In accordance with Contract No. 0726 This Work Order No . 3 is in accordance with the existing AGREEMENT dated November 6, 2007 , between Kimley- Horn and Associates , Inc . (SURVEYOR) and Indian River County (COUNTY) . This Work Order No. 3 amends the agreement as follows : SECTION I — PROJECT LIMITS ( Reference attached map) The SURVEY LIMITS are as follows : north limit is the north line of the Kroegel Homestead Subdivision (tax parcel 31390800003000000001 . 0) according to the plat thereof, as recorded in Plat book 8 , page 83 of the public records of Indian River County, Florida ; east limit is the mean high water line of the Indian River Lagoon ; south limit is the south line of tax parcel number 31 - 39-08-00000-0020-00003. 1 currently owned by Timothy P . and Carey A. Timinsky ; west limit is the easterly line of Indian River Drive . The existing docks at the north and south end of the project limits are also included . SECTION II — SCOPE OF SERVICES The scope of services for this Work Order No. 3 is the preparation of a Boundary Survey for Lot 1 , Kroegel Homestead Subdivision and the preparation of a Special Purpose Survey for the remaining parcels within the project limits. All above-ground visible improvements lying within Lots 1 and 3 of Kroegel Homestead Subdivision will be located . Those improvements on Lot 2 of Kroegel Homestead Subdivision that are currently shown on a survey by Carter Associates , Inc. will be graphically shown on the survey . The Special Purpose Survey will include the deed/monumented line for those parcels lying south of Kroegel Homestead Subdivision , the two existing docks , the mean high water line of the Indian River Lagoon , approximate location of the Intracoastal Waterway, the 3 'Y2 foot (depth) below mean low water level line and a delineation of the riparian lines associated with each parcel . The surveys will be prepared in accordance with Chapter 61 G17 ( Florida Minimum Technical Standards) as set forth for these types of surveys . Scope of Services include necessary site or County/Surveyor initiated meetings and coordination to satisfy the intent of the project . Boundary/Specific Purpose Survey - Riparian Rights Study November 20", 2007 Page 2 of 3 Deliverables for the 60 % County submittal will consist of paper copies of the Boundary Survey of Lot 1 , Kroegel Homestead Subdivision and the Special Purpose Survey of the remaining parcels lying within the project limits . An exhibit overlay of the Special Purpose Survey on color aerial photography will also be delivered to the County. SECTION III - TIME FOR COMPLETION/DELIVERABLES a) The preliminary 60% submittal will be delivered to the County for review and comments within 90 calendar days from Notice to Proceed . Final submittal will be delivered to the County within 15 calendar days of receipt of the preliminary submittal comments . b) Deliverables for the Preliminary submittal will consist of paper copies of the survey. c) Final deliverables shall be in the following format: One certified reproducible Mylar, three certified hardcopy (paper versions) , one CD or DVD disc with the Autocad file (version 2005 or better) and a PDF version . The product shall be prepared and plotted utilizing the supplied IRC standard AutoCad file format. d ) The SURVEYOR shall prepare its Work Product (Digital and paper versions) so that the COUNTY , consultants or the public can readily use it for design and analysis of the area defined . It shall contain all information necessary for a third-party surveyor to independently recreate and/or utilize the survey work. It is acknowledged that all final products become property of Indian River County and will be available for use by the public at large . e) The SURVEYOR'S work product shall meet or exceed the minimum standards as defined by Section II and made a part of this agreement, or the COUNTY will not approve the SURVEYOR'S request for payment. SECTION IV — COMPENSATION The COUNTY agrees to pay, and the SURVEYOR agrees to accept, a fee for services rendered according to the "Scope of Services" identified in Section I , II and III of this work order and man hours attached hereto this Work Order No . 3 , a Lump Sum of $26 , 830 . 00 . All and/or any additional services not described hereon shall be pre-approved by the COUNTY. Approved additional services shall be invoiced at the rates disclosed in the approved fee schedule with the SURVEYOR for the contract year(s) of November 6th , 2007 through November 5th , 2009 . All invoicing and payments shall be in accordance with the original Professional Surveying Services Agreement for Annual Surveying and Mapping Services , Contract No . 075 with the COUNTY and as stated in Section III and IV hereon .
