford
Road, be replaced and put in suitable condition as part of the regular
maintenance of county roads.
Regarding Request #3, Clean-up and Beautification, the
Administrator suggested a liasion project between.the Road and
Bridge Department, the County Health Iepartment and a Citizens
Working Committee from the area, whereby a pond in Reedwood Subdivision
could !be turned into a landfill operation, and later be made into a
playground area. The suggestion was approved by the Board and the
County Administrator was requested to discuss such an operation with
the Progressive Civic League.
The Administrator pointed out that the Request #3 for Street
Lights, that the county criteria for installation of street lights
is not met in this area.
Regarding the maintenance and management of Ambersand Beach
Park, the County Administrator was requested to discuss with the League
the possibility,of gettjng a lifeguard to be custodian of the park after
the County has 'put it back into condition.

Mr. Bill.Locke and Mr. Gene Roddenberry appeared before the
Board in regard to the construction of a boat ramp a Sebastian Inlet
Park by a group of citizens, (see minutes of 2/22/67) After considerable
discussion, Commissioner Dritenbas volunteered to work with the group
to determine the most feasible method of construction and report back
to the Board.
The County Administrator showed pictures taken of one
particular area in the County, ( Rebel Road, west of 20th Avenue)
where a great amount of trash and garbage Iswbeing dumped along the
county.right-of-way: After discussion of the problem, Motion was
made by Commissioner Macdonald, seconded by Commissioner Bogosian and
unanimously carried, that the Sheriff be requested to assign two
unmarked cars to patrol the County for illegal dumping of trash on the
rights-of-way.
On Motion by Commissioner Macdonald, seconded by Commissioner
Dritenbas and unanimously carried, the.Administrator and members of
the Board were authorized to meet with the State Road Department in
Fort Lauderdale on May 17.
The Board then recessed at 11:40 A..M. and re -convened at
1:15 P. M.
The County is in receipt of letter dated May 10, 1967
from the Corps of Engineers/. Jacksonville District, advising of an
application for dredging permit by Mrs. Anita Connelle SAJSP-Permits.
67-258. On Motion by. Commissioner Macdonald, seconded by Commissioner
Bogosian and • unanimously carried, the County Administrator is
directed to advise the Corps of Engineers that under the laws of the
State of Florida and the Resolutions of this County, permits for

such dredging and filling must be'made by formal application to this Board,
and that no such application has been made for this project, and the
Board therefore herewith registers its objections to the granting of
the permit by the Corps of Engineers.

At the request of the Board, the County Attorney invited
Dr. G. B. Britton, a member of the newly appointed county Water
Resources Committee, to meet the members of the 'Board. Dr.. Britton
addressed a few remarks regarding water conservation to the Board
and received their expression of appreciation -for his willingness to
serve on the committee.
On Motion by Commissioner Macdonald, seconded by Commissioner

Bogosian, the following Resolution was unanimously adopted:
RESOLUTION NO. 67-31
WHEREAS, Robert P. McLarty has made an app1.ication to the
Corps of Engineers of the United States Army for a dredging permit in the
public waters of Indian River County; and,
WHEREAS, this Board has recommended that the permit not be
issued; and,
WHEREAS, it is the intent and purpose of this Board to limit and
confine dredging in the public waters of this county to those areas where there
will be a minimum of disturbance of the bottoms essential to conserve fish and
wild life and to limit such dredging to that which can be accomplished without
a deposit of harmful silt in the public waters; and,
WHEREAS, this Board is well aware of the fact that there can be
honest differences of opinion on the subject; Now, therefore,
BE IT RESOLVED by the Board. of County Commissioners of Indian
River County, Florida, that this Board does herewith publicly express its
high esteem for Robert P. McLarty and does recognize the contributions which
he has made to his country in war and peace and to the State of Florida in the
promotion of public parks, preservation of historic areas and conservation of
the natural resources of the State; and,
BE IT FURTHER RESOLVED that a certified copy of this Resolu-
tion be furnished to Mr. McLarty.

On the recommendation and at the request of the State Road
Department, Commissioner Macdonald moved that a special speed zone
be established on State Road 510 (the east and west approaches to
the Wabasso Bridge), the maximum not to exceed 25 miles per hour,
and that signs be erected to that effect. Motion was seconded. by
Commissioner Bogosian and unanimously carried.
Motion was made by, Commissioner Bogosian, seconded by
Commissioner Dritenbas and unanimously carried that, the County
reject the offer of Mr. Ike Evans to sell to the County ten acres
of,land,adjacent to the Sanitary Land fill on South Gifford Road.
The County Administrator requested the Board to consider
discontinuing the project of the re -alignment of Oslo. Road between
Ranch Road and 90th Avenue because 1-95 and overpass will be in the
first 1/2 mile.of this portion of road. On Motion by Commissioner
Macdonald, seconded by Commissioner Dritenbas and unanimously carried,
this -project -!-Vas discontinued from the county road program.
Commissioner Bogosian reported to the Board of a complaint
he received from residents in Vero Lake Estates Subdivision that the
school bus driver has been instructed -not to go down the roads because
they are in such a deplorable condition.. The Administrator explained
that thecond±tion exists because the roads are sub -standard marl roads,
the extreme dry weather, and heavy tomato trucks that are using the roads.
He offered to contact the county school bus garage to see if the situation
could be remedied.
Commissioner Dritenbas presented to the Board a request by
Lloyd and Reed Knight that the county maintain the continuation of
Lindsey Road from U.S. Highway #1 towards the River. During the
discussion which ensued, it was broughtout that,to date, no record
has been found that the county owns the right-of-way.

Commissioner Dritenbas reported..that a resident of Whispering
Palms Subdivision has questioned him.who is. to maintain the concrete
block sign at the entrance to the subdivision which is in bad condition.
The County Administrator was requested to contact the property owners'
association to see if they want to maintain it; otherwise, if it is
on the right-of-way, the County will take it down.
Commissioner Dritenbas recommended and moved that the County
advertise for bids to repair whatever is necessary to the outside of
the Civil Defense building. Motion was seconded by Commissioner
Macdonald and unanimously carried.
Commissioner Macdonald suggested and requested the County
• Administrator to arrange for two garbage collections a week, rather
than one, at the Wabasso Beach Park,
On Motion by Commissioner Bogosian, seconded by Commissioner
Dritenbas and unanimously carried, Commissioner Macdonald was authorized
to attend a special meeting of the East Central Florida Regional Planning
Council in Titusville on May 27.
A copy of Resolution adopted by the Riverside Pomona Grange
#3, Legislative Committee, was received,requesting the County
Commissioners of Indian River and BrevardCounties to cap or plug
all flowing wells not in use and to cap all wells now used in mosquito
control until the drought emergency is over.—

An application for License to carry Firearm was received
from Rachel H. Moody, together with a Bond in the sum of $100.00,1
and a letter of recommendation from Sam T.•Joyce, Sheriff, and a letter
from her employer, Bill M. Moody," Bil'l's Gulf Service. On Motion by
Commissioner Dritenbas, seconded by Commissioner Macdonald and unanimously
carried, the Bond was approved and the License granted.

An application by Curtis G. Hughes, Jr. for a license
to carry firearms, together with a letter from Sheriff Norvell of
St. Lucie County endorsing the character of the applicant and a letter
from Sam T. Joyce, Sheriff of Indian River County, was received by
the Board. The Deputy Clerk stated that the Applicant is employed
by Wometco Enterprises and has taken out a state-wide Bond, and
permit is necessary through each of the counties which he travels.
On .Motion by Commissioner Dritenbas, seconded by Commissioner Mac-
donald and unanimously carried, the License to carry firearms was
granted.
On Motion by Commissioner Macdonald, seconded by Commissioner
Dritenbas and unanimously carried, the Payroll.forState Witnessess,
dated May 19, in the amount of $170.95, was approved.
On Motion by Commissioner Macdonald., secondedtby.Commissioner
Bogosian and unanimously carried, purchases of various items of
furniture and equipment were authorized, not to exceed the following
amounts: clocks, $50.0Q; upholstered bench, $150.00; desk for Tax
Assessor, $200.00; and air -conditioner, installed $400.00.
The several bills and accounts against the County, having
been audited, were examined and found to be correct, were approved
and warrants issued in settlement of same as follows: General Fund,
Nos. 7040 to 7092, both inclusive; Road:and Bridge Fund, Nos. 4389 to
4456, both inclusive; and Fine and Forfeiture Fund, Nos.705 to 710,
both inclusive. Such bills and, accounts being on file in the office
of the Clerk of the Circuit Court, and the warrants•so issued from
the respective funds being listed in the Supplemental Minute Book
as provided by the State Auditor, reference to such record and list so
recorded, being made a part of these:minutes.
There being no further business, on Motion made, seconded
and carried, the Board adjourned at 3:00 o'clock P. M.
