HomeMy WebLinkAbout08/09/1967WEDNESDAY, AUGUST 9, 1967 The Board of County Commissioners of Indian River County, Florida, met in regular session at the Courthouse, Vero Beach, Florida, on Wednesday, August 9, 1967, at 8:30 A. M. Present were Robert W. Graves, Chairman; D. B. McCullers, Jr., Vice -Chairman; and Jack U. Dritenbas. Absent were Donald Macdonald and Richard P. 8ogosian. Also present were Jack G. Jennings, County Administrator; Thomas Thatcher for Sherman N. Smith, County Attorney; and Alfred H. Webber and Ruth Elliott, Deputy Clerks. The Chairman called the meeting to order and asked if there were any corrections or additions to, the minutes of July 3, July 12 and July 26, 1967. There were none, and on Motion by Commissioner McCullers, seconded by Commissioner Dritenbas and. unanimously carried, the minutes were approved as written, Motionr.was made by Commissioner Dritenbas, seconded by Commissioner McCullers and unanimously carried, that the Board accepts for maintenance the streets and drainage within the dedicated rights of way and easements as shown on the Plat of Golf Acres Sub- division as recorded in Plat Book 7, records. page 79, Indian River County The County Administrator advised. the Board that Mr. Floyd R. Taylor has completed the street separating Blocks 3 and 4 on the Plat of Glendale Park, recorded in Plat Book 1, page 87, Indian River County records, according to existing County Subdivision regulations, and Motion was made by Commissioner Dritenbas, seconded by Commissioner McCullers and unanimously carried that the Board accepts for maintenance that . portion of 15th Airenue'b,.. extending South from Eight Street to °Seventh Street in Glendale Park. Subdivision as recorded in Plat Book 1, page 87, Indian River County Records. • AUG 91967 • it' it tin4.20 • With regard to the request; of Mrs, Arnold to move a small building that is on County property in Whispering Palms Subdivision, the Administrator reported that the building is of sound construction and was moved to its present location to provide a pick-up point for children riding the school bus. A petition was received signed by residents of Whispering Palms Subdivision or Beachwood Estates Subdivision requesting that this corner (1st. Street, S. W. and 6th Drive, S. inn remain the pick-up point for children riding the school bus. Cpmmissioner Dritenbas stated that the reason this has become -a controversial issue is that Mrs. Arnold's home is nearest to the building and children are in the building until early morning creating disturbance. After discussion, Commissioner Dritenbas moved that signs be placed on the building stating that it is to be used only .for school bus pick-up during certain hours and also thatthe position of the building be shifted 900 so that the front of the building does not face Mr. Arnold's driveway. Notice and bids were received and opened as follows: Fred Coyne Chevrolet (1968 model) w/ airconditioning Arnold Ford Sales (1967 model) w/ airconditioning $1,941.15 $2,256.55 $1,°79.88 $1,979.88 Motion was made by Commissioner McCullers, seconded by Commissioner Dritenbas and carried that the low bid of Arnold Ford Sales of $1,739.88 (without air-conditioning) be accepted, subject to the County Administrators certification that it meets bid specif- ications. The Board received a letter, dated August 2, 1967, from Robert Parker, Director, Trustees of the Internal Improvement Fund in reply to Resolution No. 67-41, requesting them to dedicate in perpetuit: the bottom lands lying within the area described as the 'Proposed Enlargement of the Pelican Island National Wildlife Refuge'. Also enclosed were copies of previous minutes of the Trustees in regard to this same request which had been considered by them on July 16, 1963. Discussion was postponed until the return of the County Attorney. On Motion by Commissioner McCullers, seconded by Commissioner Dritenbas and carried, the transfer of a typewriter from the Road and Bridge Department to the Indian River County Health Department was authorized. A petition was received from residents of Ixora Park Sub- division asking that the County do something regarding the disturbance created by Joe Woodcock doing mechanical work in his carport during all hours of the night and who has junked vehicles around his home, in an area zoned R-1, Residential. The petition was turned over to the County Attorney to determine what can be done to remedy such situations. It was moved by Commissioner McCullers, seconded by Commissioner Dritenbas and carried that the Board request a firm price from Netto Construction Company for improving a portion of the second story of the Courthouse Annex to be used for the County Agent's office, subject to the opinion of the County Attorney as to whether or not additional work in the Annex can be handled by a change order.. AUG . 2 X967 f 100.1t 10 Pacc442 The Board received a letter dated August 4, 1967, from Ney;C. Landrum, Director of the Outdoor Recreational Development Council, concerning the J. T. Gilbert application to purchase sub- merged land in the vicinity of Round Island Park, wherein he states: °'As the proposed purchase is only a quarter -mile from Round Island Park, ibis the opinion of this office that no action should be taken on this application until present efforts to expand the area of the park are completed, probably within the next three to six months. This is purely a precautionary move, however, and if the delay would work a genuine hardship on the applicant we would be glad to reconsider our position in this matter". No action was taken by the Board at this time because the matter had been tabled until the September 6 meeting. Mr. Philip Bragg and Mr. Alfred Sismey were present and objected to the change which included their property. Mr. Bragg stated he "bought it because it'was commercial property. It is 132 wide and a telephone easement runs through it, to zone it residential just confiscates my property and I can't do anything with He:regtested that.. hiss: property: be: left oiut' of the area to be rezoned. Mr:Sismey• •submitted a.jetter in which he stated a 'change in zoning would devaluate his property, but that he was not opposed to anyone wishing to have his own property rezoned. Mr. Albert Helseth, who had requested the change was also present. It was brought out that Mz. Helseth's original request for a. change in zoning contained only a portion of that area now being considered. Mr. Bragg then stated he would like to seethe zoning changed on that portion contained in Mr. Helseth's original request. Mr. Bragg stated that he had not been notified ofathe:hearing onc.,the'_proposed change. Mr. Bragg was advised that notification by letter is just a courtesy, that the Notice of Hearing had been advertized legally in the newspaper. The Administrator stated that letters had been sent to those affected by the original request and that it was an oversite in sending the letters that they had not been sent to those affected by the additional area included. After considerable further discussion, Commissioner Dritenbas moved that this matter be tabled until September 6 at 10:00 A. M., when ' the full Board is present. Motion was seconded by Commissioner McCullers and carried. ThereLbein ;ndoone'present,who wished to be heard on Item #2 as it appears in said Notice, on Motion by Commissioner Dritenbas, seconded by Commissioner McCullers, the following Resolution was unanimously adopted: AUG . 9198 Di IC) '44'24 • • RESOLUTION NO. 67-45 WHEREAS, the Zoning Commission of Indian River County, Florida, . did after public hearing make its final report recommending change. and additions to the Zoning Resolution of Indian River County, Florida; and, WHEREAS, this Board did publish its notice of said recommended changes and additions and did, pursuant thereto, hold a public hearing in relation.: thereto at which parties in interest and citizens were heard; Now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, that the Zoning Resolution of Indian River County, Florida, and the accompanying Zoning Map, be changed as follows: 1. That the Zoning Resolution be amended by adding thereto a new paragraph to be numbered 23, under Section 16, General Provisions, to be as follows: Airport Height Limitations: No structure shall be erected at a height in excess of those delineated on the Approach and Zoning Plan of the Vero Beach Municipal Airport • approved by the City of Vero Beach April 21, 1964. Channell in reply to his letter of July 24 concerning surfing at Wabasso Beach, that the County has no authority on the subject of surfing on the public beaches. On Motion by Commissioner McCullers, seconded by Commissioner Dritenbas and carried, Change Order No. Four, covering additional work in the new area to be occupied by the Supervisor of Elections and in the existing area occupied by the Supervisor, in the amount of $793.40, was approved. On Motion by Commissioner McCullers, seconded by Commissioner Dritenbas and carried, the request by Forrest McCullars, County Agent for out -of -county travel, August 16-19 to Ocala, was approved. The Sheriff filed with the Board a statement of his appointment of Donald O. Owens as a Deputy Sheriff, whose voting precinct is No. 1B; and his appointment of Evelyn L. Walters as a Deputy Sheriff, whose voting precinct is No. 3A, and said Deputy Sheriffs filed his bond with the Clerk of the Circuit Court, which were presented to the Board. On Motion by Commissioner McCullers, seconded by Commissioner Dritenbas and unanimously carried, the Bond of each said Deputy Sheriff was approved and ordered filed with the Clerk of the Circuit Court'. On Motion by Commissioner McCullers, seconded by Commissioner .Dritenbas, and unanimously .carried, the application of Joe S. Culpepper for License to carry Firearm, was approved. On Motion by Commissioner Diitenbas, seconded by Commissioner McCullers, and unanimously carried, the Payroll for State Witnesses Only, Circuit Court, dated 18th July, 1967, was approved. A letter from Dr. Aris Lindsey on behalf of the Indian River Riding Club requesting a suitable lease on some county property on which the Club may hold their events was received. No action was taken until the return of. the County Attorney.' AG; 0 aft, rn Motion was made by Commissioner McCullers, seconded by Commissioner Dritenbas and carried, that the Board approvds a millage of .22418 mill for the Indian River County Health Department for the fiscal year ending September 30, 1968. The several bilis and accounts against the County, having been audited, were examined and found to be correct, were approved and warrants issued in settlement of same as follows: General Fund, Nos. 7345 to 7421, both inclusive; Road and Bridge Fund, Nos. 4581 to 4622, I both inclusive; and Fine and Forfeiture Fund, Nos. 736 to 740, both inclusive. Such bills and accounts being on file in the office of the Clerk of the Circuit Court, and the warrants so issued from the respective funds being listed in the Supplemental Minute Book as provided 'by the rules of the State Auditor, reference to such record and list so recorded, being made a part of these minutes.
